2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 183.

4 WHEREAS, heretofore, a petition was filed with the Common Council of
5 the City of San Bernardino requesting that certain uninhabited territory con-
6 tiguous to said City be annexed to the City of San Bernardino, and which said
7 petition described said territory and the boundaries thereof proposed to be
8 annexed to the City; and
9 WHEREAS, said petition was filed by the owners of not less than
10 one-fourth of the area of land in such territory, and representing not less
11 than one-fourth of the assessed value of such territory according to the last
12 preceding equalized assessment roll of the County of San Bernardino, in which
13 said County the City of San Bernardino is situated; and
14 WHEREAS, said petition requested the said territory to be annexed to
15 and included in the said municipal corporation in accordance with the
16 provisions of the Government Code, Section 35300, et seq.; and
17 WHEREAS, on the 11th day of July, 1966, a Resolution was adopted by
18 the aforesaid Common Council of the City of San Bernardino, California,
19 proposing the annexation of the aforesaid uninhabited territory, to be
20 generally known as ANNEXATION DISTRICT NO. 183, to the City of San Bernardino,
21 and that said Resolution provided therein that the proposed annexation should
22 be generally known and identified as ANNEXATION DISTRICT NO. 183; and
23 WHEREAS, said Resolution set forth therein that all the property
24 included in the aforesaid territory should be taxed equally with the other
25 property within the said City to pay the bonded indebtedness and any and all
26 general indebtedness and liability of the City of San Bernardino contracted
27 pr~or to or existing or outstanding at the time of the aforesaid proposed
28 annexation of the aforesaid property as provided in the hereinbefore
29 mentioned Government Code; and
30 WHEREAS, said Resolution did fix, determine and declare that a
31 hearing be held on the 22nd day of August, 19~6, at the hour of 7:00 o'clock
32 p, M. in the Council Chambers of the City Hall in the City of San Bernardino,
1 and the same was the day, hour and place designated where any person owning
2 real estate within such territory so proposed to be annexed and having any
3 objections to the proposed annexation might object before the Common Council
4 and show cause why such territory should not be annexed; and, furthermore, the
5 said Resolution provided that at any time not later than the said hour set,
6 as mentioned hereinbefore for the said hearing, any owner of property within
7 the said territory proposed to be annexed might file written protest with the
8 City of San Bernardino against such annexation; and
9 WHEREAS, there were two written protests filed with the City Clerk of
10 the City of San Bernardino prior to 7:00 o'clock P. M. on the 22nd day of
11 August, 1966; and
12 WHEREAS, on the 22nd day of August, 1966, the date set for the
13 hearing of protests against the proposed annexation, Resolution No.?..:1t> /was
14 adopted by the Common Council of the City of San Bernardino declaring that a
15 majority of protests has not been presented; and
16 WHEREAS, it appears to the Common Council of the City of San
17 Bernardino that the aforementioned annexation proceedings have been completed
18 and everything performed at this time in accordance with said Government Code,
19 as mentioned hereinbefore, and any and all other laws in any way connected
20 with the said annexation procedure having been complied with; and
21 WHEREAS, the Common Council of the City of San Bernardino desire to
22 approve at this time the annexation of the aforesaid territory.
23 NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
24 DO ORDAIN AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation
26, District No. 183 is hereby annexed and incorporated in and made a part of the
27 City of San Bernardino.

SECTION TWO: The territory herein referred to as being annexed to
29 the City of San Bernardino is particularly described as follows, to wit:
30 Those portions of Lots 1, 2, 3 and 4, Block 42 and Lot 17,
Block 43, Rancho San Bernardino, as per plat thereof
31 recorded in Book 7 of Maps, Page 2 and those portions of
Lots 1, 2, 3 and 4, Jackson Subdivision, as per plat
32 thereof recorded in Book 18 of Maps, Page 77, records of

the County Recorder of San Bernardino County, State of
California, described as follows:

Beginning at a point in the Present Corporate Limits of
the City of San Bernardino, said point being the inter-
section of the North line of Ninth Street, 82.50 feet
wide, and a line which is 30.00 feet East of and parallel
with the West line of said Lot 4, Block 42; thence North
along said parallel line and said City Limit line a
distance of 965.00 feet, more or less, to the North line
of said Lot 4, Block 42; thence leaving said City Limit
line, East along the North line of said Lots 4, 3, 2 and
1, Block 42 and their Easterly prolongation to the center-
line of Tippecanoe Street, 82.50 feet wide; thence South
along the centerline of said Tippecanoe Street, a distance
of 2020.00 feet, more or less, to its intersection with
the Easterly prolongation of the South line of said Lot
4, Jackson Subdivision; thence West along said Easterly
prolongation, the South line of Lots 4, 2 and 1, Jackson
Subdivision and the South line of Lot 17, Block 43 of
said Rancho San Bernardino to the Southwest corner of said
Lot 17, said point being in the said City Limit line;
thence North along said City Limit line and the West line
of said Lot 17 to the Northwest corner thereof said point
being in the South line of said Ninth Street; thence East
along said City Limit line and the South line of said
Ninth Street a distance of 30.00 feet to a point which
is South of the point of beginning; thence North along
said City Limit line to the point of beginning.

SECTION THREE: That the above described property will be subject to
18 taxation equally with the property within such municipal corporation to pay
19 its proportion of the following bonded indebtedness of the City of San
20 Bernardino, which said bonded indebtedness was outstanding or theretofore
21 authorized and is outstanding at the time of said annexation, to wit:
22 A bonded indebtedness of $490,000.00 incurred for the acquisition
231 and construction of a public library, ::j.ncluditlg: additiops to and enlargements
24 I of the public library system of said City, the outstanding indebtedness
25 thereon being $350,000.00, bearing interest at the rates of 4 3/4%, 3 1/4%
26 and 3 1/2% per annum;
27 A bonded indebtedness of $1,116,000.00 incurred for the acquisition
28 and construction of additions to, relocations of and replacements of the fire
29 fighting system of said City, the outstanding indebtedness thereon being
30 $955,000.00, bearing interest at the rates of 4%, 3%, 2 1/2%, 2 3/4% and
31 2.9% per annum.

SECTION FOUR: The property herein annexed is declared to be a part

of Ward 1 and the boundaries of Ward 1 are hereby altered to include said
