HomeMy WebLinkAbout2772 I '! 1 NOTICE OF ELECTION ORDINANCE NO. ;17,1 J-, 2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO CALLING A SPECIAL ELECTION TO BE HELD ON THE FIFTEENTH DAY OF NOVEMBER, 1966, PERTAINING TO THE ANNEXATION OF A DISTRICT CALLED: 3 4 5! I 61 7! 81 "ANNEXATION DISTRICT NO. 184" WHEREAS, by Resolution, the Mayor and Common Council of the City of San Bernardino declared its intention to call a special election to be held in certain inhabited territory contiguous to said City proposed to be annexed to said City for the purpose of submitting to the qualified electors 91 I 10! I 111 12 residing in said territory the question whether or not said territory shall be annexed to said City; and WHEREAS, a copy of said Resolution was published as required by law; and 13 WHEREAS, at a time not later than the hour set by said Resolution 14 for hearing objections to the proposed election, no written protests were 15 made by the owners of one-half of the value of the territory propcrsed to be 16 annexed as shown by the last equalized assessment roll of the property 17 within the territory proposed to be annexed; and 18 WHEREAS, thereafter on-the 6th day of September, 1966, Resolution 19 No. 8320 was adopted by the Mayor and Common Council declaring that a majority 20 protest has not been presented; and 21 WHEREAS, all proceedings have been had in accordance with said 22 231 i 24 i Resolutions and the Annexation Act of 1913, reference thereto hereby being made for further particulars. NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF 25 SAN BERNARDINO DO ORDAIN AS FOLLOWS: 26 SECTION ONE: A special election hereby is called, to be held on 27 the 15th day of November, 1966, in the territory hereinafter described and 28 proposed to be annexed to the City of San Bernardino, for the purpose of 29 submitting to the qualified electors residing in said territory the question 30 whether or not such territory shall be annexed to, incorporated in and made 31 a part of said City of San Bernardino, and whether or not the property in 32 said territory shall, after such annexation, be subject to taxation equally 41 51 61 7' 1 81 , , 91 I 10 11 I , 121 131 I 14' 23:1 24 25 26 27 28 29 1 with the property within the City of San Bernardino to pay the entire bonded 2 indebtedness of the City of San Bernardino outstanding at the date of the 3 first publication of the notice of election for annexation. Said territory is described as follows: Those portions of Lots 9 and 10, Block 55 and Lots 6, 7, and 8, Block 46, Rancho San Bernardino as per plat thereof recorded in Book 7 of Maps, Page 2; those portions of Tract 3057, as per plat thereof recorded in Book 42 of Maps, Pages 22 and 23; Tract 2221, as per plat thereof recorded in Book 31 of Maps, Page 88; Tract 2980, as per plat thereof recorded in Book 41 of Maps, Page 50; Tract 2l94,as per plat thereof recorded in Book 31 of Maps, Page 73; and Tract 2228, as per plat thereof recorded in Book 31 of Maps, Page 95, records of the County Recorder of San Bernardino County, State of Califonnia, described as follows: 15 ! 16' Beginning at a point on the present corporate limits of the City of San Bernardino, said point being the intersection of the centerline of Waterman Avenue, 82.50 feet wide and the Westerly prolongation of the South line of the North two acres of the South one-half of said Lot 8, Block 46; thence Easterly along said Westerly prolongation and said South line of said North two acres and said City Limit line to the West line of said Lot 9, Block 46; thence Southerly along said West line of Lot 9 and said City Limit line to the Southwest corner thereof; thence Easterly along the South line of said Lot 9 and said City Limit line to the Southeast corner of the West one-half of said Lot 9; thence leaving said City Limit line and continuing Easterly along the North line of Lots 19, 20, 21, 22, and 23 of said Tract 3057 and the North line of Lot 9 of said Tract 2221 and the Easterly prolongation thereof to its intersection with the centerline of Valley View Avenue, 50.00 feet wide; thence Southerly along said centerline of Valley View Avenue to its intersection with the centerline of Central Avenue, 82.50 feet wide; thence Westerly along said center- line of Central Avenue to its intersection with the centerline of Valley View Avenue, 40.00 feet wide; thence Southerly along said centerline of Valley View Avenue to the North line of Lot 30 of said Tract 2228; thence Westerly along the North line of Lots 30, 18, and 69 of said Tract 2228 and the Westerly prolongation thereof to its intersection with the centerline of Foisy Street; thence Southerly along said centerline of Foisy Street to its intersection with the centerline of Norman Road, 60.00 feet wide; thence Westerly along said centerline of Norman Road to its intersection with the centerline of Waterman Avenue, 82.50 feet wide; thence Northerly along said centerline of Waterman Avenue to the point of beginning. i 17' 181 I , I 19' 20 21 22 SECTION TWO: TIME OF OPENING AND CLOSING OF POLLS. The polls at 30 said election shall be opened at 7 o'clock A. M. of the day herein fixed for 31 the holding of said election and shall be kept open until 7 o'clock P. Upon the ballots to be used at said 2 3 election there shall be printed the words: SHALL ANNEXATION DISTRICT NO. 184 BE ANNEXED TO, INCORl'ORATED IN 4 AND MADE A PART OF THE CITY OF SAN BERNARDINO AND THE PROPERTY IN SUCH TERRITORY BE, AFTER SUCH ANNEXATION, SUBJECT TO TAXATION EQUALLY WITH THE PROPERTY WITHIN THE CITY OF SAN BERNARDINO, TO PAY ITS PRO-RATA PORTION, BASED UPON ASSESSED VALUATION OF ALL BONDED INDEBTEDNESS OF THE CITY OF SAN BERNARDINO OUTSTANDING AT THE DATE OF THE FIRST PUBLICATION OF THE NOTICE OF ELECTION FOR ANNEXATION? Opposite these words there shall be printed the words "YES" and '!NO", and to the right of each of these last two words there shall be a voting square. If an elector shall stamp a cross (+) in the voting square after the printed word "YES", the vote of such elector shall be counted in favor of the annexation of said territory to the City of San Bernardino, and if an elector shall stamp a cross (+) in the voting square after the vrtrtted word "NO", the vote of such elector shall be counted against such annexation. In all particulars not herein recited, said election shall be held in conformity as near as may be with the laws of the State of California concerning general election, and with said Annexation Act of 1913. SECTION FOUR: For purpose of said election there hereby is established in the territory described herein one (1) consolidated voting precinct which shall include all of said territory. The following is the polling place of said election precinct, and the following named persons hereby are designated as officers of election and shall constitute the board of election for such election precinct: Consolidated Voting Precinct No. 1 shall be comprised of those portions of County Precincts Mill 4 and 5 lying within the boundaries of the annexation territory. SECTION SIX: The City Clerk shall certify to the passage and adoption of this Ordinance by the Common Council of the City of San Bernardino and shall cause the same to be published three consecutive days, exclusive of holidays, in the San Bernardino Evening Telegram, a daily newspaper of general circulation printed and published within the City of San Bernardino, and once a week for four (4) weeks prior to the date of the election in the Highland Messenger, a newspaper of general circulation printed and published outside of the City of San Bernardino but in the County of San Bernardino, California, 13: I 141 15 161 which said Ordinance shall be preceded by the words "Notice of Election", and that due publication of this Ordinance as herein provided is hereby determined to be sufficient notice of said election, and the only notice that shall be required to be given. 17i 18: I 19i I 201 211 I HEREBY CERTIFY that the foregoing Ordinance was duly passed and adopted by the Mayor and Common Council of the City of San.
