AND REQUIRING A PERMIT FOR THE PROVIDING OF ENTERTAINMENT IN ANY PlACE WHERE FOOD OR REFRESHMENTS 4 ' ARE SERVED. 5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS ~ 8 7 SECTION ONE~ Ordinance No. 763 is hereby amended by adding thereto Section Forty-One to read as follows: SECTION FORTY-ONE: (a) Entertainment in place serving food or refreshments-~ Permit required. No person shall provide or permit any type of entertainment in a coffee shop, restaurant or place where food or other refreshments are served and which is open to the public, unless such person shall first obtain a permit so to do from the City Council as hereinafter provided. A restaurant or place where food or other refreshments are served shall include any place or premise where alcoholic bever- ages only are served. Entertainment shall include any presentation or activity 19 ! I of any nature which is designed or intended to divert, amuse, or 20 ' , i attract the attention of persons observing such presentation or 21 ' , I activity, including, but not limited to, any type of presentation 221 I in which live models appear before an audience of any number of 23 i 24 25 28 27 28 29 30 31 32 persons. (b) Application for permit. Applicants for entertainment permits shall file a written, signed and acknowledged application with the City Clerkshowing~ ,', (1) The name and permanent address of applicant. (2) A detailed description of the entertainment, in- cluding the type of entertainment, number of persons engaged in the entertainment, purpose of the entertainment, and any further information about the entertainment as the Council may deem necessary. 1 (3) The date, hours and location where said entertain- 2 ment is proposed, and the admission fee, if any, to be charged. 3 I 4:' the management or supervision of applicantfs business. (4) The name or names of the person or persons having 5 (5) The length of residence of applicant within the 6 City. 7 (6) A statement of the nature and character of ap- I 8 plicantfs business, if any, to be carried on in conjunction with 9 such entertainment. 10 (7) Whether or not the person or persons having the I 11 management or supervision of applicantfs business have been con- 12' victed of a crime, the nature of such offense, and the sentence 13 received therefor. 14 (8) Such other reasonable information as to the iden- 15 tity of character of the person or persons having the management 16 or supervision of applicant's business as the Council may deem 17 necessary. I 181 (c) Application fee. A fee of $25.00 shall be paid upon 19 the filing of each application for a permit for the purpose of 20 defraying the expenses incidental to the processing of said 21 application. 22 (d) Granting permit. After the making and filing of said 23 application, the City Clerk shall refer the matter to the Chief 24 of Police for investigation and report thereon. If satisfied 25 as to the moral character and business responsibility of the 28 applicant and that said entertainment, as proposed, will not 27 be detrimental to the public welfare, the Council shall grant 28' a permit. 29 The permit shall be granted for the specific occasion re- 30 quested, or if,the request is for a continuous permit, said . 31 permit shall be issued for not longer than one year. 32 (e) Exclusions. The provisions of Section One shall not . -2- 1 be deemed to require a permit for the following: 2 (1) For the use of a radio or music recording machine, 3 or juke box in any establishment. 4 i (2) For any entertainment provided under the super- 5 vision of school authorities, City of San Bernardino, or any 8 nonprofit organization. 71 (3) For entertainment provided by any individual or I 8' individuals playing musical instruments. 9 (4) For any entertainment provided for members and I 10il their guests at a private club where admission is not open to the 11 pub lic . 12 (5) For entertainment conducted in connection with a I 1311 regularly established recreational park, circus or fairground. 141 (6) For entertainment conducted by or sponsored by 15 any bona fide club, society or association, organized or incorpor- 16 ated for benevolent, charitable, dramatic or literary purposes 17 having an established membership and which holds meetings other 18. than for such entertainment at regular intervals, when proceeds, if 191 any, arising from such entertainment are used for the purposes of I 201 such club, society or association. 21 (7) For entertainment conducted in connection with 22 any dance. 23 (f) Live Female Entertainment. Live female entertainers 24 shall not be permitted to mingle with or fraternize with the patron 25 and customers present on the premises, and such entertainers shall 28 be restricted to performing on a raised platform which is at least 27 eighteen (18) inches above the floor level, and a minimum of six 28 (6) feet in distance from the nearest patron or customer, and such 29 live female entertainers shall not be permitted to perform any 30 function, duty df'position other than as an entertainer. 31 The mere presence of any female employee in such public 32 place, unclothed.or in such attire, costume or clothing as to . -3- 8: 9. loll 1 expose to public view any portion of either breast at or below 2 the areola thereof or of any other private part of any such 3 employee, or the permitting or allowing of any other female 4' present on the premises to participate in any performance in 5 such public place, unclothed or in such attire, costume or clothing, shall constitute "live female entertainment" within the meaning of the term as used in this subsection. 6 7 I HEREBY CERTIFY that the foregoing ordinance was duly adopted by the Mayor and Common Council of the City of San Bernar- dino at q~ 11! d:Z.,3.4L- day meeting thereof, held on the , 1967, by the following vote, to 12 13 14, :i 151! 16 il 1711 1811 II I. 191i of 20: I 21 22 231 24 25 26 27 28 29 30 31 32 wit~ councilme~ AYES: NOES: ~-" ABSENT: flaJ ~ c~~, e foregoing ordinance is hereby approved this~~~day , 1967.
