2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. .187.

WHEREAS, heretofore, a petition was filed with the Common Council
of the City of San Bernardino requesting that certain uninhabited territory
6

contiguous to said City be annexed to the City of San Bernardino, and which
~aid petition described said territory and the boundaries thereof proposed to
8
9
be annexed to the City; and
WHEREAS, said petition was filed by the owners of not less than
10
11
one-fourth of the area of land in such territory, and representing not less
than one-fourth of the assessed value of such territory according to the last
12
preceding equalized assessment roll of the County of San Bernardino, in which
13
said County the City of Sanllernardino is situated; and
14
WHEREAS, said petition requested the said tertitory to be annexed
15
to and included in the said municipal corporation in accordance with the
16
provisions of the Government Code, Section 35300, et seq.; and
17
WHEREAS, on the 27th day of December, 1966, a Resolution was adopted
18

by the aforesaid Common Council of the City of San Bernardino, California,
proposing the annexation of the aforesaid uninhabited territory, to be
20
21
geneBa11y known as Annexation District No. 187, to the City of San Bernardino,
and that said Resolution provided therein that the proposed annexation should
be generally known and identified as Annexation District No. 187; and
WHEREAS, said Resolution set forth therein that all the property
included in the aforesaid territory should be taxed equally with the other
propertYiwithin the said City to pay the bonded indebtedness and any and all
general indebtedness and liability of the City of San Bernardino contracted
prior to or existing or outstanding at the time of the aforesaid proposed
annexation of the aforesaid property as provided in the hereinbefore
mentioned Government Code; and
WHEREAS, said Resolution did fix, determine and declare that a
hearing be held on the 6th day of February, 1967, at the hour of 9:30 o'clock
A, M. in the Council Chambers of the City Hall in the City of San Bernardino,

1 . and the same was the day, hour and place designated where any person owning
2 real estate within such territory so proposed to be annexed and having any
3 objections to the proposed annexation might object before the Common Council
4 and show cause why such territory should not be annexed; and, furthermore, the
5 said Resolution provided that at any time not later than the said hour set,
6 as mentioned hereinbefore for the said hearing, any owner of property within
7 the said territory proposed to be annexed might file written protest with the
8 City of San Bernardino against such annexation; and
9 WHEREAS, no written protests of any kind or nature whatsoever were
10 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock
11 A. M. on the 6th day of February, 1967, and thereafter on the 6th day of
12 February, 1967, Resolution No.8542 was adopted by the Mayor and Common Council

declaring that a majority protest has not been presented; and

WHEREAS, it appears to the Common Council of the City of San
15
Bernardino that the aforesaid annexation proceedings have been completed and
16
everything performed at this time in accordance with said Government Code,
17
as mentioned hereinbefore, and any and all other laws in any way connected
18
with the said annexation procedure having been complied with; and
19
WHEMAS, the Common Council of the City of San Bernardino desire to
20
approve at this time the annexation of the aforesaid territory.

NOW, THEREFORE,~THE MAYOR AND COMMON COUNCIL OF THE CITY OF

SAN BERNARDINO DO ORDAIN AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation
24 District No. 187 is hereby annexed and incorporated in and made a part of
25 the City of San Bernardino.
SECTION TWO: The territory herein referred to as being annexed to
the City of San Bernardino is particularly described as follows, to wit:
Those portions of Lots 5 and 6, Block 7; Lots 5 and 6, Block
8; Lot 6, Block 12, West Highlands, as per plat thereof
recorded in Book 5 of Maps, page 77, records of the County
Recorder of San Bernardino County, State of California,
described as follows:

Beginning at a point on the present Corporate Limits of
the City of San Bernardino, said point being the inter-
section of the center lines of Citrus Street, 82.50 feet

wide and Victoria Avenue; thence South along said centerline
of Victoria Avenue and said City Limit line, a distance
of 2482.32 feet, more or less, to the Northerly line of
the Atchison, Topeka and Santa Fe Railway's 50.00 foot right
of way; thence leaving said City Limit line, North 690 22'
50" West (recorded North 690 22' West) along said Northerly
line, a distance of 686.92 feet, more or less, to the
Southwesterly corner of the property conveyed to the San
Bernardino County Flood Control District by Deed recorded
January 3, 1958 in Book 4404, page 141, Official Records
of said County as Instrument Number 8; thence North 030
25' 40" East (Recorded North 030 43' East) along the
Westerly line of said Flood Control property, a distance
of 1267.51 feet to the centerline of Date Street, 40.00
feet wide; thence Easterly along said centerline of Date
Street to its intersection with the Southerly prologgation
of the West line of said Lot 6, Block 12; thence Northerly
along said Southerly prolongation, the said West line and
its Northerly prologgation to the centerline of said Citrus
Street and said City Limit line; thence Easterly along
said centerline of Citrus Street and said City Limit line
to the point of beginning. Containing 30.20 Acres,
more or less.

SECTION THREE: That the above described property will be subject
14 to taxation equally with the property within such municipal corporation to
15 pay its proportion of the following bonded indebtedness of the City of
16 San Bernardino, which said bonded indebtedness was outstanding or theretofore
17 authorized and is outstanding at the time of said annexation, to wit:
18 A bonded indebtedness of $490,000.00 incurred for the acquisition
19 and construction of a public library, including additions to and enlargements
20 of the public library system of said City, the outstanding indebtedness
21 thereon being $330,000.00, bearing interest at the rates of 4 3/4%, 3 1/4%
22 and 3 1/2% per annum;
2.3 A bonded indebtedness of $1,116,000.00 incur.ed for the acquisition
24 and construction of additions to, relocations of and replacements of the
25 fire fighting system of said City, the outstanding indebtedness thereon being
26 $955,000.00, bearing interest at the rates of 4%, 3%, 2 1/2%, 2 3/4% and
27 2.9% per annum.

SECTION FOUR: The property herein annexed is declared to be a part
of Ward 4 and the boundaries of Ward 4 are hereby altered to include said
annexed territory; and said property is placed and declared to be in
R-1-7200, Single Family Residential Zone.
SECTION FIVE: The City Clerk shall certify to the passage of this

Ordinance and shall cause the same to be published three consecutive times,
exclusive of holidays, in the San Bernardino Evening Telegram, a daily
newspaper designated for that purpose.
I HEREBY CERTIFY that the foregoing Ordinance was duly adopted by
the Mayor and COl1lljlOn Council of the City of San Bernardino at an adjourned
