HomeMy WebLinkAbout2826 j 81 I I 9'1 I lOi: " 11i " 'I 12,: Ii 13il 14'1 'i 151 ,I 16il 'j !I 171 1811 " 191i i 20 21 22 23 24 25 26 27 28 29 30 31 32 1 ORDINANCE NO. r-2 .frJ t 2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO CREATING A RECREATIGNAND JUVENILE COMMISSION; PRESCRIBING ITS POWERS AND 3 DUTIES;~D REPEALING ORDINANCE NOS. 1610 AND 2692. ,,~ ' 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 5 SECTION ONE: There is hereby created a Recreation and Juvenile Commission of the City of San Bernardino which shall con- sist of nine (9) members who shall serve at the pleasure of the Mayor and Common Council. Each Councilman shall nominate one (1) member who shall serve for one (1) year; the Mayor shall nominate two (2) members who shall serve for two (2) years; thereafter, all members nominated shall be appointed by the Mayor for terms of two (2) years each. The terms shall commence on the second Monday of May, 1967 and shall terminate on the second Monday of May of the appropriate year. Each member of the Commission, after having been nominated, shall be appointed by the Mayor subj ect to the approval of the Common Council. Each member shall be a local elector and resident. 6 7 Subsequent vacancies shall be filled and appointments shall be made in the manner hereinbefore set forth. Each member shall serve without compensation. At the first meeting of the Commission it shall choose from its members a Chairman, a Vice-Chairman and a Secretary, who shall serve at the pleasure of the Commission. SECTION TWO: Regular meetings of the Commission shall be held at least once a month and special meetings may be held upon the call of the Chairman or any five (5) members. Five (5) members shall constitute a quorum for the transaction of business but a less number of members may adjourn from time to time. SECTION THREE: The Commission shall have charge of pro- moting and encouraging athletic sports, contests, games, aquatic games, community leagues, pageants, dramatics, music, public amusements, entertainments, picnics, and other public recreational, . 8 91 loll i 11i 121 1311 " II 141, " " 151[ 16 17 18 19 20 i 211 221 I 23 24 1 juvenile and play programs or activities. The Commission shall coordinate its 2 activities with the activities of the Park Commission and the Park Superintendent. 3 The Chairman of the Commission shall attend each meeting of the Park Commission. 41 5 SECTION FOUR: The Mayor shall appoint, with the approval of the Commission and subject to the confirmation of the Common Council, a Recreation 6 Director who shall be in the unclassified service of the civil service. 7 The Recreation Director shall manage and supervise the employees in the Recreation Department and the public recreation of the city within or without its corporate limits; shall aid and promote and supervise all functions of a public recreation nature or character, under and pursuant to the regulations of the Mayor and Common Council; shall administer the budgets of the Recreation and Juvenile Commission and the Recreation Department; shall supervise the Juvenile programs of the City and shall perform such other and additional duties as are or may be prescribed by ordinance, law, resolution or by order of the Mayor and Common Council. He shall coordinate his activities with the activities of the Park Superintendent. All permits for the use of recreation and juvenile facilities shall be issued in accordance with the rules of the Mayor and Common Council by the Recreation Director or such other officers as it may designate. SECTION FIVE: The Mayor and Common Council retains the power to set aside or to modify any action taken by the Commission and may in its discretion supersede it in any of its functions. SECTION SIX: The Mayor and Common Council of the City of San Bernardino shall and do hereby establish a fund to be known as the "Recreation 25 and Juvenile Fund." TheEe shall be deposited therein all monies received for 26 recreational and juvenile program purposes, the proceeds from all gifts, 27 legacies, bequests or other sources, and all monies derived from recreational 28. and juvenile program activities under the supervision or management of the 29' Recreation Director. All monies in said fund shall be used for public 30 recreation, juvenile programs and projects and related purposes. 31 SECTION SEVEN: If any section, sentence, clause or phrase of this 32 ordinance is for any reason held by a court of competent jurtadiction to be . - 2 - I 10 11 i 12 13. 141 Ii 1511 161 171 I 18 19. II 201" 21 22 of 23 24 215 26 27 28 29 30 31 32 1 invalid, such decision shall not affect the validity of the remaining portions of 2 this ordinance. The Common Council of the City of San Bernardino hereby declares 3 that it would have passed and does hereby pass this ordinance and each section, 4 sentence, clause and phrase hereof, irrespective of the fact that anyone or 15! more sections, sentences, clauses or phrases be declared invalid, or 6 unconstitutional. 7 SECTION EIGHT: This ordinance shall become effective July I, 1967. 8: SECTION NINE: Ordinance Nos. 1610 add 2692 are hereby repealed. 9 I HEREBY CllTIFY that the foregoing ordinance was duly adopted by Mayor and Coomon Council of the City of San Bernardino at a h 7hb~ meeting thereof held on the s-d day of ~ { _~ / {/ . the 1967, by the following vote, to wit: AYES: Councilmen NOES: ~~ /4]1-1/ ABSENT: J" aJ .C r;;::LL ( City Clerk \.. ordinance is hereby approved this I AI:r day , 1967.
