AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE
NO. 1987 ENTITLED IN PART "AN ORDINANCE REGUlATING THE OPERATION OF
TAXICABS, AMBUlANCES, TOWING VEHICLES . . ."; AND EXEMPTING FROM
THE PERMIT REQUIREMENTS ANY AMBULANCE WHICH IS TRANSPORTING A
PATIENT DIRECTLY FROM THE SAN BERNARDINO COUNTY GENERAL HOSPITAL
TO A POINT OUTSIDE THE CITY.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS 2

SECTION ONE: Ordinance No. 1987 Section Two is hereby
amended to read as follows:
"SECTION TWO: PERMIT REQUIRED. No person shall drive,
operate or cause to be operated, nor shall any person employ, per-
mit or allow another to drive, operate or cause to be operated, any
taxi, charter vehicle, sightseeing vehicle, ambulance, or towing
vehicle over any street of this City regardless of whether such
operation extends beyond the boundary limits of the City, nor shall
any person advertise for, solicit, induce, persuade, invite, or
.
procure such transportation of passengers, or sick or injured per-
sons or towing of vehicles without a permit first having been
obtained from the Bureau, subject to the exceptions set forth in
the following subsections.
(a) A vehicle or ambulance which is lawfully transporting
a passenger or a patient or towing a vehicle from a point outside
the City to a destination within the City, or en route to a desti-
nation outside the City, is excepted, provided that no such vehicle
shall solicit or accept a passenger or patient or tow a vehicle
from within the City, for transportation to any destination what-
soever without such permit.
(b) Any private ambulance accepting and transporting a
patient within the City when such private ambulance has been re-
quested or summoned by any police, fire, or civil defense authority
or has been informed by the person requesting such transportation
that no permittee hereunder is willing or able to render such
transportation and the Police Department of the City has been

notified that such transportation will be made, is excepted;
provided that the Bureau may revoke the permit of any permittee
refusing such transportation unless the following conditions exist~
:1
i. The permittee has notified the Bureau in writing
of the time and date of each such refusal and the reasons therefor

on or before the tenth day of the following month; and
ii. The Bureau finds that the permittee refusing

8 service was not able by reason of unavailability of equipment and
9 personnel to render such service. In making this finding, the
10 Bureau may require the permittee to furnish any further informa-
11 tion reasonably necessary for such determination.
12 (c) A vehicle being operated pursuant to franchise issued
13 I by the authority of the State Public Utilities Commission or

14! Interstate Commerce Commission is excepted.

(d) A vehicle being operated for the purpose of transporting
16 bona fide pupils attending an institution of learning between
17 their homes and such institution is excepted.

(e) A vehicle being operated under what is commonly re-

1911 ferred to as a "share-the-ride" plan or arrangement, as where a

20 person en route from his place of residence to his place of busi-
21 ness, or vice versa, transports another person living and working
22 in the same general vicinity upon payment of a sum estimated to
23 cover the actual or approximate cost of operation of the vehicle
24 is excepted.

(f) A vehicle rented or leased for self-operation by a
person using such vehicle under a plan commonly known as "U-Drive"
unless it is used by such person to transport other persons for
compensation, is excepted.
(g) Any ambulance maintained, owned or operated by any
30 firm, corporation, co-partnership or individual engaged in any
31 business other than the ambulance business in this City, which
32 said ambulance is maintained, owned or operated exclusively or

primarily for the use and benefit of officers. servants or employ-
ees of such firm. corporation. co-partnership or individual is
excepted.

(h) A towing vehicle being operated in response to calls
other than police calls is excepted.
(i) Any private ambulance which is lawfully transporting
a patient from the San Bernardino County General Hospital directly
and non-stop to a point outside the City is excepted.
