AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDI-
NANCE NO. 2676) KNOWN AS THE "UNIFORM BUIlDING ORDINANCE"; AND
EXEMPTING LAND RECLAMATION OR REFUSE DISPOSAL SITES FROM THE
EXCAVATION AND GRADING REQUIREMENTS THEREOF.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5 DO ORDAIN AS FOLLOWS:

SECTION ONE: Ordinance No. 2676 Section Three, which
7 amends certain sections and provisions of the Uniform Building
8 Code, Volume 1, 1964, is hereby amended by amending said Section
9 and Section 7003 of the said Code to read as follows:
"Section 7003. No person shall do any grading without
10
11 first having obtained a grading permit from the Building
12 Official, except for the following:
13
1. An excavation which (a) is less than two feet (2f)
in depth, or (b) which does not create a cut slope greater than
five feet (5') in height and steeper than one and one-half
14

horizontal to one vertical.

2. A fill less than one foot (I') in depth, and placed on
18 natural terrain with a slope flatter than five horizontal to
19 one vertical, or less than three feet (3 ') in depth, not in-
ro tended to support structures, which does not exceed 50 cubic
21 yards on anyone lot and does not obstruct a drainage course.

3. An excavation below finished grade for basements and
23 footings of a building, retaining wall or other structure
~ authorized by a valid building permit. This shall not exempt
25 any fill made with the material from such excavation nor exempt
26 any excavation having an unsupported height greater than five
27 feet (5') after the completion of such structure.

4. Excavation or deposition of earth materials within a
property which is dedicated or used, or to be used for cemetery
purposes, except where such grading is within one hundred feet
(lOa') of the property line or intended to support structures.
5. Mining, quarrying, excavating, processing, stockpiling

1 of rock, sand, gravel, aggregate, or clay where established and
2 provided for by law provided that such operations do not affect
3 the lateral support or unduly increase the stresses in or
4 pressure upon any adjacent or continguous property.

6. Grading in an isolated, self-contained area if the
6 Building Official finds that no danger to private or public
7 property can now or thereafter result from the grading operations.

7. A land reclamation or refuse disposal site and opera...
9 tion when the owners or operators have first obtained, and there-
10 after continually comply with, a conditional development permit
11 for a land reclamation or refuse disposal operation and have
12 first recorded with the County Recorder an agreement between
13 said owners and the city stating that the subject land has been
14 exempted from the excavation and grading ordinance and require-
15 ments and promising to comply with each condition of said con-
16 ditiona1 development permit. Such exemption shall be conditioned
17 upon compliance with the conditions and requirements of this
18 paragraph and the conditional development permit. The City
19
Engineer shall file and maintain a map depicting such land
reclamation or refuse disposal sites."
