2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 194.

4 WHEREAS, heretofore, a petition was filed with the Common Council
5 of the City of San Bernardino requesting that certain uninhabited territory
6 contiguous to said City be annexed to the City of San Bernardino, and which
7 said petition described said territory and the boundaries thereof proposed
8 to be annexed to the City; and
9 WHEREAS, said petition was filed by the owners of not less than
10 one-fourth of the area of land in such territory, and representing not less
11 than one-fourth of the assessed value of such territory according to the
12 last preceding equalized assessment roll of the County of San Bernardino, in
13 which said County the City of San Bernardino is situated; and
14 WHEREAS, said petition requested the said territory to be annexed
15 to and included in the said municipal corporation in accordance with the
16 provisions of the Government Code, Section 35300, et seq.; and
17 WHEREAS, on the 25th day of September, 1967, a Resolution was
18 adopted by the aforesaid Common Council of the City of San Bernardino,
19 California, proposing the annexation of the aforesaid uninhabited territory
20 and that said Resolution provided therein that the proposed annexation should
21 be generally known and identified as Annexation District No. 194; and
22 WHEREAS, said Resolution set forth therein that all the property
23 included in the aforesaid territory should be taxed equally with the other
24 property within the said City to pay the bonded indebtedness and any and all
25 general indebtedness and liability of the City of San Bernardino contracted
26 prior to or existing or outstanding at the time of the aforesaid proposed
27 annexation of the aforesaid property as provided in the hereinbefore
28 mentioned Government Code; and
29 WHEREAS, said Resolution did fix, determine and declare that a
30 hearing be held on the 6th day of November, 1967, at the hour of 9:30 o'clock
31 A. M. in the Council Chambers of the City Hall in the City of San Bernardino,
32 and the same was the day, hour and place designated where any person owning

1 real estate within such territory so proposed to be annexed and having any
2 objections to the proposed annexation might object before the Common Council
3 and show cause why such territory should not be annexed, and, furthermore,
4 the said Resolution provided that at any time not later than the said hour
5 set, as mentioned hereinbefore for the said hearing, any owner of property
6 within the said territory proposed to be annexed might file written protest
7 with the City of San Bernardino against such annexation; and
8 WHEREAS, no written protests of any kind or nature whatsoever were
9 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock
10 A. M. on the 6th day of November, 1967, and thereafter on the 6th day of
11 November, 1967, Resolution No. 8907 was adopted by the Mayor and Common
12 Council declaring that a majority protest has not been presented; and
13 WHEREAS, it appears to the Common Council of the City of
14 San Bernardino that the aforesaid annexation proceedings have been completed
15 and everything performed at this time in accordance with said Government
16 Code, as mentioned hereinbefore, and any and all other laws in any way
17 connected with the said annexation procedure having been complied with; and
18 WHEREAS, the Common Council of the City of San Bernardino desire
19 to approve at this time the annexation of the aforesaid territory.
20 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF
21 SAN BERNARDINO DO ORDAIN AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation
23 District No. 194 is hereby annexed and incorporated in and made a part of
24 the City of San Bernardino.

SECTION TWO: The territory herein referred to as being annexed to
26 the City of San Bernardino is particularly described as follows, to wit:
27 Those portions of Lots 3, 4, 5, and 6, Block 6; Lots 1,
2 and 3, Block 7; all of Blocks 1 and 2, West Highlands
28 as per plat thereof recorded in Book 5 of Maps, page 77,
Records of the County Recorder of San Bernardino County,
29 State of California; that portion of the Northeast one
quarter of Section 31, Township 1 North, Range 3 West,
30 San Bernardino Meridian if said section lines were
extended across Rancho Muscupiabe as per plat thereof
31 recorded in Book 7 of Maps, page 23, records of said
County; those portions of Lots 2, 3 and 4, Block 60,
32 Rancho San Bernardino, as per plat thereof recorded in

Book 7 of Maps, page 2, records of said County; that portion
of Shay's Subdivision, as per plat thereof recorded in Book
8 of Maps, page 44, records of said County, described as
follows:
Beginning at a point on the present corporate limits of the
City of San Bernardino, said point being the intersection
of the center line of Highland avenue and the Southerly
prolongation of the West line of Lot 3, of said Block 6,
West Highlands, said point also being 880 feet more or less
Easterly from the intersection of the center lines of
Highland Avenue and Sterling Avenue; thence Northerly along
said Southerly prolongation, the West line of said Lot 3,
and the Northerly prolongation thereof, also being the
present corporate limit line of said City to the center line
of Puma10 Street; thence Easterly along the center line of.
said Puma10 Street to the center line of Arden Avenue; thence
Southerly along the center line of said Arden Avenue to the
intersection of the Westerly prolongation of the South line
of Tract No. 5995 as per plat recorded in Book 77 of Maps,
Page 76, Records of the County Recorder of said County;
thence Easterly along said Westerly prolongation and the
South line of said Tract No. 5995 to a point on the East
line of said Lot 3, Block 7; thence Southerly along the
East line of said Lot 3 and the Southerly prolongation thereof
to the center line of said Highland Avenue; thence Westerly
along the center line of said Highland Avenue to the inter-
section of the Northerly prolongation of the East line of
said Block 2; thence Southerly along said Northerly prolon-
gation and the East line of Block 2 and Block 1 of said
West Highlands and the Southerly prolongation of said East
line of Block 1 a distance of 2650.00 feet more or less to
the center line of Pacific Street; thence Westerly along
the center line of Pacific Street a distance of 650.00 feet
more or less to the Northerly prolongation of the East line
of the West one half of said Lot 2, Block 60, Rancho San
Bernardino; thence Southerly along said Northerly prolon-
gation and the East line of the West one half of said

SECTION THREE: That the above described property will be subject
22 to taxation equally with the property within such municipal corporation to
23 pay its proportion of the following bonded indebtedness of the City of
24 San Bernardino, which said bonded indebtedness was outstanding or theretofore
25 authorized and is outstanding at the time of said annexation, to wit:
26 A bonded indebtedness of $490,000.00 incurred for the acquisition
27 and construction of a public library, including additions to and enlargements
28 of the public library system of said City, the outstanding indebtedness
29 thereon being $310,000.00, bearing interest at the rates of 4 3/4%, 3 1/4%
30 and 3 1/2% per annum;
31 A bonded indebtedness of $1,116,000.00 incurred for the acquisition
32 and construction of additions to, relocations of and replacements of the

1 fire fighting system of said City, the outstanding indebtedness thereon being
2 $910,000.00, bearing interest at the rates of 4%, 3%, 2 1/2%, 2 3/4% and
3 2.9% per annum.

SECTION FOUR: The property herein annexed is declared to be a part

of Ward 2 and the boundaries of Ward 2 are hereby altered to include said
6
annexed territory, with zoning classifications as shown on a map titled
7
"Exhibit A", on file in the office of the City Clerk, consisting of Block 1,
8
West Highlands, a portion of Shay's Subdivision, portions of Lots 2, 3, 4,
9
Block 60, Rancho San Bernardino, a portion of the Northwest one-quarter of

Section 31, Township 1 North, Range 3 West, described as follows:

recorded in Book 8 of Maps, page 44, records of San Bernardino

SECTION FIVE: The City Clerk shall certify to the passage of
21 this Ordinance and shall cause the same to be published three consecutive
22 times, exclusive of holidays, in the San Bernardino Evening Telegram, a
23 daily newspaper designated for that purpose.

25 the Mayor and Common Council of the City of San Bernardino at an adjourned
