HomeMy WebLinkAbout2865 1 ORDINANCE NO.. ,;z(l~- AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE NO. 2370 ENTITLED IN PART "AN ORDINANCE CREATING A BOARD OF POLICE COMMISSIONERS . . ."; PROVIDING THAT ONE MEMBER THEREOF SHALL BE AN ATl'ORNEY AT IAW; AND PROVIDING FOR HEARINGS FOR COMPIAINTS UPON RECOMMENDATION OF THE CHIEF OF POLICE. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 2 3 4 5 6 7 SECTION ONE: Ordinance No. 2370 Section Three is hereby amended to read as follows: 8 "SECTION THREE: MEMBERS. The Board shall consist of 9 10 five (5) members. Each member shall be a local elector and one member shall be admitted to the practice of law in the State of California. Members shall be appointed by the Mayor with ap~ proval of the Common Council; two shall be appointed for two- year terms and three for four-year terms ending on the second Monday of May 1963 and 1965 respectively, but they shall serve 11 12 13 14 15 until their respective successors are appointed and have quali- fied. All successors shall be appointed to four-year terms or to complete unexpired terms. Each member of the Board shall serve at the pleasure of the Council. At the first meeting of the Board, they shall choose from their me~bers a Chairman, a Vice Chairman, and a Secretary." 16 17 18 19 20 21 22 SECTION TWO: Ordinance No. 2370 Section Four is hereby amended to read as follows: 23 "SECTION FOUR: POWERS. The Board shall have power: (a) To prescribe such rules and regulations as they deem necessary or expedient for the administration of their duties, subject to approval by the Council, and shall adopt as a part of said Rules the present Rules and Regulations of the Police Department, which may be amended from time to time; (b) To investigate and to examine or inquire into the affairs or operation of any division or depart- ment of the Police Department and to make such recommendations to the Chief as may seem desirable; (c) To keep informed as to the latest practices in the field of law enforcement and to recommend to the Chief such new practices as appear to be of benefit to the Police Department and to the public; 24 25 26 27 28 29 30 31 32 . 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 1 (d) To assist the Chief upon his request in matters pertaining to appointments and promotions in the Police Department; (e) To review and, with the approval of the Chief, to hear and summarily recommend appropriate action concerning all complaints of misconduct, inefficiency, violation of rules or other charges against any of- ficer, member, or employee of the Police Department, except the Chief, thereof, and to recommend in writing to the Chief such action thereon as shall be most conducive to the maintenance and discipline and efficiency of such Department, subject to the Civil Service provisions of the Charter; to file written verified charges against any officer, member, or employee of the Police Department, subject to the Rules and Regulations of the Civil Service Board; and to recommend to the Chief that any officer, mem- ber, or employee be suspended, discharged or reduced in rank or compensation.
