2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDI-
NANCE NO. 763 ENTITLED IN PART "AN ORDINANCE PROVIDING FOR THE
3 LICENSING OF BUSINESSES, . . ."; AND WAIVING THE PAYMENT OF COSTS
OF THE IDENTIFICATION CARD FOR EACH LICENSED SOLICITOR.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5 DO ORDAIN AS FOLLOWS:

SECTION ONE: Ordinance No. 763 Section Lll-B is hereby
7 amended to read as follows:

"SECTION lll-B: Each solicitor who goes from house to
9 house or from place to place or to only one house or one place
10 within the City of San Bernardino, selling or taking orders for,
11 or offering to sell or take orders for, goods, wares, merchandise,
12 or magazines, periodicals, or publications or subscriptions for
13 the same, or any article, right, or privilege of value, for
14 future delivery, or for service to be performed in the future, or
15 for the making, manufacturing, or repairing of any article or
16 thing whatsoever for future delivery (religious material and
17 regularly published newspapers excepted) and each solicitor of
18 alms or donations of any nature who goes from house to house or
19 from place to place or to only one house or one place within the
~ City of San Bernardino is hereby required to register with the
21 Police Department of the City of San Bernardino and to obtain
22 an identification and registration card for which he shall pay
23 the sum of five dollars ($5.00) to defray costs, which sum is
~ waived in the case of a solicitor who represents a local,
25 established and licensed place of business, or who has obtained
U a business license as a solicitor under the provisions of
27 Section 111 of this ordinance; provided that the provisions of
28 this section shall ~ot apply to (1) a solicitor who represents a
29 bona fide local fraternal, charitable, or religious organization
~ which is exempt under the provisions of Section 115 of this
31 ordinance; (2) a person who has been issued a valid vocational,
32 oqcupational, or professional license by the State of California,
1 provided, however, that such person shall display written evidence
2 of such license to each resident during the period of solicita-
3 tion; (3) a disabled veteran who is exempt under the provisions
4 of Section 66-A of this ordinance; or (4) a solicitor who goes
5 only to a licensed local merchant for wholesale merchandising
6 purposes.
7 (1) Each applicant for registration hereunder shall be
8 photographed and fingerprinted by an employee of the Police
9 Department. One photograph shall be attached at all times to
10 the applicant's identification and registration card and another
11 photograph shall be retained by the Police Department.
12 The identification and registration card shall bear the
13 name of the applicant, the company or companies which he repre-
14 sents, and his photograph and right thumb print. It shall be
15 carried on the person of the applicant and shall be displayed to
16 all residents during the period of solicitation. It shall be
17 valid for a period of one year and may be renewed each year
18 thereafter for a fee of five dollars ($5.00).
19 (2) An identification and registration card shall be
~ issued to each applicant who has complied with the provisions of
21 this section and has submitted written evidence of his good
22 character, reputation or moral integrity, unless at the discretion
23 of the Chief of Police, after investigation and for good cause,
24 it is determined that an applicant has violated any provision
25 of this ordinance or has been convicted of a felony or a
26 criminal offense involving moral turpitude, or unless the pro-
~ posed sales proposition shall include an element of trickery,
28 fraud, or deceit, in which case, in the interest of public
29 safety and protection, a registration card shall not be issued.
~ A registration card may be revoked for any of the foregoing
31 causes in the discretion of the Chief of Police.
32 An applicant who has been denied a card or a solicitor

1 whose card has been revoked may within ten (10) days after such
2 denialior revocation, appeal the decision of the Chief of Police
3 to the Mayor and Common Council by filing a written appeal with
4 the City Clerk stating the action appealed from and the grounds
5 for the appeal. At the next meeting or at any subsequent meeting
6 to which the matter may be continued, the Mayor and Common Council
7 shall conduct a hearing at which time the appellant may appear
8 and be heard. The Mayor and Common Council may approve, modify
9 or reject the decision of the Chief of Police, and its decision
10 shall be final and conclusive."
