2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 197. (LAFC NO. 553)

4 WHEREAS, heretofore, proceedings were initiated by the Common
5 Council of the City of San Bernardino, on its own motion, to annex to the
6 City of San Bernardino certain contiguous uninhabited territory hereinafter
7 described; and
8 WHEREAS, on the 8th day of January, 1968, a resolution was adopted
9 by the aforesaid Common Council of the City of San Bernardino, California,
10 declaring that proceedings had been initiated by said Council and proposing
11 the annexation, for the reasons therein stated, of the aforementioned
12 uninhabited territory to the City of San Bernardino, and that said resolution
13 provided that the proposed annexation should be generally known and identified
14 as Annexation District No. 197; and
15 WHEREAS, said resolution set forth therein that all the property
16 included in the aforesaid territory should be taxed equally with the other
17 property within the City to pay the bonded indebtedness and any and all
18 general indebtedness and liability of the City of San Bernardino contracted
19 prior to or existing or outstanding at the time of the aforesaid proposed
20 annexation of the aforesaid property as provided in the hereinbefore
21 mentioned Government Code; and
22 WHEREAS, said resolution did fix,determine and declare that a
23 hearing be held on the 26th day of February, 1968, at the hour of 7:00 o'clock
24 P. M. in the Council Chambers of the City Hall in the City of San Bernardino,
25 and the same was the day, hour and place designated where any person owning
26 real estate within such territory so proposed to be annexed and having any
27 objections to the proposed annexation might object before the Common Council
28 and show cause why such territory should not be annexed; and furthermore,
29 the said resolution provided that at any time not later than the said hour
30 set, as mentioned hereinbefore for the said hearing, any owner of property
31 within the said tertitory proposed to be annexed might file written protest
32 with the City of San Bernardino against such annexation; and
1 WHEREAS, no written protests of any kind or nature whatsoyver were
2 filed with the City Clerk of the City of San Bernardino prior to 7:00 o'clock
3 P. M. on the 26th day of February, 1968, and thereafter on the 26th day of
4 February, 1968, Resolution Nu.geQ2'Mas adopted by the Mayor and Common Council
5 declaring that a majority protest has not been presented; and
6 WHEREAS, it appears to the Common Council of the City of
7 San Bernardino that the aforesaid annexation proceedings have been completed
8 and everything performed at this time in accordance with said Government Code,
9 as mentioned hereinbefore, ~ any and all other laws in any way connected
10 with the said annexation procedure having been complied with; and
11 WHEREAS, the Common Council of the City of San Bernardino desire
12 to approve at this time the annexation of the aforesaid territory.
13 NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
14 DO ORDAIN AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation
16 District No. 197 is hereby annexed and incorporated in and made a part of
17 the City of San Bernardino.

SECTION TWO: The territory herein referred to as being annexed to
19 the City of San Bernardino is particularly described as follows, to wit:
20 Those portions of Lots 1, 2, 3, Block 47, Lots 1, 2, 3, 4,
5, 6, Block 69, Lots 5, 6, 7, Block 70 and Lot 13, Block 72,
21 all of Rancho San Bernardino as per plat thereof recorded
in Book 7 of Maps, Page 2; those portions of Tract No. 2038
22 as per plat thereof recorded in Book 29 of Maps, Pages 51 and
52, Tract No. 2948, as per plat thereof recorded in Book 40
23 of Maps, Page 94, and of Tract No. 2767 as per plat thereof
recorded in Book 38 of Maps, Page 60, all of records of the
24 County Recorder of San Bernardino County, State of
California, described as follows:

Beginning at a point on the present corporate limits of the
City of San Bernardino, said point being the intersection
of the center lines of Central Avenue and Tippecanoe Avenue;
thence in a general Easterly direction along said City limits
line and following all its various courses and distances to
its intersection with the Northerly right of way line of the
Flood Control Channel being at the center line of Mill Street
(vacated); thence Southwesterly along said right of way line
following all its various courses and distances to an inter-
section with the center line of Mountain View Avenue; thence
South along said center line of Mountain View Avenue to an
intersection with the Easterly prolongation of the North
line of the property conveyed to Victoria Farms Mutual Water
Company by deed No. 61, recorded January 28, 1929 in Book 464,

Page 104, Official Records of said County; thence West along
said Easterly prolongation and the North line of said Water
Company property a distance of 305.00 feet; thence South
along the West line of said property a distance of 87.50 feet,
more, ,or less, to the South line of Lot 91 of said Tract No. 2948;
thence West along the South line of said Lot 91 to the East
line of Lot 92 of said Tract No. 2948; thence South along said
East line of Lot 92 to the Southeast corner thereof; thence
West along the South lines of Lots 92 through 108 of said
Tract No. 2948 and the Westerly prolongation thereof to the
center line of Shedden Drive; thence North along said center
line of Shedden Drive a distance of 10.00 feet to its
intersection with the Easterly prolongation of the South line
of Lot 168 of said Tract No. 2948; thence West along said
Easterly prolongation and the South line of said Lot 168 to
the Southwest corner thereof; thence North along the West
line of said Lot 168 to the Southeast corner of Lot 172 of
said Tract No. 2948; thence West along the South lines of
Lots 172 through 183 of said Tract No. 2948 and the Westerly
prolongation thereof to the center line of Richardson Street;
thence South along said center line of Richardson Street a
distance of 2034.00 feet, more or less, to its intersection
with the Easterly prolongation of the North line of the A. T.
& S. F. Railroad's 132.50 foot right of way; thence West along
said Easterly prolongation and said North line, a distance
of 250.00 feet to an angle point therein; thence South along
the West line of said right of way line a distance of 25.00
feet; thence West along the North line of the A. T. & S. F.
Railroad's 107.50 foot right of way a distance of 350.00
feet to an angle point therein; thence South along the West
line of said right of way a distance of 7.50 feet; thence
West along the North line of the A. T. & S. F. Railroad's
100.00 foot right of way and along its Easterly prolongation
to an intersection with the center line of Tippecanoe Avenue;
thence North along said center line to an intersection with
the Easterly prolongation of the South line of Lot 32 of
said Tract No. 2767; thence West along said Easterly pro-
longation and the South line to the Southwest corner of
said Lot 32; thence North along the West lines of Lots 32
to 23, inclusive, to an intersection with the South line
of Lot 22 of said Tract No. 2767; thence Westerly along
said South line, to the Southwest corner of said Lot 22;
thence Northerly along the West line of said Lot 22 and
its Northerly prolongation to an intersection with the center
line of Central Avenue, said center line being on the present
corporate limits of the City of San Bernardino; thence
Easterly along said center line and corporate limits, to
the Point of Beginning.

SECTION THREE: That the above described property will be subject
27 to taxation equally with the property within such municipal corporation to
28 pay its proportion of the following bonded indebtedness of the City of San
29 Bernardino which said bonded indebtedness was outstanding or theretofore
30 authorized and is outstanding at the time of said annexation, to wit:
31 A bonded indebtedness of $490,000.00 incurred for the acquisition
32 and construction of a public library, including additions to and enlargements

1 of the public library system of said City, the outstanding indebtedness
2 thereon being $310,000.00, bearing interest at the rates of 4 3/4%, 3 1/4%
3 and 3 1/2% per annum;
4 A bonded indebtedness of $1,116,000.00 incurred for the acquisition
5 and construction of additions to, relocations of and replacements of the
6 fire fighting system of said City, the outstanding indebtedness thereon being
7 $910,600.00, bearing interest at the rates of 4%, 3%, 2 3/4%, 2.9% and
8 2 1/2% per annum.

SECTION FOUR: The property herein annexed is declared to be a part
10 of Ward 1 and the boundaries of Ward 1 are hereby altered to include said
11 annexed territory, with zoning as shown on a map on file in the office of
12 the City Clerk titled "Zoning Study Map No.2" as follows.

SECTION FIVE: The City Clerk shall certify to the passage of this
24 exclusive of holidays, in the San Bernardino Evening Telegram, a daily
25 newspaper designated for that purpose.
26 I HEREBY CERTIFY that the foregoing Ordinance was duly adopted by
27 the Mayor and Common Council of the City of San Bernardino at a regular
