HomeMy WebLinkAbout2890 " 1 NOTICE OF ELECTION ORD INANCE NO.,-::( ~?/J 2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO CALLING A SPECIAL ELECTION TO BE HELD ON THE SEVENTH DAY OF MAY, 1968, PERTAINING TO THE 3 ANNEXATION OF A DISTRICT CALLED "ANNEXATION DISTRICT NO. 199". (LAFC No. 564) 4 WHEREAS, by Resolution, the Mayor and Common Council of the City of 5 San Bernardino declared its intention to call a special election to be held 6 "in certain inhabited territory contiguous to said City, proposed to be annexed 7 to said City, for the purpose of submitting to the qualified electors residing 8 in said territory the question whether or not said territory shall be annexed 9 to said City; and 10 WHEREAS, a copy of said Resolution was published as required by 11 law; and 12 WHEREAS, at a time not later than the hour set by said Resolution 13 for hearing objections to the proposed election, no written protests were 14 made by the owners of one-half of the value of the territory proposed to be' 15 annexed, as shown by the last equalized assessment roll of the property 16 within the territory proposed to be annexed; and 17 WHEREAS, thereafter on the 11th day of March, 1968, Resolution 18 No. '1of<! was adopted by the Mayor and Common Council declaring that a majority 19 protest has not been presented; and 20 WHEREAS, all proceedings have been had in accordance with said 21 Resolution and the Annexation Act of 1913, reference thereto hereby being 22 made for further particulars. 23 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF 24 SAN BERNARDINO DO ORDAIN AS FOLLOWS: 25 SECTION ONE: A special election hereby is called, to be held on 26 the 7th day of May, 1968, in the territory hereinafter described and proposed 27 to be annexed to the City of San Bernardino, for the purpose of submitting 28 to the qualified electors residing in said territory the question whether or 29 not such territory shall be annexed to, incorporated in and made a part of 30 the City of San Bernardino, and whether or not the property in said territory 31 shall after such annexation be subject to taxation equally with the property 32 within the City of San Bernardino to pay the entire bonded indebtedness of . 1 the City of San Bernardino outstanding at the date of the first publication 2 of the notice of election for annexation. 3 Said territory is described as follows: 4 Those portions of Lots 24 and 25, Block 54, Rancho San Bernardino as per plat thereof recorded in Book 7 of Maps, 5 Page 2, records of the County Recorder of San Bernardino County, State of California, described as follows: 6 8 Beginning at a point on the Present Corporate limits of the City of San Bernardino and the center line of Dumas Street, said point being at the most Westerly terminus of Dumas Street as said Street is delineated on the map of Tract No. 1995, as per plat thereof recorded in Book 29 of Maps, page 13, Records of the County Recorder of said County; thence Easterly along the center line of Dumas Street to the center line of Waterman Avenue 82.50 feet wide as said street is delineated on the map of said Rancho; thence Southerly along the center line of Waterman Avenue, a distance of 505.00 feet more or less to the Easterly prolongation of the North line of the property conveyed to Whittaker Electric Company, a California Corporation, Rose Miller, a widow, by Deed recorded September 28, 1962 in Book 5775, page 815, Official Records of said'County as Instrument Number 371, said point being 30 rods South of the North line of said Lot 25; thence Westerly along said Easterly prolongation and the North line of said Whittaker Electric Company property a distance of 1361.25 feet, more or less, to the West line of said Lot 25; thence Southerly along the West line of said Lot 25 a distance of 99.00 feet, more or less, to the Southeast corner of the property conveyed to Samuel James Bankhead and Helen Bankhead by Deed recorded June 11, 1954 in Book 3400, page 293, Official records of said County as instrument Number 142; thence Westerly along the South line of said Bankhead property and the South line of the property conveyed to Harvey H. Head and Naomi B. Head by Deed recorded April 19, 1967 in Book 6806, page 35, Official Records of said County as Instrument Number 187 and the Westerly prolongation thereof to the East line of the West one-third of said Lot 24; thence Northerly along the East line of the West one-third of said Lot 24 and the said City Limit Line to the North line of said Lot 24; thence Easterly along the North line of said Lot 24 and the City Limit Line a distance of 250.00 feet more or less to a point due South of the point of beginning; thence North along said City Limit Line to the point of beginning. 7 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 Containing 28.15 acres, more or less. 26 SECTION TWO: TIME OF OPENING AND CLOSING OF POLLS. The polls at 27 said election shall be opened at 7 o'clock A. M. of the day herein fixed for 28 the holding of said election, and shall be kept open until 7 o'clock P. M. 29 of the same day, when the polls shall be closed. 30 SECTION THREE: BALLOTS. Upon the ballots to be used at said 31 election there shall be printed the words: 32 - 2 - 1 SHALL ANNEXATION DISTRICT NO. 199 BE ANNEXED TO, INCORPORATED IN 2 AND MADE A PART OF THE CITY OF SAN BERNARDINO AND THE PROPERTY IN SUCH 3 TERRITORY BE, AFTER SUCH ANNEXATION, SUBJECT TO TAXATION EQUALLY WITH THE 4 PROPERTY WITHIN THE CITY OF SAN BERNARDINO, TO PAY ITS PRO-RATA PORTION, 5 BASED UPON ASSESSED VALUATION OF ALL BONDED INDEBTEDNESS OF THE CITY OF 6 SAN BERNARDINO OurSTANDING AT THE DATE OF THE FIRST PUBLICATION OF THE 7 NOTICE OF ELECTION FOR ANNEXATION? 8 Opposite these words there shall be printed the words "YES" and 9 "NO", and to the right of each of these last two words, there shall be a 10 voting square. If an elector shall stamp a cross (+) in the voting square 11 after the printed word "YES", the vote of such elector shall be counted in 12 favor of the annexation of said territory to the City of San Bernardino, and 13 if an elector shall stamp a cross (+) in the voting square after the printed 14 word "NO", the vote of such elector shall be counted against such annexation. 15 In all particulars not herein recited, said election shall be held 16 in conformity as near as may be with the laws of the State of California 17 conceruing general elections and with said Annexation Act of 1913. 18 SECTION FOUR: For purpose of said election there hereby is 19 established in the territory described herein one (1) consolidated voting 20 precinct which shall include all of said territory. The following is the 21 polling place of said election precinct, and the following named persons 22 hereby are designated as officers of election and shall constitute the board 23 of election for such election precinct: 24 Consolidated Voting Precinct No. 1 shall be comprised of that 25 portion of County Precinct Pickering Park 1 lying within the boundaries of 26 the annexation territory. 27 Polling Place - Allen Residence 24049 Dumas Street 28 Inspector - Dorothy R. Clerk - Agnes Robinson 23897 Dumas Street - 3 - . 1 SECTION FIVE: This Ordinance shall take effect upon its publication. 2 SECTION SIX: The City Clerk shall certify to the passage and 3 adoption of this Ordinance by the Common Council of the City of San Bernardino 4 and shall cause the same to be published- three consecutive days, exclusive of 5 holidays, in the San Bernardino Evening Telegram, a daily newspaper of general 6 circulation printed and published within the City of San Bernardino, and once 7 a week for four (4) weeks prior to the date of the election in the Highland 8 Messenger, a newspaper of general circulation printed and published outside 9 the City of San Bernardino but in the County of San Bernardino, California, 10 which said Ordinance shall be preceded by the words "Notice of Election", and 11 that due publication of this Ordinance as herein provided is hereby determined 12 to be sufficient notice of said election, and the only notice that shall be 13 required to be given. 14 I HEREBY CERTIFY that the foregoing Ordinance was duly passed and. 15 adopted by the Mayor and Common Council of the City of San Bernardino at 8 16 / i"~ day of ;. regular meeting hereof, held on the 17 _ ~";-f/1.-- ./ , 1968, following vote, to wit: 18 AYES: 19 20 NOES: ABSENT: .7./~ 21 22 23 j#~' Wk..
