2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 200 (LAFC No. 574).

4 WHEREAS, heretofore, a petition was filed with the Common Council
5 of the City of San Bernardino requesting that certain uninhabited territory
6 contiguous to said City be annexed to the City of San Bernardino, and which
7 said petition described said territory and the boundaries thereof proposed
8 to be annexed to the City; and
9 WHEREAS, said petition was filed by the owners of not less than
10 one-fourth of the area of land in such territory, and representing not less
11 than one-fourth of the assessed value of sncn territory according to the
12 last preceding equalized assessment roll of the County of San Bernardino, in
13 which said County the City of San Bernardino is situ~ed; and
14 WHEREAS, said petition requested the said territory to be annexed
15 to and included in the said municipal corporation in accordance with the
16 provisions of the Government Code, Section 35300, et seq.; and
17 WHEREAS, on the 4th day of March, 1968, a Resolution wa~ adopted
18 by the aforesaid Common Council of the City of San Bernardino, California,
19 proposing the annexation of the aforesaid uninhabited territory and that
20 said Resolution provided therein that the proposed annexation should be
21 generally known and identified as Annexation District No. 200; and
22 WHEREAS, said Resolution set forth therein that all the property
23 included in the aforesaid territory should be taxed equally with the other
24 property within the said City to pay the bonded indebtedness and any and all
25 general indebtedness and liability of the City of San Bernardino contracted
26 prior to or existing or outstanding at the time of the aforesaid proposed
27 annexation of the aforesaid property as provided in the hereinbefore
28 mentioned Government Code; and
29 WHEREAS, said Resolution did fix, determine and declare that a
30 hearing be held on the 22nd day of April, 1968, at the hour of 7:00 o'clock
31 P. M. in the Council Chambers of the City Hall in the City of San Bernardino,
32 and the same was the day, hour and place designated where any person owning

1 real estate within such territory so proposed to be annexed and having any
2 objections to the proposed annexation might object before the Common Council
3 and show cause why such territory should not be annexed; and, furthermore,
4 the said Resolution provided that at any time not later than the said hour
5 set, as mentioned hereinbefore for the said hearing, any owner of property
6 within the said territory proposed to be annexed might file written protest
7 with the City of San Bernardino against such annexation; and
8 WHEREAS, no written protests of any kind or nature whatsoever were
9 filed with the City Clerk of the City of San Bernardino pr~or to 7:00 o'clock
10 P. M. on the 22nd day of April, 1968, and thereafter on the 22nd day of
11 April, 1968, Resolution No. 9150 was adopted by the Mayor and Common
12 Council declaring that a majority protest has not been presented; and
13 WHEREAS, it appears to the Common Council of the City of
14 San Bernardino that the aforesaid annexation proceedings have been completed
15 and everything performed at this time in accordance with said Government
16 Code, as mentioned hereinbefore, and any and all other laws in any way
17 connected with the said annexation procedure having been complied with; and
18 WHEREAS, the Common Council of the City of San Bernardino desire
19 to approve at this time the annexation of the aforesaid territory.
20 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF
21 SAN BERNARDINO DO ORDAIN AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation
23 District No. 200 is hereby annexed and incorporated in and made a part of
24 the City of San Bernardino.

SECTION TWO: The territory herein referred to as being annexed to
26 the City of San Bernardino is particulatiy described as follows, to wit:
27 Those portions of the East one-half of Section 31, Township
1 North, Range 3 West, San Bernardino Meridian if said
28 section lines were extended across Rancho Muscupiabe as
per plat thereof recorded in Book 7 of Maps, page 23,
29 Records of the County Recorder of San Bernardino County,
State of California; that portion of Lot 1, Block 60,
30 Rancho San Bernardino, as per plat thereof recorded in
Book 7 of Maps, page 2, records of said County, described
31 as fo llows :
32 Beginning at a point on the present corporate limits of the

City of San Bernardino, said point being the intersection
of the center line of Pacific Street and the Southerly pro-
longation of the East line of Block 1 West Highlands as per
plat thereof recorded in Book 5 of Maps, page 77, Records
of the County Recorder of said County; thence North~along
said Southerly prolongation and the East line of said Block 1
to the intersection of the Westerly prolongation of the
center line of Seventeenth Street; thence Easterly along said
Westerly prolongation and the center line of said Seventeenth
Street to a point on the West line of Lot 67, Tract No. 3996
as per plat thereof recorded in Book 52 of Maps, page 64,
records of said County; thence South along the West line of
said Lot 67 to the Southwest corner thereof; thence Easterly
along the South line of said Lot 67 and the Easterly
prolongation thereof to the center line of Lynwood Way
also known as Rockford Avenue; thence South along the center
line of said Rockford Avenue to the intersection with the
center line of Western Avenue; thence Westerly along the
Westerly prolongation of the center line of Western Avenue
to a point on the West line of said Rockford Avenue; thence
South along the West line of Rockford Avenue and the West
line of Lots 13 and 34, Clark and Hinkle Subdivision as per
plat thereof recorded in Book 24 of Maps, page 64, Records
of the County Recorder of said County and the Southerly
prolongation thereof to the center line of Pacific Street;
thence East along the center line of Pacific Street to the
Northerly prolongation of the East line of that parcel
deeded to Court Street Fund, Inc., a corporation by Deed
recorded August 27, 1965, Document No. 167 in Book 6462,
page 137, Official Records of said County, said East line
also being the East line of the West one-half of the East
one-half of said Lot 1, Block 60; thence South along said
Northerly prolongation and the East line of said Court
Street Fund, Inc. property to the Southeast corner thereof;
thence West along the South line of said Court Street
Fund, Inc. property to a point on the East line of the San
Bernardino County Flood Control property by deed recorded
July 23, 1943, Document No. 34, in Book 1613, page 304,
Official Records of said County, said East line being the
East line of the West one-half of said Lot 1, Block 60;
thence South along said East line of said Flood Control
property to the Southeast corner thereof; thence West along
the South line of said Flood Control property to the South-
west corner thereof; thence North along the West line of
said Flood Control property and the West line of that parcel
deed to Dellason, Inc, a California Corporation by deed
recorded March 1, 1965, Document No. 65 in Book 6339, page
663, Official Records of said County, being also the West
line of the East one-half of the West one-half of said
Lot 1, Block 60, and the Northerly prolongation thereof to
the center line of Pacific Street; thence West along the
center line of Pacific Street to the point of beginning.

SECTION THREE: That the above described property will be subject
31 pay its proportion of the following bonded indebtedness of the City of
32 San Bernardino, which said bonded indebtedness was outstanding or theretofore

1 authorized and is outstanding at the time of said annexation, to wit:
2 A bonded indebtedness of $490,000.00 incurred for the acquisition
3 and construction of a public library, including additions to and enlargements
4 of the public library system of said City, the outstanding indebtedness
5 thereon being $310,000.00, bearing interest at the rates of 4 3/4%, 3 1/4%
6 and 3 1/2% per annum;
7 A bonded indebtedness of $1,116,000.00 incurred for the acquisition
8 and construction of additions to, relocations of and replacements of the
9 fire fighting system of said City, the outstanding indebtedness thereon being
10 $910,000.00, bearing interest at the rates of 4%, 3%, 2 1/2%, 2 3/4% and
11 2.9% per annum.

SECTION FOUR: The property herein annexed is declared to be a
13 part of Ward 2 and the boundaries of Ward 2 are hereby altered to include
14 said annexed territory, with zoning classifications as shown on a map titled
15 "Exhibit A", on file in the office of the City Clerk, consisting of portions
16 of the east one-half of Section 31, Township 1 North, Range 3 West, San
17 Bernardino Meridian, if said section lines were extended across Rancho
18 Muscupiabe, as per plat thereof recorded in Book 7 of Maps, page 23, records
19 of the County Recorder of San Bernardino County, State of California, and
20 that portion of Lot I, Block 60, Rancho San Bernardino, as per plat thereof
21 recorded in Book 7 of Maps, page 2, records of said County, and described
22 as follows:
23 R-3-3000 Multiple Family Residential Zone:
24 Parcell: (Portion Muscupiabe Rancho) Beginning at a
point in the north line of Pacific Street, said point
25 being 20 feet east of the present corporate limits of
the City of San Bernardino; thence north 220 feet; thence
26 east 540 feet, more or less; thence south 220 feet to the
north line of Pacific Street; thence west 540 feet, more
27 or less, along the north line of Pacific Street to the
point of beginning.

SECTION FIVE: The City Clerk shall certify to the passage of
28 this Ordinance and shall cause the same to be published three consecutive
29 times, exclusive of holidays, in the San Bernardino Evening Telegram, a
30 daily newspaper designated for that purpose.
