SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 201 (LAFC No. 573).

Council of the City of San Bernardino requesting that certain uninhabited
6
territory contiguous to said City be annexed to the City of San Bernardino,
7
and which said petition described said territory and the boundaries thereof
8
proposed to be annexed to the City; and
9
WHEREAS, said petition was filed by the owners of not less than
one-fourth of the area of land in such territory, and representing not less
than one-fourth of the assessed value of such territory according to the
last preceding equalized assessment roll of the County of San Bernardino, in
which said County the City of San Bernardino is situated; and
WHEREAS, said petition requested the said territory to be annexed
to and included in the said municipal corporation in accordance with the
provisions of the Government Code, Section 35300, et seq.; and
WHEREAS, on the 18th day of March, 1968, a Resolution was adopted
by the aforesaid Common Council of the City of San Bernardino, California,
proposing the annexation of the aforesaid uninhabited territory and that
said Resolution provided therein that the proposed annexation should be
generally known and identified as Annexation District No. 201; and
WHEREAS, said Resolution set forth therein that all the property
included in the aforesaid territory should be taxed equally with the other
property within the said City to pay the bonded indebtedness and any and all
general indebtedness and liability of the City of San Bernardino contracted
prior to or existing or outstanding at the time of the aforesaid proposed
annexation of the aforesaid property as provided in the hereinbefore
mentioned Government Code; and
WHEREAS, said Resolution did fix, determine and declare that a
hearing be held on the 29th day of April, 1968, at the hour of 9:30 o'clock
A. M. in the Council Chambers of the City Hall in the City of San Bernardino,
and the same was the day, hour and place designated where any parson owning

real estate within such territory so proposed to be annexed and having any

objections to the proposed annexation might object before the Common Council
3
and show cause why such territory should not be annexed; and, furthermore,
4
the said Resolution provided that at any time not later than the said hour
5
set, as mentioned hereinbefore for the said hearing, any owner of property
6
within the sGlid territory proposed to be annexed might file written protest
7
with the City of San Bernardino against such annexation; and
8
WHEREAS, no written protests of any kind or nature whatsoever were
9
filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock
A. M. on the 29th day of April, 1968, and thereafter on the 29th day of
April, 1968, Resolution NO:l'l'~;r was adopted by the Mayor and Common Council
declaring that a majority protest has not been presented; and
WHEREAS, it appears to the Common Council of the City of
San Bernardino that the aforesaid annexation proceedings have been completed
and everything performed at this time in accordance with said Government
Code, as mentioned hereinbefore, an~ any and all other laws in any way
connected with the said annexation procedure having been complied with; and
WHEREAS, the Common Council of the City of San Bernardino desire
to approve at this time the annexation of the aforesaid territory.
NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO DO ORDAIN AS FOLLOWS:
SECTION ONE: 'That said territory hereiri described as Annexation
District No. 201 is hereby annexed and incorporated in and made a part of
the City of San Bernardino.
SECTION TWO: The territory herein referred to as being annexed to
26 the City of San Bernardino is particularly described as follows, to wit:
27 Those portions of Lots 104, 105 and 116, Arrowhead Suburban
Farms, Tract E. Tract No. 1748 as per plat thereof recorded
28 in Book 25 of Maps, Page 59, records of the County Recorder
of San Bernardino County, State of California, and those
29 portions of Reservoir Drive, Magnolia Drive and Forty-second
Street, described as follows:

Beginning at a point on the Present Corporate limits of the
City of San Bernardino, said point being the intersection
of the West line of Magnolia Drive, 40.00 feet wide, and the
South line of Reservoir Drive, 40.00 feet wide; thence West

along the South line of Reservoir Drive and said City Limit
Line, to the Northwest corner of Lot 135 of said Tract
No. 1748; thence North to the center line of said Reservoir
Drive; thence leaving said City Limit Line, East along the
center line of said Reservoir Drive to its intersection with
the center line of Orange Drive; thence North along the
center line of Orange Drive to the Westerly prolongation of
the North line of said Lot 116; thence Easterly along said
Westerly prolongation and the North line of said Lot 116 to
the Southwest corner of Lot 104; thence North along the
West line of Lot 104 to the Northwest corner thereof; thence
East along the North line of said Lot 104 and the Easterly
prolongation thereof to the center line of said Magnolia
Drive; thence South along the center line of said Magnolia
Drive to its intersection with the center line of Forty-second
Street, 60.00 feet wide; thence West along the center line
of Forty-second Street a distance of 210.00 feet, more or
less to a point on the Present Corporate limits of the City
of San Bernardino; thence North along said City Limit Line
to the North line of said Forty-second Street; thence East
along the North line of said Forty-second Street to its
intersection with the West line of said Magnolia Drive;
thence North along the West line of said Magnolia Drive
to the point of beginning.
Containing 2.26 acres, more or less.

SECTION THREE: That the above described property will be subject
to taxation equally with the property within such municipal corporation to
pay its proportion of the following bonded indebtedness of the City of
San Bernardino, which said bonded indebtedness was outstanding or theretofore
authorized and is outstanding at the time of said annexation, to wit:
A bonded indebtedness of $490,000.00 incurred for the acquisition
and construction of a public library, including additions to and enlargements
of the public library system of said City, the outstanding indebtedness
thereon being $310,000.00, . bearing interest at the rates of 4 3/~%, 3 1/4%
and 3 1/2% per annum;
A bonded indebtedness of $1,116,000.00 incurred for the acquisition
and construction of additions to, relocations of and replacements of the
fire fighting system of said City, the outstanding indebtedness thereon
being $910,000.00, bearing interest at the rates of 4%, 3%, 2 1/2%, 2 3/4%
and 2.9% per annum.
SECTION FOUR: The property herein annexed is declared to be a
30 part of Ward 5 and the boundaries of Ward 5 are hereby altered to include
31 said annexed territory, and said property is ple.ced.cand declared to be in
32 R-3-3600 Multiple Family Residential Zone.

SECTION FIVE: The City Clerk shall certify to the passage of this
2 Ordinance and shall cause the same to be published three consecutive times,
3 exclusive of holidays, in" the San Bernardino Evening Telegram, a daily
4 newspaper designated for that purpose.
