HomeMy WebLinkAbout2909 1 ORDINANCE NO.~ AN ORDINANCE OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION TO THE CITY OF SAN BERNARDINO OF CERTAIN INHABITED TERRITORY DESIGNATED AS "ANNEXATION DISTRICT NO. 199" (LAFC No. 564), UPON THE TERMS CONTAINED IN THE QUESTION SUBMITTED AT A SPECIAL ELECTION HELD IN SAID TERRITORY ON THE SEVENTH DAY OF MAY, 1968. 2 3 4 5 WHEREAS, pursuant to the provisions of an Act of the Legislature of 6 the State of California known as the "Annexation Act of 1913", and pursuant 7 to Ordinance No. 2890, adopted by the Mayor and Common Council of the City 8 of San Bernardino on the 18th day of March, 1968, a special election was held 9 on the 7th day of May, 1968, in that certain inhabited territory contiguous 10 to the City of San Bernardino designated as "Annexation District No. 199" and 11 which is hereinafter more particularly described; and 12 WHEREAS, at said special election the following question was 13 submitted to the qualified electors residing in said territory: 14 SHALL ANNEXATION DISTRICT NO. 199 BE ANNEXED TO, INCORPORATED IN AND 15 MADE A PART OF THE CITY OF SAN BERNARDINO AND THE PROPERTY IN SUCH TERRITORY BE, 16 AFTER SUCH ANNEXATION, SUBJECT TO TAXATION EQUALLY WITH THE PROPERTY WITHIN THE 17 CITY OF SAN BERNARDINO, TO PAY ITS PRO-RATA PORTION, BASED UPON ASSESSED VALUA- 18 TION OF ALL BONDED INDEBTEDNESS OF THE CITY OF SAN BERNARDINO OUTSTANDING AT T 19 DATE OF THE FIRST PUBLICATION OF THE NOTICE OF ELECTION FOR ANNEXATION? 20 WHEREAS, it appears from the canvass of the returns of the votes 21 cast at said special election that a majority of all votes cast in said 22 territory on the question of said annexation and the assumption of said 23 indebtedness favor annexation upon the terms contained in the question 24 submitted; and 25 WHEREAS, it appears that said special election and all proceedings 26 relating thereto have been conducted strictly in accordance with law. 27 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF 28 SAN BERNARDINO DO ORDAIN AS FOLLOWS: 29 SECTION ONE: That the annexation of that certain inhabited 30 territory contiguous to the City of San Bernardino designated as "Annexation 31 District No. 199", be and the same is hereby approved upon the terms contained 32 in the aforesaid question which was submitted at the special election held . 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 1 on the 7th day of May, 1968. Said territory is described as follows: 2 Those portions of Lots 24 and 25, Block 54, Rancho San Bernardino as per plat thereof recorded in Book 7 of Maps, Page 2, records of the County Recorder of San Bernardino County, State of California, described as follows: 3 4 5 Beginning at a point on the Present Corporate Limits of the City of San Bernardino and the center line of Dumas Street, said point being at the most Westerly terminus of Dumas Street as said Street is delineated on the map of Tract No. 1995, as per plat thereof recorded in Book 29 of Maps, page 13, Records of the County Recorder of said County; thence Easterly along the center line of Dumas Street to the center line of Waterman Avenue 82.50 feet wide as said street is delineated on the map of said Rancho; thence Southerly along the center line of Waterman Avenue, a distance of 505.00 feet more or less to the Easterly prolon- gation of the North line of the property conveyed to Whittaker Electric Company, a California Corporation, Rose Miller, a widow, by Deed recorded September 28, 1962 in Book 5775, page 815, Official Records of said County as Instrument Number 371, said point being 30 rods South of the North line of said Lot 25; thence Westerly along said Easterly prolongation and the North line of said Whittaker Electric Company property a distance of 1361.25 feet, more or less, to the West line of said Lot 25; thence Southerly along the West line of said Lot 25 a distance of 99.00 feet, more or less to the Southeast corner of the property comreyeji t:o'S8o\DUe1cJaflleA Bankhead And Helen' J3ai:lkheadc,by~deed recorde June 11, 1954 in Book 3400, page 293, Official records of said County as instrument Number 142; thence Westerly along the South line of said Bankhead property and the South line of the property conveyed to Harvey H. Head and Naomi B. Head by Deed recorded April 19, 1967 in Book 6806, page 35, Official Records of said County as Instrument Number 187 and the Westerly prolongation thereof to the East line of the West one-third of said Lot 24; thence Northerly along the East line of the West one-third of said Lot 24 and the said City Limit Line to the North line of said Lot 24; thence Easterly along the North line of said Lot 24 and the City Limit Line a distance of 250.00 feet more or less to a point due South of the point of beginning; thence North along said City Limit Line to the point of beginning. Containing 28.15 acres, more or less. 6 7 8 9 SECTION TWO: The property herein annexed is declared to be a part 25 of Ward 3 and the boundaries of Ward 3 are hereby altered to include said 26 annexed territory, with the zoning classifications to be as shown on a map 27 filed in the office of the City Clerk marked Exhibit A, and described as 28 follows: 29 To be admitted in C-M Conmercial-Manufacturing Zone: 30 31 32 The east 198 feet of the north 495 feet of Lot 25; Block 54, Rancho San Bernardino, excepting that portion dedicated for street and highway purposes. . . - 2 - . 1 To be admitted in M-l Light Industrial Zone: 2 The west 1112.71 feet of the north 495 feet of Lot 25, Block 54, Rancho San Bernardino, and the east 637.74 feet of the north 594 feet of Lot 24, Block 54, Rancho San Bernardino, excepting that portion dedicated for street and highway purposes. 3 4 5 To be admitted in "0" ()pen Zone: 6 The west 260 feet of the east 897.74 feet of the north 594 feet of Lot 24, Block 54, Rancho San Bernardino. 7 8 SECTION THREE: The City Clerk shall certify to the adoptiong of 9 this Ordinance and cause the same to be publshed three consecutive times, 10 exclusive of holidays, in the San Bernardino Evening Telegram, a newspaper 11 of general circulation in the City of San Bernardino. 12 I HEREBY CERTIFY that the foregoing Ordinance was duly adopted 14 13 by the Mayor and Common Council of the City of San Bernardino at a regular meeting thereof, held on the ::J.r?,x.l1:7 day of , 1968, 15 by the following vote, to wit: 16 AYES: councilmen.,J.I..I''''.IrVv> J~ 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 NOES: ABSENT: :J1aJ e: ~~ City Clerk I hereby approve the foregoing Ordinance this ~ I ~ day , of YnY' , 1968.
