2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 202 (LAFC No. 534).

WHEREAS, heretofore, a petition was filed with the Common Council
5
of the City of San Bernardino requesting that certain uninhabited territory
6
contiguous to said City be annexed to the City of San Bernardino, and which
7
said petition described said territory and the boundaries thereof proposed
8
to be annexed to the City; and
9
WHEREAS, said petition was filed by the owners of not less than
10
one-fourth of the area of land in such territory, and representing not less
11
than one-fourth of the assessed value of such territory according to the last
12
preceding equalized assessment roll of the County of San Bernardino, in which
13
said County the City of San Bernardino is situated; and
14
WHEREAS, said petition requested the said territory to be annexed
15
to and included in the said municipal corporation in accordance with the
16
provisions of the Government Code, Section 35300, et seq.; and
17
WHEREAS, on the 15th day of April, 1968, a Resolution was adopted
18
by the aforesaid Common Council of the City of San Bernardino, California,
19
proposing the annexation of the aforesaid uninhabited territory and that said
20
Resolution provided therein that the proposed annexation should be generally
21
known and identified as Annexation District No. 202; and
22
WHEREAS, said Resolution set forth therein that all the property
23
included in the aforesaid territory should be taxed equally with the other
24
property within the said City to pay the bonded indebtedness and any and all
25
general indebtedness and liability of the City of San Bernardino contracted
26
prior to or existing or outstanding at the time of the aforesaid proposed
27
annexation of the aforesaid property as provided in the hereinbefore
28
mentioned Government Code; and

WHEREAS, said Resolution did fix, determine and declare that a
30
hearing be held on the 27th day of May, 1968, at the hour of 7:00 o'clock
31
P. M. in the Council Chambers of the City Hall in the City of San Bernardino,
32
and the same was the day, hour and place designated where any person owning

real estate within such territory so proposed to be annexed and having any
2
objections to the proposed annexation might object before the Common Council
3
and show cause why such territory should not be annexed; and, furthermore,
4
the said Resolution provided that at any time not later than the said hour
5
set, as mentioned hereinbefore for the said hearing, any owner of property
6
within the said territory proposed to be annexed might file written protest
7
with the City of San Bernardino against such annexation; and
8
WHEREAS, no written protests of any kind or nature whatsoever were
9
filed with the City Clerk of the City of San Bernardino prior to 7:00 o'clock
10
P. M. on the :a7th day of May, 1968, and thereafter on the 3td_..day:of,.Ji1il~,

1968, Resolution No. 9207 was adopted by the Mayor and Common Council
12
declaring that a majority protest has not been presented; and
13
WHEREAS, it appears to the Common Council of the City of
14
San Bernardino that the aforesaid annexation proceedings have been completed
15
and everything performed at this time in accordance with said Government Code,
16
as mentioned hereinbefore, and any and all other laws in any way connected
17
with the said annexation procedure having been complied with; and
18
WHEREAS, the Common Council of the City of San Bernardino desire
19
to approve at this time the annexation of the aforesaid territory.

NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF
21
SAN BERNARDINO DO ORDAIN AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation
23 District No. 202 is hereby annexed and incorporated in and made a part of
24 the City of San Bernardino.

SECTION TWO: The territory herein referred to as being annexed to
26
the City of San Bernardino is particularly described as follows, to wit:

That portion of the Southeast one-quarter of the Southwest
one-quarter of the Southeast one-quarter of Section 6,
Township 1 South, Range 4 West, San Bernardino Meridian,
described as follows:

Beginning at a point on the present corporate limits of the
City of San Bernardino, said point being the intersection
of the center line of Terrace Road and the North line of the
Southeast one-quarter of the Southwest one-quarter of the
Southeast one-quarter of said section; thence Easterly along
the North line of said Southeast one-quarter of the Southwest

one-quarter of the Southeast one-quarter a distance of 680.00
feet, more or less, to the center line of Parley Avenue 60.00
feet wide; thence South along the center line of Parley
Avenue a distance of 140.00 feet, more or less, to the center
line of Fifth Street; thence East along the center line of
Fifth Street a distance of 10.00 feet, to the center line of
Parley Avenue, 40.00 feet wide; thence South along the center
line of Parley Avenue a distance of 355.00 feet, more or less,
to the present City Limit line; thence West along the present
City Limit line a distance of 620.00 feet, more or less, to
the center line of Terrace Road, thence North along the center
line of Terrace Road and City Limit line, a distance of 500.00
feet, more or less, to the point of beginning.

Containing 7.40 acres, more or less.

SECTION THREE: That the above descriped property will be subject
10 to taxation equally with the property within such municipal corporation to
11 pay its proportion of the following bonded indebtedness of the City of
12 San Bernardino, which said bonded indebtedness was outstanding or theretofore
13 authorized and is outstanding at the time of said annexation, to wit:
14 A bonded indebtedness of $490,000.00 incurred for the acquisition
15 and construction of a public library, including additions to and enlargements
16 of the public library system of said City, the outstanding indebtedness
17 thereon being $310,000.00, bearing interest at the rates of 4 3/~%, 3 1/4%
18 and 3 1/2% per annum;
19 A bonded indebtedness of $1,116,000.00 incurred for the acquisition
20 and construction of additions to, r.elOea:t::Lou of and replacements of the
21 fire fighting system of said City, the outstanding indebtedness the~eon being
22 $910,000.00, bearing interest at the rates of 4%, 3%, 2 1/2%, 2 3/4% and
23 2.9% per annum.

SECTION FOUR: The property herein annexed is declared to be a part
25 of Ward 3 and the boundaries of Ward 3 are hereby altered to include said
26 annexed territory, and said property is placed and declared to be in R-1-7200
27 Single Family Residential Zone.

SECTION FIVE: The City Clerk shall certify to the passage of this
29 Ordinance and shall cause the same to be published three consecutive times,
30 exclusive of holidays, in the San Bernardino Evening Telegram, a daily
31 newspaper designated for that purpose.
