HomeMy WebLinkAbout2914 ORDINANCE NO. .29/ ~ AN ORDINANCE OF THE CITY OF ~INO AMENDING ORDINANCE NO. 821; AND MODIFYING THE LICENSE, DISPOSAL, IMPOUND, QUARANTINE, 3 TAG, RECLAIMING, RECEIVING AND SELLING FEES FOR CATS AND DOGS. ~ 2 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 SECTION ONE: Ordinance No. 821 section 519 is hereby amended to read as follows: "SECTION 519: Each person, firm or corporation owning or harboring a dog, either kept upon private property or otherwise, within the City of San Bernardino, shall on or before the first day of July of each year, pay to said City in advance for the fiscal year, a license fee of Three and 75/100 Dollars ($3.75) for each dog, and in addition, the sum of Twenty-Five Cents (259) for a tag for each dog, and in the event any of said fees and sums are not paid prior to the first day of August of each year, then a penalty of One Dollar ($1.00) shall be added to each such license fee. A fee of Fifty Cents (Sot) shall be charged for any additional tag issued to replace a lost, stolen, misplaced or damaged tag. Monies received during the current fiscal year for a license shall be first applied to the payment of delinquent fees, sums and penalties due during the preceding fiscal year, and any balance remaining thereafter shall be applied to the payment of the cur- rent license fees, sums and penalties. A license issued during any prior fiscal year to the same owner for the same dog, as shown in an application for a current license, shall be prima I I facie evidence in any court or administrative proceeding that the dog was continuously owned by the same owner from said prior year to the current fiscal year." SECTION TWO: Ordinance No. 821 section 523 is hereby amended 30 31 32 to read as follows: "SECTION 523:.The Animal Control Officer shall have the right to seize any dog or animal within the City of San B~rnardino . . ~ having or suspected to have rabies or hydrophobia and in the event 2 he shall determine that such dog or animal is afflicted with rabies 3 or hydrophobia, the dog or animal shall be forthwith killed by 4 said Officer; provided that if such dog or animal shall be suspected 5 of having rabies or hydrophobia, it may be confined by said Officer 6 for such time as is necessary, and if said Officer shall then de- 7 termine that said dog or animal does not have rabies or hydro- 8 phobia, it shall be returned to the owner upon payment by the 9 owner of the sum of One Dollar and Fifty Cents ($1.50) per day 10 for each day that the dog or animal shall be confined." 11 SECTION THREE: Ordinance No. 821 Section 530 is hereby 12, amended to read as follows: 13 "SECTION 530: Any dog found running at large or running 14 loose and unrestrained in the City of San Bernardino shall be im- 15 pounded by the Animal Control Officer for a period of seventy-two 16 (72) hours. The first time the dog is impounded the reclaiming 17 fee shall be Three Dollars ($3.00) plus One Dollar and Fifty Cents 18 ($1.50) per day pound fee; the second time the same dog is im- 19 pounded the reclaiming fee shall be Five Dollars ($5.00) plus One 20 Dollar and Fifty Cents ($1.50) per day pound fee; the third or any 21 subsequent time the same dog is impounded the reclaiming fee shall 22 be Ten Dollars ($10.00) plus One Dollar and Fifty Cents ($1.50) 23 per day pound fee. In the event the owner of or the person 24 possessing said dog shall not on or before the expiration of said 25 period of seventy-two (72) hours call for and claim said dog, 26 paying any sum then due or owing, said dog shall be disposed of by 27 said Officer." 28 SECTION FOUR: Ordinance No. 821 Section 531 is hereby 29 amended to read as follows: 30 "SECTION 5 31: The Animal Control Officer shall have the 31 right to receive and dispose of dogs delivered into his possession 32 ~ the owners thereof and shall charge therefor the sum of Four -2- . ~ 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 Dollars ($4.00) for each such dog and the sum of One Dollar ($1.00) for each puppy under the age of three (3) months. Said Officer may sell any dog or puppy so placed in his possession for a sum not to exceed Four Dollars ($4.00)." SECTION FIVE: Ordinance No. 821 Section 532 is hereby amended to read as follows: "SECTION 532: The Animal Control Officer shall have the right to receive and dispose of any cat or kitten delivered into his possession by the owner thereof and shall charge therefor the sum of Fifty Cents (50~) for each such cat or kitten. Said Officer may sell each cat or kitten so placed in his possession for a sum not to exceed Two Dollars ($2.00)." SECTION SIX: This ordinance, inasmuch as it provides for a tax levy and/or revenue for the usual and current expenses of the City, shall take effect immediately. Furthermore, the facts constituting an emergency are that licenses are due on July 1, 1968 and any later effective date than June 17 would cause numerous and burdensome administrative problems and great inconvenience to the public and that said revenue is urgently needed to defray maintenance and operational costs of the City Animal Shelter.
