AN ORDINANCE OF THE CITY OF SAN BERNARDINO PROVIDING FOR
THE PROTECTION OF THE PUBLIC HEALTH AND SAFETY, AND THE
LICENSING OF PERSONS ENGAGED IN THE INSTALLATION OF PLUMBING,
GAS AND DRAINAGE SYSTEMS; CREATING A BOARD OF APPEALS,
PRESCRIBING ITS DUTIES AND THE DUTIES OF THE PLUMBING INSPECTOR;
ESTABLISHING MINIMUM REGULATIONS FOR THE INSTALLATION, ALTERATION
OR REPAIR OF PLUMBING, GAS AND DRAINAGE SYSTEMS AND INSPEC'lDNS
THEREOF; PROVIDING PENALTIES FOR VIOLATIONS; ADOPTING AND
ESTABLISHING RULES AND REGULATIONS FOR THE INSTALLATION,
ALTERATION AND REPAIR OF PLUMBING, GAS AND DRAINAGE SYSTEMS AND
RELATED MATTERS; ADOPTING THE UNIFORM PLUMBING CODE, 1967 EDITION,
INCLUDING ITS APPENDICES A THROUGH G, INCLUSIVE, AND TABLES;
AND REPEALING ORDINANCE NO. 2705.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION ONE: This Ordinance shall be known as the "UNIFORM
PLUMBING ORDINANCE."
SECTION TWO: Those certain rules and regulations which
provide for and govern the installation, alteration and repair
of plumbing, gas and drainage systems and the inspections
thereof, the licensing of persons engaged in the installation
of plumbing, gas and drainage systems in the City of San
Bernardino, the creation of a Board of Appeals and prescribing
its duties and the duties of the plumbing inspector; and
penalties for violations thereof, as set forth in that certain
code printed in book form, and entitled "Uniform Plumbing Code,
1967 Edition", as prepared and promulgated by the International
Association of Plumbing and Mechanical Officials, three (3)
copies of which code have heretofore been filed with and are
now on file in the Office of the City Clerk of the City of San
Bernardino, and which copies are identified by certificates
attached thereto, reading substantially as follows:
"I, JACK T. FELTON, hereby certify that the annexed code
entitled "Uniform Plumbing Code, 1967 Edition", was filed in
the office of the City Clerk of the City of San Bernardino on
the 11th day of December, 1967, and is a true, correct and complet
copy of said Code which is sought to be adopted by reference

2 be and the same are hereby established as rules and regulations
3 and a code of said City; and each and every part of said code,
4 and each and every provision therein contained, including its
51 Appendices A th~ugh G, inclusive, and Tables, is hereby
6 referred to and designated as the "Uniform Plumbing Code, 1967
7 Edi tion", and is hereby adopted and made a part hereof as though
8 fully set forth at length in this ordinance.

SECTION THREE: The following sections and provisions of
10 the Uniform Plumbing Code, 1967 Edition, are hereby amended to
11 read as follows:

Section 1.1. ADMINISTRATIVE AUTHORITY AND ASSISTANTS.
13 Whenever the term "administrative authority" is used in this
14 code it shall be construed to mean the Chief Plumbing Inspector
16
15 or his authorized representative.
Section l.~. ASSISTANTS.
Whenever the term "assistants"
17 is used in this code it shall be construed to mean the Plumbing
18 Inspectors. All assistants shall have had at least two (2) years
19 as a Journeyman Plumber.

Section 1.3. DEPARTMENT HAVING JURISDICTION.
Unless
21 otherwise provided for by law, the Office of the Administrative
23
22 Authority shall be part of the Department of Building and Safety.
Section 1.7. VIOLATIONS AND PENALTIES.
Any person, firm
24 or corporation violating or causing or permitting the violation
25 of any of the provisions of this code or ordinance shall be
26 deemed guilty of a misdemeanor and upon conviction thereof s4&!1
27 be punishable by a fine of not to exceed Five Hundred Dollars
28 ($500.00) or by imprisonment in the County Jail for not to exceed
29
six (6) months, or by both such fine and imprisonment.
Each
30 separate day or any portion thereof during which any violation
31 of this code or ql1:,dinance occurs or continues shall be deemed to
32 qonstitute a separate offense, and upon conviction thereof shall

~ be punishable as herein provided.
2 The issuance or granting of a permit or approval of plans
3 and specifications shall not be deemed or construed to be a
4 permit for, or an approval of, any violation of any of the
5 provisions of this code.
No permit presuming to give authority
6 to violate or cancel the provisions of this code shall be valid,
7 except insofar as the work or use which it authorizes is lawful.

The issuance or granting of a permit or approval of pl~ns
9 shall not prevent the Administrative Authority from thereafter
10 requiring the correction of errors in ~ plans and specifications
111 or from preventing
12, thereunder when in
13 ordinance or from
14 in error.
15 Every permit issued by the Administrative Authority under
construction operations being carried on
violation of this code or of any other
revoking any Certificate or Approval when issued
16 the provisions of this code shall expire by limitation and
17 become null and void, if the work authorized by such permit is
18 not commenced within sixty (60) days from the date of issuance
19 of such permit, or if the work authorized by such permit is
20 suspended or abandoned at any time after the work is commenced
21 for a period of sixty (60) days. Before such work can be
22 recommenced a new permit shall be first obtained so to do.
23 When work for which a plumbing permit is required by this
24 ordinance is started or proceeded with prior to obtaining said
25 permit, the fees specified in the Uniform Plumbing Code $~~Il"
26 be doubled, but the payment of such double fee shall not relieve
27 any person from "fully CIIIIIplying with the requirements of this
28 code in the execution of the work nor from any other penalties
29 prescribed herein.

Section 1.12. COST OF PERMIT.
Every applicant for
31 a permit to install, add to, alter, relocate or replace a plumbing
32 or. drainage system or part thereof, shall state in writing on

the application form provided for that purpose, the character
of work proposed to be done and the amount and kind in
connection therewith, together with such information pertinent
thereto as may be required.
Such applicant shall pay for each permit issued at the
time of issuance, a fee in accordance with the following schedule,
and at the rate provided for each classification shown theretn.
Any person who shall commence any plumbing work for which
a permit is required by this code without first having obtained
a permit therefor shall, if subsequently permitted to obtain a
permit, pay double the permit fee fixed by this section for such
work, provided, however, that this provision shall not apply
to emergency work when it shall be proved to the satisfaction
of the Administrative Authority that such work was urgently
necessary and that it was not practical to obtain a permit therefor
before the commencement of the work. In all such cases a permit
must be obtained as soon as it is practical to do so, and if
there be an unreasonable delay in obtaining such permit, a
double fee as herein provided shall be charged.
For the purpose of this section a sanitary plumbing outlet
on or to which a plumbing fixture or appliance may be set or
attached shall be construed to be a fixture.
Fees for
reconnection and retest of existing plumbing systems in relocated
buildings shall be based on the number of plumbing fixtures,
gas systems, water heaters, etc., involved.
When interceptor traps or house trailer site traps are
installed at the same time as a building sewer on any lot, no
sewer permit shall be required for the connection of any such
trap to an appropriate inlet fitting provided in the buildng
sewer by the permittee constructing such sewer.
When a permit has been obtained to connect an existing
building or existing work to the public sewer or to connect to

a new private disposal facility, backfilling of private sewage
disposal facilities abandoned consequent to such connection is
included in the building sewer permit.

Section 702(c). Each waste outlet for a plumbing fitting
that requires roughing in above floor shall be immediately in
the rear of the fixture trap and no concealed change of direction
or offset shall be installed between any such fixture trap and
its vent.
Any exposed fitting installed between a trap and its
vent shall be so located as to be readily removable for cleaning
purposes.
Section 704: TRAPS PROHIBITED.
No form of trap which
depends for its seal upon the action of movable parts or concealed
32 iftterior partitions shall be used.
Full "s" traps are prohibited.

Bell traps are prohibited. Crown-vented traps are prohibited.
No fixture shall be double trapped. Drum traps without vents
may be installed only when permitted by the Administrative
Authority for special conditions.
Section 907(e). SETTING. Fixtures shall be set level
and in proper alignment with reference to adjacent walls. No
water closet shall be set closer than fifteen inches (15")
from its center to any vertical surface. No urinal shall be
set closer than twelve (12") inches from its center to any side
wall or partition or closer than twenty-four inches (24")
center to center.
SECTION FOUR: Said Uniform Plumbing Code is hereby amended
by deleting therefrom the following sections, sub-sections and
provisions:
Section 2.1 (c) Section 310 (e)
Section 2.4 Section 802 (f) and (g)
Section 2.6 Section 1008 (c)-I
Section 2.9 Section 1310 (a)
Section 2.10
SECTION FIVE: Said Uniform Plumbing Code is hereby amended
by adding thereto the sections and sub sections hereinafter set
forth to read as follows:
Section 1.15. LIABILITY OF CITY OFFICIAL OR EMPLOYEE.
This Ordinance and said Uniform Plumbing Code shall not be
construed to impose upon the City of San Bernardino or its
employees or agents any liability or responsibility for damages
caused by defective plumbing or drainage systems or the installatio
thereof, and the City of San Bernardino and its officials,
agents or employees shall not be held as assuming any such
liability or responsibility by reason of any inspection required
or authorized thereunder.

Section 1.16. SUBSTANCES OR EQUIPMENT POLLUTING WATER.
No person shall advertise, sell or offer for use or sale, any
water-treating chemical or substance, water-using or water-
treating chemical or substance, water-using or water-operated
equipment, mechanism or contrivance, if the Health Officer finds
that the use of such chemical or substance, equipment, mechanism
or contrivance may cause contamination or pollution of the
domestic water system. Such devices may be permitted when
equipped with back-flow protection meeting the requirements of
the Uniform Plumbing Code.
Section 1.17. Where work for which a permit is requi~ed
by this code is completed prior to the issuance of said permit,
an additional fee of ten (10) percent of the cost of the project,
or the sum of $200.00, whichever is less, shall be paid, and it
shall be the duty of the Chief plumbing Inspector to levy and
collect said additional fees. The payment of such fee shall not
relieve any persons or firms from fully complying with other
provisions of this code or from the payment of any other
penalties or fees prescribed herein.
Section 207 (d). An approved two-way clean-out fitting
shall be installed at the lower end of every building drain and
shall be located two (2) feet outside the dwelling or building
which it serves. Such clean-out shall be extended to the finish
grade and made readily accessible.
Section 403 (c). The minimum size of the building drain
installed in any commercial construction shall be 4".
Section 410. HOUSE DRAINS SHALL CONNECT TO ONE OUTLET.
In a single family dwelling all plumbing drains shall connect to
one outlet. Such outlet shall not exceed ninety (900) degrees
from the direction of flow of the closest public sewer or if
there is no public sewer then from the proposed public sewer.

the plumbing shall connect all such stub-outs to each other so
that there shall be one outlet.
The materials used shall be as
required elsewhere in this code.
section 1009 (n).
All horizontal water piping, including
lawn sprinkler systems, installed underground shall have not
less than six inches (6") of earth cover.
Section 1103 (c). The following are the only materials
approved for the installation of sewers for buildings and
structures in the City of San Bernardino:
Wedge Lock
Speed Seal
Band Seal
Transite
Cast Iron
Acrylonitrile-Butadine-
Styrene (A.B.S.) as
approved by International
Association of Plumbing &
Mechanical Officials.
Pacific Clay Products
Gladding McBean Co.
Mission Clay Products
Johns-Manville
Section 1219 (e).
Every system of gas piping which has
not been supplied with gas under pressure for a period exceeding
one year, shall be retested in accordance with the procedure
set forth in Section 1206 (c-2) of the Uniform Plumbing Code.
The permit fee for such retesting shall be the same as that e.r
new installation thereof.
SECTION SIX:
The word "City" in the aforesaid sections
23 and code shall be deemed to refer to and designate the City of
24 San Bernardino, and any reference to any act or legislative
25 enactment therein referred to shall be deemed to designate
26 and embrace the statutes of the State of California, and

amendments thereof, dealing with the subject matter thereby
and therein referred to.
SECTION SEVEN:
REVOCATION.
The Mayor and Common Council
of the City of San Bernardino shall have the power, upon
31 recommendation of the Plumbing Inspector, to suspend or revoke

the business license of any person, firm or corporation violating

1 the terms and provisions of said Plumbing Code, provided that such
2 suspension or revocation shall not be ordered by said Mayor and
3 Common Council without first holding a public hearing thereon
4 and without giving reasonable notice of such hearing to the
5 person, firm or corporation so charged with said violation.

SECTION EIGHT: If any section, Sub-section, sentence, clause I
7 or phrase of this Ordinance or said code is for any reason held to
8 be invalid or unconstitutional by the decision of any court of
9 competent jurisdiction, such decision shall not affect the
10 validity of the remaining portions of said Ordinance or code. The

Mayor and Common Council of the City of San Bernardino hereby
declare that they would have passed said Ordinance and code, and
each section, sub-section, sentence, clause and phrase thereof,
irrespective of the fact that anyone or more other sections,
SUb-sections, clauses or phrases be declared invalid or
unconstitutional.
SECTION NINE: Ordinance No. 2705 is hereby repealed.
