2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 209 (LAFC No. 619).

4 WHEREAS, heretofore, a petition was filed with the Common Council
5 of the City of San Bernardino requesting that certain uninhabited territory
6 contiguous to said City be annexed to the City of San Bernardino, and which
7 said petition described said territory and the boundaries thereof proposed
8 to be annexed to the City; and
9 WHEREAS, said petition was filed by the owners of not less than
10 one-fourth of the area of land in such territory, and representing not less
11 than one-fourth of the assessed value of such territory according to the
12 last preceding equalized assessment roll of the County of San Bernardino,
13 in which said County the City of San Bernardino is situated; and
14 WHEREAS, said petition requested the said territory to be annexed
15 to and included in the said municipal corporation in accordance with the
16 provisions of the Government Code, Section 35300, et seq.; and
17 WHEREAS, on the 26th day of August, 1968, a Resolution wa~ adopted
18 by the aforesaid Common Council of the City of San Bernardino, California,
19 proposing the annexation of the aforesaid uninhabited territory and that said
20 Resolution provided therein that the proposed annexation should be generally
21 known and identified as Annexation District No. 209; and
22 WHEREAS, said Resolution set forth therein that all the property
23 included in the aforesaid territory should be taxed equally with the other
24 property within the said City to pay the bonded indebtedness and any and all
25 general indebtedness and liability of the City of San Bernardino contracted
26 prior to or existing or outstanding at the time of the aforesaid proposed
27 annexation of the aforesaid property as provided in the hereinbefore
28 mentioned Government Code; and
29 WHEREAS, said Resolution did fix, determine and declare that a
30 hearing be held on the 7th day of October, 1968, at the hour of 9:30 o'clock
31 A. M. in the Council Chambers of the City Hall in the City of San Bernardino,
32 and the same was the day, hour and place designated where any person owning

1 real estate within such territory so proposed to be annexed and having any
2 objections to the proposed annexation might object before the Common Council
3 and show cause why such territory should not be annexed, and, furthermore,
4 the said Resolution provided that at any time not later than the said hour
5 set, as mentioned hereinbefore for the said hearing, any owner of property
6 within the said territory proposed to be annexed might file written protest
7 with the City of San Bernardino against such annexation; and
8 WHEREAS, no written protests of any kind or nature whatsoever were
9 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock
10 A. M. on the 7th day of October; 1968, and thereafter on the 7th day of
11 October, 1968, Resolution No. 9440 was adopted by the Mayor and Common Council
12 declaring that a majority protest has not been presented; and
13 WHEREAS, it appears to the Common Council of the City of San
14 Bernardino that the aforementioned annexation proceedings have been completed
15 and everything performed at this time in accordance with said Government Code,
16 as mentioned hereinbefore, and any and all other laws in any way connected
17 with the said annexation procedure having been complied with; and
18 WHEREAS, the Common Council of the City of San Bernardino desire
19 to approve at this time the annexation of the aforesaid territory.
20 NOW, THEREFORE. THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
21 DO ORDAIN AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation
23 District No. 209 is hereby annexed and incorporated in and made a part of
25
24 the City of San Bernardino.
SECTION TWO: The territory herein referred to as being annexed to
26 the City of San Bernardino is particularly described as follows, to wit:
27 That portion of Lots 7, 8, 9, 10, II, 12 and 13, Tract No.
3879, as per plat thereof recorded in Book 50 of Maps,
28 page 50, records of the County Recorder of San Bernardino
County, State of California, described as follows:

Beginning at a point in the Present Corporate Limits of
the City of San Bernardino. said point being the intersection
of the centerline of Twenty-first Street, 50.00 feet wide,
with the centerline of ElmwoOd Road, 66.00 feet wide; thence
Northerly along said centerline of Elmwood Drive and along
said City Limit line to its intersection with the Westerly

prolongation of the North line of that certain alley, 20.00
feet wide, as said alley is delineated on the Map of said
Tract No. 3879; thence East along said Westerly prolongation
and the North line of said alley, being along said City Limit
line and along the South line of Lots, 1, 2, 3, 4, 5, and 6
of said Tract No. 3879, to its intersection with the West
line of Lot 7 of said Tract No. 3879; thence North along
said City Limit line and the West line of said Lot 7 and
its Northerly prolongation to the centerline of Highland
Avenue; thence East along said centerline of Highland Avenue
and said City Limit line, a distance of 82.96 feet, more or
less, to its intersection with the Northerly prolongation of
the East line of that certain 20.00 foot alley adjoining
said Lot 7 on the East; thence South along said City Limit
line, said Northerly prolongation, the East line of said
alley, the East line of said Lot 8 and their Southerly
prolongation, a distance of 402.72 feet, more or less, to
the centerline of said Twenty-first Street; thence West
along said centerline of Twenty-first Street to the point
of beginning.
Containing 1.92 acres, more or less.

SECTION THREE: That the above described property will be subject
13 to taxation equally with the property within such municipal corporation to
14 pay its proportion of the following bonded indebtedness of the City of San
15 Bernardino, which said bonded indebtedness was outstanding or theretofore
16 authorized and is outstanding at the time of said annexation, to wit:
17 A bonded indebtedness of $490,000.00 incurred for the acquisition
18 and construction of a public library, including additi6aa to and enlargements
19 of the public library system of said City, the outstanding indebtedness
20 thereon being $310,000.00, bearing interest at the rates of 4 3/4%, 3 1/4%
21 and 3.1/2% per annum;
22 A bonded indebtedness of $1,116,000.00 incurred for the acquisition
23 and construction of additions to, relocations of and replacements of the fire
24 fighting system of said City, the outstanding indebtedness thereon being
25 $865,000.00, bearing interest at the rates of 4%, 3%, 2 1/2%, 2 3/4% and
26 2.9% per annum.

SECTION FOUR: The property herein annexed is declared to be a
29 said annexedo_=erritory, with the following zoning classifications:
30 Lot 7, Tract 3879 to be zoned C-3A Limited General Commercial
District, and Lots 8 through 13, inclusive, to be zoned
31 "T" Transitional District.

SECTION FIVE: The City Clerk shall certify to the adoption of

this Ordinance and shall cause the same to be published three consecutive
times, exclusive of holidays, in the San Bernardino Evening Telegram, a daily
newspaper designated for that purpose.
I HEREBY CERTIFY that the foregoing Ordinance was duly adopted by
