AN ORDINANCE OF THE CITY OF SAN BERNARDINO CALLING A SPECIAL ELECTION
TO BE HELD ON THE SEVENTEENTH DAY OF DECEMBER, 1968, PERTAINING TO THE ANNEXA-
TION OF A DISTRICT CALLED ANNEXATION DISTRICT NO. 211 (LAFC No. 597).

WHEREAS, by Resolution, the Mayor and Common Council of the City of
San Bernardino declared its intention to call a special election to be held

in certain inhabited territory contiguous to said City, proposed to be annexed

to said City, for the purpose of submitting to the qualified electarsresiding
in said territory the question whether or not said territory shall be annexed
to said City; and
WHEREAS, a copy of said Resolution was published as required by
law; and
WHEREAS, at a time not later than the hour set by said Resolution
for hearing objections to the proposed election, no written protests were made
by the owners of one-half of the value of the territory proposed to be annexed,
as shown by the last equalized assessment roll of the property within the
territory proposed to be annexed; and
WHEREAS, thereafter on the 21st day of October, 1968, Resolution
No. 9460 was adopted by the Mayor and Common Council declaring that a majority
protest has not been presented; and
WHEREAS, all proceedings have been had in accordance with said
Resolution and the Annexation Act of 1913, reference thereto hereby being
made for further particulars.
NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO DO ORDAIN AS FOLLOWS:
26 the 17th day of December, 1968, in the territory hereinafter described and
SECTION ONE: A special election hereby is called, to be held on
27 proposed to be annexed to the City of San Bernardino, for the purpose of
28 submitting to the qualified electors residing in said territory the question
29 whether or not such territory shall be annexed to, incorporated in and made
30 a part of the City of San Bernardino, and whether or not the property in
31 said territory shall, after such annexation, be subject to taxation equally
32 ~th the property within the City of San Bernardino to pay the entire bonded

indebtedness of the City of San Bernardino outstanding at the date of the

first publication of the notice of election for annexation.
Said territory is described as follows:

That portion of the Northeast one~quarter of Section 32,
Township 1 North, Range 3 West, San Bernardino Meridian
and that portion of Tract No. 4864 as per plat thereof
recorded in Book 87 of Maps, page 40 and 41, and that
portion of Tract No. 1745 as per plat thereof recorded
in Book 25 of Maps, page 32, records of the County Recorder
of San Bernardino County, State of California described
as follows:

Beginning at a point on the Present Corporate Limits of the
City of San Bernardino, said point being the intersection
of the center line of Highland Avenue and the center line
of Orange Street; thence East along said City Limit Line,
the Easterly prolongation thereof and the center line of
Highland Avenue a distance of 1320.00 feet, more or less
to its intersection with the center line of Palm Avenue;
thence South along the center line of Palm Avenue a distance
of 1320.00 feet, more or less to its intersection with the
center line of Atlantic Avenue; thence West along the center
line of Atlantic Avenue a distance of 1320.00 feet, more
or less to its intersection with the center line of Orange
Street; thence North along the center line of Orange Street
a distance of 1320.00 feet, more or less to the point of
beginning.
Containing 40 acres, more or less.
SECTION TWO: TIME OF OPENING AND CLOSING OF POLLS. The polls at
18 said election shall be opened at 7:00 o'elock A. M. of the day herein fixed
19 for the holding of said election, and shall be kept open until 8:00 o'clock
20 P. M. of the same day, when the polls shall be closed.

SECTION THREE: BALLOTS. Upon the ballots to be used at said
22 election there shall be printed the words:
23 SHALL ANNEXATION DISTRICT NO. 211 BE ANNEXED TO, INCORPORATED IN
24 AND MADE A PART OF THE CITY OF SAN BERNARDINO AND THE PROPERTY IN SUCH
25 TERRITORY BE, AFTER SUCH ANNEXATION, SUBJECT TO TAXATION EQUALLY WITH THE
26 PROPERTY WITHIN THE CITY OF SAN BERNARDINO, TO PAY ITS PRO-RATA fORTION,
27 BASED UPON ASSESSED VALUATION OF ALL BONDED INDEBTEDNESS OF THE CITY OF
28 SAN BERNARDINO OUTSTANDING AT THE DATE OF THE FIRST PUBLICATION OF THE
29 NOTICE OF ELECTION FOR ANNEXATION?
30 Opposite these words there shall be printed the words "YES" and
31 "NO", and to the right of each of these last two words, there shall be a
32 ~oting square. If an elector shall stamp a cross (+) in the voting square

1 after the printed word "YES", the vote of such ..lector shall be counted in
2 favor of the annexation of said territory to the City of San Bernardino, and
3 if an elector shall stamp a cross (+) in the voting square after the printed
4 word "NO", the vote of such elector shall be counted against such annexation.
5 In all particulars not herein recited, said election shall be held
6 in conformity as near as may be with the laws of the State of California
7 concerning general elections and with said Annexation Act of 1913.

SECTION FOUR: For purpose of said election there hereby is
9 established in the territory described herein one (1) consolidated voting
10 precinct which shall include all of said territory. The following is the
11 polling place of said election precinct, and the following named persons
12 hereby are designated as officers of election and shall constitute the board
13 of election for such election precinct:
14 Consolidated Voting Precinct No. 1 shall be comprised of that
15 portion of County Precinct Highland 8 lying within the boundaries of the
16 annexation territory.

SECTION FIVE: This Ordinance shall take effect upon its publication.
SECTION SIX: The City Clerk shall certify to the passage and
27 adoption of this Ordinance by the Common Council of the City of San Bernardino
28 and shall cause the same to be published three consecutive times, exclusive
29 of holidays, in the San Bernardino Evening Telegram, a daily newspaper of
30 general circulation printed and published within the City of San Bernardino,
31 and once a week for four (4) weeks prior to the date of the election in the
32 ~gh1and Messenger, a newspaper of general circulation printed and published

~ outside the City of San Bernardino but in the County of San Bernardino,
2 California, which said Ordinance shall be preceded by the words "Notice of
3 Election", and that due publication of this Ordinance as herein provided is
4 hereby determined to be sufficient notice of said election, and the only
5 notice that shall be required to be given.
6 I HEREBY CERTIFY that the foregoing Ordinance was duly passed and
