HomeMy WebLinkAbout2958 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ~ """""'". ...215/ AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 212 (LAFC 637). 2 3 4 WHEREAS, heretofore, proceedings were initiated by the Common 5 Council of the City of San Bernardino, on its own motion, to annex to the 6 City of San Bernardino certain contiguous uninhabited territory hereinafter 7 described; and 8 WHEREAS, on the 21st day of October, 1968, a resolution was adopted 9 by the aforesaid Common Council of the City of San Bernardino, California, declaring that proceedings had been initiated by said Council and proposing the annexation, for the reasons therein stated, of the aforementioned uninhabited territory to the City of San Bernardino, and that said resolution provided that the proposed annexation should be generally known and identified as Annexation District No. 212; and WHEREAS, said resolution set forth therein that all the property included in the aforesaid territory should be taxed equally with the other property within the City to pay the bonded indebtedness and any and all general indebtedness and liability of the City of San Bernardino contracted prior to or existing or outstanding at the time of the aforesaid proposed annexation of the aforesaid property as provided in the hereinbefore mentioned Government Code; and WHEREAS, said resolution did fix, determine and declare that a hearing be held on the 2nd day of December, 1968, at the hour of 9:30 o'clock A. M. in the Council Chambers of the City Hall in the City of San Bernardino and the same was the day, hour and place designated where any person owing real estate within such territory so proposed to be annexed and having any objections to the proposed annexation might object before the Common Council and show cause why such territory shouid not be annexed; and, furthermore, the said resolution provided that at any time not later than the said hour set, as mentioned hereinbefore for the said hearing, any owner of property within the said territory proposed to be annexed might file written protest with the City of San Bernardino against such annexation; and 9 101 111 12 13 14 15 16 17 II ~ WHEREAS, there was one written protest filed with the City Clerk 2 3 of the City of San Bernardino prior to 9:30 o'clock A. M. on the 2nd day of December, 1968; and 4 5 6 7 WHEREAS, on the 2nd day of December, 1968, the date set for the hearing of protests against the proposed annexation, Resolution No. 9550 was adopted by the Common Council of the City of San Bernardino declaring that a majority protest has not been presented; and 8 WHEREAS, it appears to the Common Council of the City of San Bernardino that the aforeaamd annexation proceedings have been completed and everything performed at this time in accordance with said Government Code, as mentioned hereinbefore, and any and all other laws in any was connected with the said annexation procedure having been complied with; and WHEREAS, the Common Council of the City of San Bernardino desire to approve at this time the annexation of the aforesaid territory. NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION ONE: That said territory herein described as Annexation 18 District No. 212 is hereby annexed and incprporated in and made a part of 19 the City of San Bernardino. 20 SECTION TWO: The territory herein referred to as being annexed to 21 the City of San Bernardino is particularly described as follows, to wit: 22 Those portions of Lots 1 and 2, Block 16; Lots 1, 2, 3, 4, 5 and 6, Block 15; Lot 1, Block 11, Map of West Highlands 23 as per plat thereof recorded in Book 5 of Maps, Page 77, and those portions of Lots 4, 5 and 6, Block 15; Lots 3, 4, 24 5, and 6, Block 18; Lots 5 and 6, Block 19, Orange Grove Tract as per plat thereof recorded in Book 11 of Maps, Page 25 14, records of the County Recorder of San Bernardino County, State of California, described as follows: 26 27 28 29 30 31 32 . Beginning at a point on the Present Corporate Limits of the City of San Bernardino, said point being the intersection of the Southerly prolongation of the East line of said Lot 2, Block 16 and the center line of Lynwood Drive, 82.50 feet wide; thence leaving said City Limit Line West along the center line of said Lynwood Drive a distance of 440.00 feet more or less to the Southerly prolongation of the East line of Tract No. 6805 as per plat thereof recorded in Book 87 of Maps, pages 89 and 90, records of said County; thence North along said Southerly prolongation and the East line of said Tract 7408 a distance of 494.70 feet more or less to the Northeast corner thereof; thence West along the North line of said Tract 7408 a distance of 880.22 feet more or less to the Northwest corner thereof; thence South along the West line of said Tract 7408 and the Southerly prolongation thereof a distance of 494.26 feet more or less to the center line of Lynwood Drive; thence West along the center line of Lynwood Drive a distance of 1320.00 feet more or less to its intersection with "the center line of Sterling Avenue; thence South along the center line of Sterling Avenue a distance of 990.00 feet more or less to its intersection with the center line of Citrus Street; thence East along the center line of Citrus Street a distance of 440.00 feet mare or less to the Northerly prolongation of the East line of said Lot 1, Block 11; thence South along said Northerly prolongation and th~ East line of said Lot 1, Block 11, a distance of 670.00 feet more or less to the Norher1y right of way line of the Atchison, Topeka and Santa Fe Railroad; thence Northwesterly along the Norhher1y line of said Atchison, Topeka and Santa Fe Railroad right of way a distance of 465.00 feet more or less to its intersection with the center line of Sterling Avenue; thence North along said Southerly prolongation, the East line of said Tract No. 4683 and the Northerly prolongation thereof a distance of 865.00 feet more or less to the Northerly line of the Atchison, Topeka and Santa Fe Railroad right of way; thence Northwesterly along the Northerly line of said Atchison, Topeka and Santa Fe Railroad right of way a distance of 735.00 feet more or less to the Southerly prolongation of the East line of Ironwood Street, 40.00 feet wide; thence North along said Southerly prolongation and the East line of said Ironwood Street a distance of 170.00 feet, more or less to the inter- section with the Easterly prolongation of the center line of Holly Vista Blvd., 60.00 feet wide; thence West along said Easterly prolongation a distance of 20.00 feet to the center line of said Ironwood Street; thence North along the center line of said Ironwood Street a distance of 800.00 feet more or less to the center line of Lynwood Drive; thence East along the center line of Lynwood Drive a distance of 887.00 feet more or less to its intersection with the Southerly prolongation of the East line of Tract No. 4589 as per plat thereof recorded in Book 59 of Maps, page 82, Records of said County; thence North along said Southerly prolongation and the East line of said Tract No. 4589 and the Northerly pro- longation thereof a distance of 988.35 feet more or less to the center line of Marshall Blvd.; thence South along said Northerly prolongation, the East line of said Lot 2 and along said City Limit Line a distance of 987.77 feet more or less to the point of beginning. 2 :5 4 Containing 155 acres, more or less. 5 6 7 SECTION THREE: That the above described property will be subject to taxation equally with the property within such municipal corporation to I I I I , pay its proportion of the following bonded indebtedness of the City of San 81 91 Bernardino, which said bonded indebtedness was outstanding or theretofore authorized and is outstanding at the time of said annexation, to wit: A bonded indebtedness of $490,000.00 incurred for the acquisition and construction of a public library, including additions to and enlargements of the public library system of said City, the outstanding indebtedness thereon being $290,000.00, bearing interest at the rates of 4 3/4%, 3 1/4% and 3 1/2% per annum; A bonded indebtedness of $1,116,000.00 incurred for the acquisition and construction of additions to, relocations of and replacements of the fire fighting system of said City, the outstanding indetibedness thereon being $865,000.00, bearing interest at the rates of 4%, 3%, 2 3/4%, 2.9% and 2 1/2% per annum. SECTION FOUR: The property herein annexed is declared to be a 21 part of Ward 4 and the boundaries of Ward 4 are hereby altered to include 22 said annexed territory, with zoning classifications as shown on a map filed 23 in the City Clerk's office titled "Exhibit A", consisting of portions of 24 Lots 1 and 2, Block 16; Lots 1, 2, 3, 4, 5 and 6, Block 15; Lot 1, Block 11, 25 Map of West Highlands; and portions of Lots 4, 5 and 6, Block 15; Lots 3, 4, 26 5 and 6, Block 18; Lots 5 and 6, Block 19, Orange Grove Tract, all located in 27 the County of San Bernardino, State of California, and described as follows: 28 Parcel 1, R-l~7200 Single Family Residential District: 29 30 31 32 . All of lots 1, 2, 3, 6 and the northerly 440 feet, more or less, of lots 4 and 5, block 15; the northerly 390 feet, more or less, of lot 1, all of lot 2, block 16, Map of West Highlands; all those portions of lots 3, 4, 5 and 6, block 18, Orange Grove Tract lying north of the San Bernardino County Flood Control property; all those portions of the east 140 feet, more or less, lot 4; - 4 - ~ 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 . and all of lots 5 and 6, block 15, Orange Grove Tract lying south of the center line of the A.T. & S.F. railroad right of way; aai all of lot 1, block 11, map of West Highlands lying north of the north line of the A.T. & S.F. railroad right of way line. Parcel 2, R-3-2000 Multiple Family Residential District: All those portions of lots 4, 5 and 6, block 18, Orange Grove Tract lying east and southerly of the south line of the San Bernardino County Flood Control property; and those portions of lots 4, 5 and 6, block 15, Orange Grove Tract described as follows: beginning at a point which is the east line of said lot 6 and the centerline of the A.T. & S.F. Railroad right of way; thence north along the east line of said lot 6 to the northeast corner of said lot 6; thence west along the north lines of said lots 4, 5 and 6 to the northwest corner of said lot 4; thence south along the west line said lot 4 approximately 40 feet; thence southeasterly along the north line of the A.T. & S.F. railroad right of way approximately 330 feet; thence south to the centerline of the A.T. & S.F. railroad right of way; thence southeasterly along the centerline of the A.T. & S.F. railroad right of way to the point of beginning. Parcel 3, R-3-3000 Multiple Family Residential District: Those portions of lots 5 and 6, block 19, Orange Grove Tract, described as follows: beginning at a point which is approximately 200 feet west of the northeast corner of said lot 5; thence west to the northwest corner of said lot 5; thence south along the west line of said lot 5 to the southwest corner thereof; thence east toe the west line of a dedicated unnamed street; thence northerly along the west line of said street to the northerly terminus thereof; thence east 30 feet; thence northerly along a curve concave to the northeast, a distance of approximately 370 feet; thence continuing north approximately 230 feet to the north line of said lot 5 and point of beginning. Parcel 4. C-1 Neighborhood Commercial District: Those portions of lots 5 and 6, block 19, Orange Grove Tract, described as follows: beginning at a point which is approximately 200 feet west of the northeast corner of said lot 5; thence east to the northeast corner of said lot 6; thence south to the southeast corner said lot 6; thence west approximately 270 feet to the east line of an unnamed dedicated street; thence northerly along the east line of said road to the northerly terminus thereof; thence continuing northerly along a curve concave to the northeast, a distance of approximately 370 feet; thence continuing north approximately 230 feet to the north line of said lot 5 and point of beginning. Parcel 5. "0" Open District: Those portions of lots 3, 4, 5 and 6, block 18, Orange Grove Tract and lots 3 and 4, block 15, Orange Grove Tract described as follows: starting at a point in the east line of said lot 6, block 18, approximately 420 feet south of the northeast corner said lot 6; thence south approximately 110 feet; thence southwesterly in an irregular manner along the south line of the flood control property to the east line of lot 3, block 18; - 5 - . ~ thence south approximately 180 feet to the north line of the A.T. & S.F. Railroad right of way; thence westerly along the north line of the A.T. & S.F.
