AN ORDINANCE OF THE CITY OF S~ B~ARDINO AMENDING ORDI-
NANCE NO. 1984 ENTITLED IN PART "AN ORDINANCE . . . GOVERNING
THE PLATTING AND SUBDIVIDING OF LAND; . . . "; AND PERMITTING
ORNAMENTAL STREET LIGHTING SYSTEMS IN SUBDIVISIONS TO BECOME THE
PROPERTY OF THE PUBLIC UTILITY ERECTING SUCH SYSTEMS; AND MODI-
FYING AMBIGUOUS LANGUAGE RELATING TO THE APPLICATION OF THE LOT
SPLIT PROVISIONS THEREOF.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION 1.. Ordinance No. 1984 Section 4.50 Subsection B
is hereby amended to read as follows:
"B. After final approval thereof, such systems shall
become the property of the City of San Bernardino, except when
the systems are installed by a public utility which assumes the
major portion of the cost of the purchase and installation of the
systems or when the facilities of the systems are attached to
poles or to a system in existence prior to the filing of the
tentative map.
The Mayor and Common Council may grant a variance from the
provisions of Subsection 4.50 when physical conditions existing
prior to the filing of the Tentative Map require an alternate type
of system."

SECTION 2. Ordinance No. 1984 Section Five Subsection 5.10
is hereby amended to read as follows:
"5.10 PROCEDURE:
A. When an owner or subdivider desires to split or divide
one or more lots or parcels of land into not more than
four (4) lots or parcels, he shall first comply with the
regulations hereinafter set forth which are in addition
to any other regulations provided by law.
B. An application for a lot split shall be filed on forms
provided by the City; shall contain the names of the
owners; and shall be signed by the applicant. A uniform
fee of twenty-three dollars ($23.00) shall be paid to the

City upon the filing of each application to defray the
.
costs and expenses involved.
C. Three copies of a map showing the proposed split shall
be prepared by a registered civil engineer or licensed
surveyor and such maps shall be filed with the Planning
Commission. The map shall show the exact dimensions and
all other applicable matters required by this ordinance
pertaining to tentative maps.
D. Notices of a hearing before the Planning Commission
on said application shall be posted at ten separate loca-
tions within a minimum radius of three hundred (300) feet
of the property under consideration at least ten (10) days
prior to said hearing.
E. The decision of the Planning Commission and any condi-
tions thereof shall be final unless an appeal is taken to
the Mayor and Common Council. The decision of the Com-
mission shall be immediately filed with the Mayor and
Common Council and mailed to the applicant at the address
shown on the application. The decision shall not become
effective for ten (10) days, during which time an appeal
may be taken to the Council by the applicant or any person
aggrieved by the commission's decision. The Council may
cause any Commission decision to be appealed. On the
24 appeal, the Council shall review the decision of the Com-
25 mission, hear new evidence and testimony if offered, and in
26 deciding the appeal may either affirm, reverse or modify
27 the decision of the Commission."
