ORDINANCE NO. .:/.1 tf,fL 2 3 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 213 (LAFC 661). 4 5 6 7 WHEREAS, heretofore, proceedings were initiated by the Common Council of the City of San Bernardino, on its own motion, to annex to the City of San Bernardino certain contiguous uninhabited territory hereinafter described; and 8 WHEREAS, on the 12th day of November, 1968, a resolution was adopted 9 by the aforesaid Common Council of the City of San Bernardino, California, declaring that proceedings had been initiated by said Council and proposing the annexation, for the reasons therein stated, of the aforementioned uninhabited territory to the City of San Bernardino, and that said resolution provided that the proposed annexation should be generally known and identified as Annexation District No. 213; and WHEREAS, said resolution set forth therein that all the property included in the aforesaid territory should be taxed equally with the other property within the City to pay the bonded indebtedness and any and all general indebtedness and liability of the City of San Bernardino contracted prior to or existing or outstanding at the time of the aforesaid proposed annexation of the aforesaid property as provided in the hereinbefore mentioned Government Code; and WHEREAS, said resolution did fix, determine and declare that a hearing be held on the 23rd day of December, 1968, at the hour of 7:00 o'clock P. M. in the Council Chambers of the City Hall in the City of San Bernardino, and the same was the day, hour and place designated where any person owning real estate within such territory so proposed to be annexed and having any objections to the proposed annexation might object before the Common Council and show cause why such territory should not be annexed; and, furthermore, the said resolution provided that at any time not later than the said hour set, as mentioned hereinbefore for the said hearing, any owner of property within the said territory proposed to be annexed might file written protest ~ith the City of San Bernardino against such annexation; and ~ WHEREAS, no written protests of any kind or nature whatsoever were 2 filed with the City Clerk of the City of San Bernardino prior to 7:00 o'clock 3 P. M. on the 23rd day of December, 1968, and thereafter on the 23rd day of 4 December, 1968, Resolution No. 9503 was adopted by the Mayor and Common 5 Council declaring that a majority protest has not been presented; and 6 WHEREAS, it appears to the Common Council of the City of San 7 Bernardino that the aforesaid annexation proceedings have been completed and 8 everything performed at this time in accordance with said Government Code, 9 as mentioned hereinbefore, and any and all other laws in any way connected 10 with the said annexation procedure having been complied with; and 11 WHEREAS, the Common Council of the City of San Bernardino desire 12 to approve at this time the annexation of the aforesaid territory. 13 NOW, THEREFORE, THE COMMON COUNCIL OF TIlE CITY OF SAN BERNARDINO 14 DO ORDAIN AS FOLLOWS: SECTION ONE: That said territory herein described as Annexation 16 District No. 213 is hereby annexed and incorporated in and made a part of 15 17 the City of San Bernardino. 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 SECTION TWO: The territory herein referred to as being annexed to the City of San Bernardino is particularly described as follows, to wit: That portion of David Way, North of Fortieth Street, and a portion of Lot 2 of the John Hancock Survey as per plat thereof, recorded in Book 2 of Maps, page 42, records of the County Recorder of San Bernardino County, State of California, and that portion of Fortieth Street, described as follows: . Beginning at a point on the present corporate limits of the City of San Bernardino, said point being at the intersection of the South line of Section 14, Township 1 North, Range 4 West, San Bernardino Meridian if said Section lines were extended across the Rancho Muscupiabe as per plat thereof recorded in Book 7 of Maps, Page 23, Records of the County Recorder of said County and the Southerly pro- longation of the East line of David Way, 40.00 feet wide as conveyed to the County of San Bernardino, May 14, 1954, by deeds recorded in Book 3383 of Official Records, pages 167 and 170, Records of the County Recorder of said County; thence West along the South line of said Section 14, the center line of Fortieth Street, and said City Limit Line a distance of 525.00 feet, more or less to the East line of Lot 1 of said John Hancibvlt':Stirvey; thence North along said City Limit Line and the East line of said Lot 1 a distance of 716.00 feet to the North line of the property conveyed to the San Bernardino County Flood Control District - 2 - J. by Deed Number 33, recorded November 22, 1944 in Book 1723, page 134, Official Records of said County; thence leaving said City Limit Line, East along the North line of said Flood Control Property a distance of 485.00 feet to the West line of said David Way; thence North along said West line of David Way a distance of 1075.00 feet more or less to the North line of said Rancho Muscupiabe and said City Limit Line; thence Southeasterly along the North line of said Rancho Muscupiabe and said City Limit Line a distance of 40.00 feet, more or less to the East line of said David Way; thence South along the East line of said David Way and said City Limit Line a distance of 1760.00 feet, more or less to the point of beginning. 2 3 4 5 6 7 8 9 Containing 9.92 acres, more or less. SECTION THREE: That the above described property will be subject 10 to taxation equally with the property within such municipal corporation to 11 pay its proportion of the following bonded indebtedness of the City of San 12 Bernardino, which said bonded indebtedness was outstanding Qr theretofore 13 authorized and is outstanding at the time of said annexation, to wit: 14 A bonded indebtedness of $490,000.00 incurred for the acquisition 15 and construction of a public library, including additions to and enlargements 16 of the public library system of said City, the outstanding indebtedness 17 thereon being $290,000.00, bearing interest at the rates of 4 3/4%, 3 1/4% 18 and 3 1/2% per annum; 19 A bonded indebtedness of $1,116,000.00 incurred for the acquisition 20 and construction of additions to, relocations of and replacements of the 21 fire fighting system of said City, the outstanding indebtedness thereon 22 being $865,000.00, bearing interest at the rates of 4%, 3%, 2 3/4%, 2.9% 23 and 2 1/2% per annum. 24 SECTION FOUR: The property herein annexed is declared to be a 25 part of Ward 4 and the boundaries of Ward 4 are hereby altered to include 26 said annexed territory, and said property is placed and declared to be in 27 "0" Open Zoning District. 28 29 30 31 32 SECTION FIVE: The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published three consecutive times, exclusive of holidays, in the San Bernardino Evening Telegram, a daily newspaper designated for that purpose. . - 3 - . 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 J.
