HomeMy WebLinkAbout2966 ~ ORDINANCE NO. d "7~ t 2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 215 (LAFC 663). 3 4 WHEREAS, heretofore, a petition was filed with the Common Council 5 of the City of San Bernardino requesting that certain uninhabited territory 6 contiguous to said City be annexed to the City of San Bernardino, and which 7 said petition described said territory and the boundaries thereof proposed 8 to be annexed to the City; and 9 WHEREAS, said petition was filed by the owners of not less than 10 one-fourth of the area of land in such territory, and representing not less 11 than one-fourth of the assessed value of such territory according to the 12 last preceding equalized assessment roll of the County of San Bernardino, 13 in which said County the City of San Bernardino is situated; and 14 WHEREAS, said petition requested the said territory to De annexed 15 to and included in the said municipal corporation in accordance with the 16 provisions of the Government Code, Section 35300, et seq.; and 17 WHEREAS, on the 2nd day of December, 1968, a Resolution was adopted 18 by the aforesaid Common Council of the City of San Bernardino, California, 19 proposing the annexation of the aforesaid uninhabited territory and that said 20 Resolution provided therein that the proposed annexation should be generally 21 known and identified as Annexation District No. 215; and 22 WHEREAS, said Resolution set forth therein that all the property 23 included in the aforesaid territory should be taxed equally with the other 24 property within the said City to pay the bonded indebtedness and any and all 25 general indebtedness and liability of the City of San Bernardino contracted 26 prior to or existing or outstanding at the time of the aforesaid proposed 27 annexation of the aforesaid property as provided in the hereinbefore 28 mentioned Government Code; and 29 WHEREAS, said Resolution did fix, determine and declare that a 30 hearing be held on the 13th day of January, 1969, at the hour of 7:00 o'clock 31 P. M. in the Council Chambers of the City Hall in the City of San Bernardino, 32 and the same was the day, hour and place designated where any person owning . ~ real estate within such territory so proposed to be annexed and having any 2 objections to the proposed annexation might object before the Common Council 3 and show cause why such territory should not be annexed, and, furthermore, 4 the said Resolution provided that at any time Qot later than the said hour 5 set, as mentioned hereinbefore for the said hearing, any owner of property 6 within the said territory proposed to be annexed might file written protest 7 with the City of San Bernardino against such annexation; and 8 WHEREAS, no written protests of any kind or nature whatsoever were 9 filed with the City Clerk of the City of San Bernardino prior to 7:00 o'clock 10 P. M. on the 13th day of January, 1969, and thereafter on the 13th day of 11 January, 1969, Resolution No. ;7J:J7 was adopted by the Mayor and Common Council 12 declaring that a majority protest has not bean presented; and 13 WHEREAS, it appears to the Common Council of the City of San 14 Bernardino that the aforementioned annexation proceedings have been completed 15 and everything performed at this time in accordance with said Government Code, 16 as mentioned hereinbefore, and any and all other laws in any way connected 17 with the said annexation procedure having been complied with; and 18 WHEREAS, the Common Council of the City of San Bernardino desire 19 to approve at this time the annexation of the aforesaid territory. 20 NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 21 DO ORDAIN AS FOLLOWS: 22 SECTION ONE: That said territory herein described as Annexation 23 District No. 215 is hereby annexed and incorporated in and made a part of 24 the City of San Bernardino. 25 SECTION TWO: The territory herein referred to as being annexed to 26 the City of San Bernardino is particularly describedcas follows, to wit: 27 That portion of Lots 14, 15, 16, 17, 18 and 19, Tract No. 3879, as per plat thereof recorded in Book 50 of Maps, 28 page 50, records of the County Recorder of San Bernardino County, State of California, and that portion of adjoining 29 streets, described as follows: 30 Beginning at a point in the Present Corporate Limits of the City of San Bernardino, said point being the intersection 31 of the center line of Twenty-first Street, 50.00 feet wide, with the center line of Elmwood Road, 66.00 feet wide; 32 thence Easterly along the center line of Twenty-first Street - 2 - 1 and along said City Limit Line a distance of 400.00 feet more or less to its intersection with the Northerly prolomgation of the East line of said Lot 19; thence leaving said City Limit Line South along said Northerly prolongation and the east line of said Lot 19 a distance of 145.00 feet to the Southeast corner of said Lot 19; thence West along the South line of said Lots 19, 18, 17, 16, 15 and 14 and the Westerly prolongation thereof to the center line of said Elmwood Road and said City Limit Line; thence Northerly along the center line of said Elmwood Road and said City Limit Line to the point of beginning. Containing 1.38 acres, more or less. 2 3 4 5 6 7 8 SECTION THREE: That the above described property will be subject 9 to taxation equally with the property within such municipal corporation to 10 pay its propcrtion of the following bonded indebtedness of the City of San 11 Bernardino, which said bonded indebtedness was outstanding or theretofore 12 authorized and is outstanding at the time mf said annexation, to wit: 13 A bonded indebtedness of $490,000.00 incurred for the acquisition 14 and construction of a public library, including additions to and enlargements 15 of the public library system of s aid City, the outstanding indebtedness 16 thereon being $310,000.00, bearing interest at the rates of 4 3/4%, 3 1/4% 17 and J 1/2% per annum; 18 A bonded indebtedness of $1,116,000.00 incurred for the acquisition 19 and construction of additions to, relocations of and replacements of the 20 fire fighting system of said City, the outstanding indebtedness theeeon being 21 $865,000.00, bearing interest at the rates of 4%, 3%, 2 3/4%, 2.9 per cent 22 and 2 1/2% per annum. SECTION FOUR: The property herein annexed is declared to be a 24 part of Ward 2 and the boundaries of Ward 2 are hereby altered to include 23 25 said annexed territory, and said property is placed and declared to be in 26 R-1-7200 Singl~ Family Residential Zone. 27 SECTION FIVE: The City Clerk shall certify to the adoption~oIf~ 28 this Ordinance and shall cause the same to be published three consecutive 29 times, exclusive of holidays, in the San Bernardino I!;vening Telegram, a daily 30 newspaper designated for that purpose. 31 I HEREBY CERTIFY that the foregoing Ordinance was duly adopted by 32 -the Mayor and Common Council of the City of San Bernardino at a regular - 3 - J. 2 :5 4 5 6 7 8 9 10 11 12 13 14 15 15 17 18 19 20 21 22 23 24 25 25 27 28 29 30 31 32 meeting thereof, held on the ..;2 /.J d 1969, by the following vote, to wit: AYES: Councilmen day of ~-'iiL~~ tI , xLn~ (]I=' (;' c, ;#:c- City Clerk he foregoing Ordinance is hereby approved this c.:7 / Llf- day of ~ . - 4 - , 1969.
