WHEREAS, by Resolution, the Mayor and Common Council of the City of San Bernardino declared its intention to call a special election to be held in certain inhabited territory contiguous to said City, proposed to be annexed to said City, for the purpose of submitting to the qualified electors residing in said territory the question whether or not said territory shall be annexed to said City; and WHEREAS, a copy of said Resolution was published as required by law; and WHEREAS, at a time not later than the hour set by said Resolution for hearing objections to the proposed election, no written protests were made by the owners of one-half of the value of the territory proposed to be annexed, as shown by the last equalized assessment roll of the property within the territory proposed to be annexed; and WHLREAS, thereafter on the 27th day of January, 1969, Resolution No. ~,~ was adopted by the Mayor and Common Council declaring that a majority protest has not been presented; and WHEREAS, all proceedings have been had in accordance with said Resolution and the Annexation Act of 1913, reference thereto hereby being made for further particulars. NOW~ THEREFORE~ THE MAYOR ATID COI~IIfON COUNCIL OF THE CITY OE SAN BERNARDINO DO ORDAIN AS FOLIAWS: SECTION ONE: A special election hereby is called, to be held on the 25th day of March, 1969, in the territory hereinafter described and proposed to be annexed to the City of San Bernardino, for the purpose of submitting to the qualified electors residing in said territory the question whether or not such territory shall be annexed to, incorporated in and made a part of the City of San Bernardino, and whether or not the property in said territory shall, after such annexation, be subject to taxation equally with the property,within the City of San Bernardino to pay the entire bonded 1 indebtedness of the City of San Bernardino outstanding at the date of the 2 first publication of the notice of election for annexation. 3 Said territoxy is described as follows: 4 That portion of the North one-half of Section 32, Township 1 North, Range 3 West, San Bernardino Meridian and that 5 portion of La Verne Tract as per plat thereof recorded in Book 15 of Maps, page 11, and that portion of York Place 6 Subdivision as per plat thereof recorded in Book 18 of Maps, page 40, records of the County Recorder of San 7 Bernardino County, State of California~ described as follows: 8 Beginning at a point on the Present Corporate Limits of 9 the City of San Bernardino, said point being the intersection of the center line of Highland Avenue, 82.50 feet wide, and 10 the center line of Central Avenue, 40 feet wide; thence East along the center line of Highland Avenue and said City Limit 11 Line a distance of 1340.00 feet, more or lesa to its inter- section with the center line of Orange Street; thence 12 leaving said City Limit Line, South along the center line of said Orange Street a distance of 2640.00 feet, more or 13 less to its intersection with the center line of Pacific Street; thence West along the center line of Pacific Street 14 a distance of 1340.00 feet, more ox less to its intersection with the center line of Central Avenue and the said City 15 Limit Line; thence North along the center line of Central Avenue and said City Limit Line a distance of 2640.00 feet, 16 more or lesa to the point of beginning. 17 Containing 81 acres, more or less. 18 SECTION TWO: TIME OF OPENING AND CIASING OF POLLS. The polls at 19 said election shall be opened at 7:00 o'clock A. M. of the day herein fixed 20 for the holding of said election, and shall be kept open until 8:00 o'clock 21 p, M. of the same day, when the polls shall be closed. 22 SECTION THItEE: BALIATS. Upon the ballots to be used at said 23 election there shall be printed the words: 24 SHALL ANNEXATION DISTRICT N0. 217 BE ANNIXED T0, INCORPORATID IN 25 AND MADE A PART OE THE CITY OF SAN BERNARDINO AI~ID THE PROPSRTY IN SUCH 26 TIItRITORY BE, AFTER SUCH ANNN~ATION~ SUBJECT TO TAXATION EQUALLY WITH THE 27 pROPERTY WITHIN THE CITY OF SAN BERNARDINO~ TO PAY ITS PRO-RATA PORTION~ 28 BASED UPON ASSESSED VALUATION OF ALL BOPIDED INDEBTIDNESS OF THE CITY OF 29II SAN BERNARDINO OUTSTANDING AT THE DATE OF THE FIRST PUBLICATION OF THE 30II NOTICE OF ELECTION FOR ANNEXATION? 31 Opposite these wordst~er-~ shall be printed the words "YES" and 32 "NO", and to the right of each of these last two words, there shall be a - 2 - 1 voting square. If an elector shall stamp a cross (+) in the voting square 2 after the printed word "YES", the vote of such elector shall be counted in 3 favor of the annexation of said territory to the City of San Bernardino, and 4 if an elector shall stamp a cross (+) in the voting square after the printed 5 word "NO"~ the vote of such elector shall be counted against such annexation. s In all particulars not herein recited, said election shall be held 7 in conformity as near as may be with the laws of the State of California $ concerning general elections and with said Annexation Act of 1913. 9 SECTION FOUR: For purpose of said election there hereby is 10 established in the territory described herein one (1) consolidated voting 11 precinct which shall include all of said territory. The following is the 12 polling place of said election precinct, and the following named persons 13 hereby are designated as officers of election and shall constitute the board 14 of election for such election precinct: 15 Consolidated Voting Precinct No. 1 shall be compriaed of that 16 portion of County Precinct Highland 8 lying within the boundaries of this 17 annexation territory. 18 Polling Place - Highland-Pacific Elementary School 27040 Pacific Avenue 19 Highland, California 20 Inspector - Mrs. Carolyn C. Cordoza 25 6591 Pepper Drive Highland, California 26 Clerk - Mrs. Helen Du Bois 6563 La Verne Avenne 27 Highland, California 28 SECTION FIVE; This Ordinance shall take effect upon its publication. 29 SECTION SIX: The City Clerk shall certify to the passage and 30 adoption of this Ordinance by the Co~on Council of the City of San Bernardino 31 and shall cause the same to be published three consecutive times, exclusive 32 of holidays, in the San Bernardino Evening Telegram, a daily newspaper of - 3 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 general circulation printed and published within the City of San Bernardino, and once a week for four (4) weeks prior to the date of the election in the Aighland Messenger, a newspaper of general circulation printed and published outside the City of San Bernardino but in the County of San Bernardino, California, which said Ordinance shall be preceded by the words "Notice of Election", and that due publication of this Ordinance as herein provided is hereby determined to be sufficient notice of said election, and the only notice ~hat. shall be required to be given.
