WHEREAS, heretofore, proceedings were initiated by the Co~on Council of the City of San Bernardino, on its own motion, to annex to the City of San Bexnardino certain contiguous uninhabited territory hereinafter described; and WHEREAS, on the 16th day of December, 1968, a resolution was adopted by the aforesaid Cou~on Council of the City of San Bernardino, California, declaring that proceedings had been initiated by said Council and proposing the annexation, for the reasons therein stated, of the aforementioned uninhabited territory to the City of San Bernardino, and that said resolution provided that the proposed annexation should be generally known and identified as Annexation District No. 216; and WHEREAS, said resolution set forth therein that all the property included in the aforesaid territory should be taxed equally with the other property within the City to pay the bonded indebtedness and any and all general indebtedness and liability of the City of San Bernardino contracted prior to or existing or outstanding at the time of the aforesaid proposed annexation of the aforesaid property as provided in the hereinbefore mentioned Government Code; and WHEREAS, said resolution did fix, determine and declare that a hearing be held on the 27th day of January, 1969, at the hour of 7:00 o'clock P. M. in the Council Chambers of the City Hall in the City of San Bernardino, and the same was the day, Hmss~and place.:~ee~gaaged where any person owning real estate within such territory so proposed to be annexed and having any ' objections to the proposed annexation might object before the Common Council and show cause why such territory should not be annexed; and, furthermore, the said resolution provided that at any time not later than the said hour set, as mentioned hereinbefore for the said hearing, any owner of property within the said territory proposed to be annexed might file written protest with the City of San Bernardino against such annexation; and 1 WHEREAS, no written protests of any kind or nature whatsoever were 2 filed with the City Clerk of the City of San Bernardino prior to 7:00 o'clock 3 P. M, on the 27th day of January, 1969, and thereafter on the 27th day of 4 January, 1969, Resolution No. ~'1 ~ef ~ was adopted by the Mayor and Co~uon 5 Council declaring that a majority protest has not been presented; a~d 6 WHEREAS, it appears to the Comnon Council of the City of San 7 Bernardino that the aforesaid annexation proceedings have been completed and 8 everything performed at this time in accordance with said Government Code, 9 as mentioned hereinbefore, and any and all other laws in any way connected 10 with the said annexation procedure having been complied with; and 11 WHEREAS, the Co~on Council of the City of San Bernardino desire ~ 12 to approve at this time the annexation of the aforesaid territory. 13 NOW~ THEREFORE~ THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 14 DO ORDAIN AS FOLLOWS: 15 SECTION ONE: That said territory herein described as Annexation 16 District No. 216 is hereby annexed and incorporated in and made a part of 17 the City of San Bernardino. 18 SECTION TWO; The territory herein referred to as being annexed to 19~~ the City of San Bernardino is particularly described as follows, to:-wit: 20 Those portions of Lots 38, 39, 40. 41~ 41'~, 42, 48, 49~ 50, 51, 52, 54, S5~ 56, 57, 58, 60, 84~ 85, 61, and 62, 21 Irvington Land and Water Company's Subdivision, as per plat thereof recorded in Book 1, page 32, Records of Survey 22 on file in the office of the County Recorder of San Bernar- dino County, State of California, and those portions of 23 Sections 6 and 7, Township 1 North, Range 4 West, San Bernardino Meridian which include Lots 37, 47, 53~ and 24 59 as delineated on said map of Irvington Land and Water Company's Subdivision and that portion of Section 1, Town- 25 ship 1 North, Range 5 West, San Bernardino Meridian~ and that portion of the Rancho Muscupiabe as per plat thereof 26 recorded in Book 7 of Maps, page 23, records of said County, described as follows: 27 Beginning at Station M-24 in the Muscupiabe Rancho line as 28 same is shown in Book 7 of Maps, page 23, records of the County Recorder of said County, said point also being the 29 Southeasterly corner of Government Lot 9 of said Section 6 and being on the Present Corporate Limits of the City 30 of San Bernardino; thence along said City Limit Line the following courses and distances; thence Northwesterly a-long 31 the North line of said Rancho Muscupiabe and the Southerly line of Government Lots 9 and 7 of said Section 6 a 32 distance of 1,100.00 feet, more or less to the West line of - 2 - 1 said Government Lot 7; thence North along the West line of Government Lot 7 a distance of 1,290.00 feet more or less 2 to the Northwest corner thereof; thence East along the North line of Government Lots 7 and 8 of said Section 6 a 3 distance of 1,850.00 feet, more or less to the Northeast corner of said Lot 8, said point also being the Southeast ~ corner of Government Lot 1 of said Section 6; thence North- easterly along the Easterly line of said Lot 1 a distance 5 of 1,500.00 feet, more or less to the Northeast cmEner thereof; thence West along the North line of said Section s 6, Township 1 North, Range 4 West and leaving City Limit ,r Line and West along the North line of said Section 1, Township 1 North, Range 5 West, a distance of 5100.00 feet, 8 more or less to the Northeast corner of Government Lot 1 of said Section 1, Township 1 North, Range 5 West; thence 9 Southwesterly along the West line of the property conveyed to John P. Fauls Sr. by Deed recorded January 8, 1957 in 10 Book 4126, page 84, Official Records of said Countyr a distance of 1,335.00 feet, more or less, to a point on 11 the Southerly line of said Government Lot 1, which point is 900.00 feet Southeasterly thereon from the Southwest 12 corner of said Government Lot 1; thence Northwesterly along said Southerly line of Government Lot 1, a distance 13 of 70.00 feet~ more or less to the centerline of Palm Avenue; thence Southwesterly along said center line of said Palm 14 Avenue a distance of 5,900.00 feet, more or less to the Northwesterly prolongation of the center line of Kendall 15 Drive; thence Southeasterly along said Northwesterly pro- longation and the centerline of Kendall Drive a distance 16 af 4,800.00 feet, more ox less to the center line of Pine Avenue as said Pine Avenue is delineated on the Map of 17 Tract 2404 as per plat thereof recorded in Book 34 of Maps, pages 52 and 53, records of said County; thence Northerly along the center line of Pine Avenue and following its 18 various courses and distances, a distance of 710.00 feet 19 more or less, to the Northwesterly prolongation of the Northeasterly line of said Tract 2404; thence Southeasterly 20 along aaid Northwesterly prolongation and the Northeasterly line of said Tract 2404 a distance of 1,367.99 feet, more 21 or less to the most Northeasterly corner of Lot 25, Tract 2404, said point also being on said City Limit Line; thence 22 Northerly along said City Limit Line the following courses ° and distances; thence North 0 19' East a distance of 23 2,580.00 feet, more or less to an angle point therein; thence North 23° 25' East a distance of 1,110.47 feet; thence North 84° 34' East a distance of 404.21 feet; 24 thence North 36° 43' East a distance of 744.00 feet; 25 thence North 12° 10' East a distance of 1,208.11 feet; ° thence North 74 19' West a distance of 291.58 feet to the point of beginning. 26 Containing 820 acres, more or less. 27 SECTION THItEE: That the above described property will be subject 28 to taxation equally with the property within such municipal corporation to 29 pay its proportion of the following bonded indebtedness of the City of San 30 Bernardino, which said bonded indebtedneas was outstanding or theretofore 31 authorized and is outstanding at the time of said annexation, to wit: 32 A bonded indebtedness of $490,000.00 incurred for the acquisition - 3 - 1 and construction of a public library, including additions to and enlargements 2 of the public library system of said City, the outstanding indebtedness 3 thereon being $290,000.00, bearing interest at the rates of 4 3/4 ~r:-S 1~4% ~ and 3 1/2% per annum; 5 A bonded indebtedness of $1~116~000.00 incuxred for the acquisition s and construction of additions to, relocations of and replacements of the 7 fire fighting system of said City, the outstanding indebtedness thereon $ being $865~000.00, bearing interest at the rates of 4%, 3%, 2 3/4%, 2.9% 9 and 2 1/2% per annum. ~ 10 SECTION FOUR: The property herein annexed is declared to be a part 11 of Ward 5 and the boundaries of Ward 5 are hereby altered to include said 12 annexed territory, with zoning classifications as shown on a map filed in 13 the office of the City Clerk titled, "Exhibit A", consisting of portions of 14 Lots 38, 39, 40, 41~, 42, 48, 49, 50, 51, 52, 54, 55, 56, 57, 58, 60, 84, 15 $5~ 61~ and 62, Irvington Land and Water Company's Subdivision, and those 16 portions of Sections 6 and 7, Township 1 North, Range 4 West, San Bernardino 17 Meridian which include lots 37, 47~ 53, and 59 as delineated on said map of 18 Irvington Land and Water Company's Subdivision and that portion of Section 1, 19 Township 1 North, Range 5 West, San Bernardino Meridian; and that portion of 20 the Rancho Muscupiabe as per plat thereof recorded in Book 7 of Maps, page 23, 21 records of San Bernardino County, State of California, as follows: 22 R-1-10,800 SinRle Family Residential District: All that property located north of the Perrit line, 23 R.S. 1~32, except the following described property which shall be C-1 Neighborhood Commercial zoning: beginning 24 at a point where the existing city limits and the Perrin line converge; thence northwesterly along said Perris line 25 1200 feet; thence northeasterly and parallel with Walnut Avenue extended 300 feet; thence southeasterly and parallel 26 with said Perrin line to a point in the existing city limits; thence south to point of beginning. 27 C-1 NeiQhborhood Commercial District: 28 The north 300 feet of the east 510 feet, lying south of the Perrin line, lot 54 and the west 655 feet of the north 29 300 feet, lying south of the Perrin line, lot 48, Irvington Land and Water Company's Subdivision, 30 R-1-7200 SinQle Family Residential District: 31 All that property lying south of the Perrin line and norCh of the north line of Lots 42~ 52~ 58, and 62, Irvington Land 32 and Waper Company's Subdivision.
