2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0, 223 (LAFC 689).

4 WHEREAS, heretofore, a petition was filed with the Common Council
5 of the City of San Bernardino requesting that certain uninhabited territory
6I1 contiguous to said city be annexed to the City of San Bernardino, and which
7 said petition described said territory and the boundaries thereof proposed
8i to be annexed to the city; and
9 WHEREAS, said petition was filed by the owners of not less than
I
l0i one-fourth of the area of land in such territory, and representing not less
11 ', than one-fourth of the assessed value of such territory according to the
121 last preceding equalized assessment roll of the County of San Bernardino, in
13~ which said county the City of San Bernardino is situated; and
14j WHEREAS, said petition requested the said territory to be annexed
15 to and included in the said municipal corporation in accordance with the
16 provisions of the Government Code, Section 35300, et seq.; and
17 WHEREAS, on the 17th day of March, 1969, a resolution was adopted
18 by the aforesaid Common Council of the City of San Bernardino, California,

19i proposing the annexation of the aforesaid uninhabited territory and that said

20 resolution provided therein that the proposed annexation should be generally
21~ known and identified as Annexation District No. 223; and
221 WHEREAS, said resolution set forth therein that all the property
23 included in the aforesaid territory should be taxed equally with the other
24 property within the said city to pay the bonded indebtedness and any and all
25 general indebtedness and liability of the City of San Bernardino contracted
26 prior to or existing or outstanding at the time of the aforesaid proposed
27 annexation of the aforesaid property as provided in the hereinbefore mentioned
28 Government Code; and
29 WHEREAS, said resolution did fix, determine and declare that a
30 hearing be held on the 28th day of April, 1969, at the hour of 7:00 o'clock
31 P. M. in the Council Chambers of the City Hall in the City of San Bernardino,
32 and the same was the day, hour and place designated where any person owning

1 real estate within such territory so proposed to be annexed and having any
2 objections to the proposed annexation might object before the Common Council
3, and show cause why such territory should not be annexed; furthermore, the
4 said resolution provided that at any time not later than the said hour set,
5 as mentioned hereinbefore for the said hearing, any owner of property within
6 the said territory proposed to be annexed might file written protest with the
7 City of San Bernardino against such annexation; and
$ WHEREAS, no written protests of any kind or nature whatsoever were
9 filed with the City Clerk of the City of San Bernardino prior to 7:00 o'clock

10; P. M, on the 28th day of April, 1969, and thereafter on the 28th day of
11~ April, 1969, Resolution No. was adopted by the Mayor and Common
12~i Council declaring that a majority protest has not been presented; and
13I WHEREAS, it appears to the Common Council of the City of San
14 Bernardino that the aforementioned annexation proceedings have been completed
15i and everything performed at this time in accordance with said Government Code,
16 as mentioned hereinbefore, and any and all other laws in any way connected
17 with the said annexation procedure having been complied with; and
18 WHEREAS, the Common Council of the City of San Bernardino desire
19 to approve at this time the annexation of the aforesaid territory.
20~ NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
21 DO ORDAIN AS FOLLOWS:
22 SECTION ONE: That said territory herein described as Annexation
23 District No. 223 is hereby annexed and incorporated in and made apart of
24 the City of San Bernardino.
25 SECTION TWO: The territory herein referred to as being annexed to
26 the City of San Bernardino is particularly described as follows, to wit:
27 That portion of the Southwest one-quarter of the Southeast
one-quarter of Section 6, Township 1 South, Range 4 West,
28 San Bernardino Meridian and those portions of the adjoining
streets described as follows:

Beginning at a point on the Present Corporate Limits of the
30 City of San Bernardino, said point being the intersection
of the centerline of Terrace Road and the North line of the
31 Southeast one-quarter of the Southwest one-quarter of the
Southeast one-quarter of said Section; thence Easterly along
32 the said North line and along said City Limit Line, a

~ 1 distance of 680.00 feet, moreā¢or less, to the centerline
of Parley Avenue, 60.00 feet wide; thence leaving said
2 City Limit Line, North along said centerline of Parley
Avenue, a distance of 660.00 feet, more or less, to the
3 North line of the Southwest one-quarter of the Southeast
one-quarter of said Section 6; thence West along said
4 North line of the Southwest one-quarter of the Southeast
one-quarter of Section 6, a distance of 775.00 feet,
5i more or less, to the centerline of said Terrace Road
(Vacated); thence South along said centerline of Terrace
6~ Road, a distance of 675.00 feet, more or less, to the
~, Point of Beginning.
7! Containing 11.02 acres, more or less.
8i SECTION THREE: That the above described property will be subject
9~ to taxation equally with the property within such municipal corporation to
l0 pay its proportion of the following bonded indebtedness of the City of San
11~ Bernardino, which said bonded indebtedness was outstanding or theretofore
12 authorized and is outstanding at the time of said annexation, to wit:
13 A bonded indebtedness of $490,000.00 incurred for the acquisition
14 and construction of a.public library, including additions to and enlargements
15 of the public library system of said city, the outstanding indebtedness
16 thereon being $290,000.00, bearing interest at the rates of 4 3/4%, 3 1/4%
17 and 3 1/2% per annum;
18 A bonded indebtedness of $1,116,000.00 incurred for the acquisition
19 and construction of additions to, relocations of and replacements of the
20 fire fighting system of said city, the outstanding indebtedness thereon being
21 $865,000.00, bearing interest at the rates of 4%, 3%, 2 3/4%, 2.9% and
2~ 2 1/2% per annum.
23 SECTION FOUR: The property herein annexed is declared to be a
24 part of Ward 3 and the boundaries of Ward 3 are hereby altered to include
25 said annexed territory, with zoning classifications as shown on a map on
26 file in the City Clerk's office titled "Exhibit A", consisting of a portion
27 of the southwest one-quarter of the southeast one-quarter of Section 6,
28 Township 1 South, Range 4 West, San Bernardino Meridian, 11.02 acres, more
29 or less, described as follows:
30 R-1-7200 Single Familv Residential District
31 That portion Section 6, Township 1 South, Range 4 West,
San Bernardino Meridian, lying West of the San Bernardino
32 County Flood Control property.
