HomeMy WebLinkAbout3001 '~ ~I 1 ORDINANCE N0, ~ ~ ~ 2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNERATION OF DISTRICT N0, 227 (LAFC 730). 3 ' 4 WHEREAS, heretofore, proceedings were initiated by the Common 5 Council of the City of San Bernardino, on its own motion, to annex to the 6 City of San Bernardino certain contiguous uninhabited territory hereinafter 7 described; and 8 WHEREAS, on the 26th day of May, 1969, a resolution was adopted 9i by the aforesaid Common Council of the City of San Bernardino, California, l0i declaring that proceedings had been initiated by said Council, and proposing 11! the annexation, for the reasons therein stated, of the aforementioned 12 uninhabited territory to the City of San Bernardino, and that said resolution 13 provided that the proposed annexation should be generally known and 14 identified an Annexation District No. 227; and 15 WHEREAS, said resolution set forth therein that all the property 16 included in the aforesaid territory should he taxed equally with the other 17 property within the City to pay the bonded indebtedness and any and all 18 general indebtedness and liability of the City of San Bernardino contracted 19 prior to or existing or outstanding at the time of the aforesaid proposed 20 annexation of the aforesaid property as provided in the hereinbefore mentioned 21 Government Code; and 22 WHEREAS, said resolution did fix, determine and declare that a 23 hearing be held on the 7th day of July, 1969, at the hour of 9:30 o'clock A. M. 24 in the Council Chambers of the City Hall in the City of San Bernardino, and 25 the same was the day, hour and place designated where any person owning real 26 estate within such territory so proposed to be annexed and having any 27 objections to the proposed annexation, might object before the Common Council 28 and show cause why such territory should not be annexed; furthermore, the 29 said resolution provided that at any time not later than the said hour set, 30 as mentioned hereinbefore for the said hearing, any owner of property within 31 the said territory proposed to be annexed might file written protest with 32 the City of San Bernardino against such annexation; and i WHEREAS, there was one written protest filed with the City Clerk of the ~ City of San Bernardino prior to 9:30 o'clock A.M, on the 7th day of July, 1969; a d 2 WHEREAS, on the 7th day of July, 1969, the date set for the hearing of 3 protests against the proposed annexation, Resolution No. 9906 was adopted by ¢ the Common Council of the City of San Bernardino declaring that a majority 5 protest has not been presented; and 6 WHEREAS, it appears to the Common Council of the City of San 7 Bernardino that the aforesaid annexation proceedings have been completed and 8 everything performed at this time in accordance with said Government Code, as 9 mentioned hereinbefore, and any and all other laws in any way connected with 10~ the said annexation procedure having been complied with; and 11 WHEREAS, the Common Council of the City of San Bernardino desire to 12 approve at this time the annexation of the aforesaid territory. 13 NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 14 DO ORDAIN AS FOLLOWS: 15 SECTION ONE: That said territory herein described as Annexation 16 District No. 227 is hereby annexed and incorporated in and made apart of 17 the City of San Bernardino. 1$ SECTION TWO: The territory herein referred to as being annexed to 19 the City of San Bernardino is particularly described as follows, to wit: 20 Those portions of Blocks 65, 66, 70, 71, 76, 77, 82, 83 and 87, Irvington Land and Water Company's Subdivision, 21 as per plat thereof recorded in Book 1, Page 32, Records of Survey, and those portions of Lots H, 'T, J, K, L and M 22 0£ the Meyer and Barclay Resubdivision as per plat thereof recorded in Book 12 of Maps, Page 18, and Lots 11 and 13 23 of the Meyer and Barclay Sub as per plat thereof recorded in Book 2 of Maps, page 32, and that portion of Tract 3167 24 as per plat recorded in Book 42 of Maps, page 59, and that portion of Section 2, Township 1 North, Range 5 West, 25 San Bernardino Meridian, if said Section lines were extended across the Rancho Muscupiabe as per plat recorded in Book 7 26 of Maps, page 23, all of records of the County Recorder of San Bernardino County, State of Calif ornia, and those portions 27 of the adjoining streets, described as follows: 28 Beginning at a point on the Present Corporate Limits of the City of San Bernardino, said point being the intersection 29 of the center line of Palm Avenue, 60.00 feet wide and Belmont Avenue, 60.00 feet wide; thence leaving said City 30 Limit Line Northwesterly along the center line of Belmont Avenue a distance of 2850.00 £eet, more or less to the 31 Northeasterly prolongation of the Northwesterly line of Magnolia Avenue, 60.00 feet wide; thence Southwesterly 32 along said Northeasterly prolongation a distance of 30.00 2 - --- I I 1 feet to a point on present non-contiguous City Limit Line; thence along said present non-contiguous City Limit Line 2 the following courses and distances; thence Southwesterly along the Northwesterly line of Magnolia Avenue a distance 3 of 1360.00 feet, more or less, to the intersection with the Northeasterly line of Irvington Avenue, 60.00 feet wide; 4 thence Northwesterly along said Northeasterly line of Irvington Avenue a distance of 994.00 feet, more or less, 5 to the intersection of the Southwesterly prolongation of the Easterly line of the West 330.00 feet of said Block 76; I 6 thence Northeasterly along said Southwesterly prolongation and the East line of said West 330.00 feet a distance of 7 142.00 feet to the Northeasterly line of the South 132.00 feet of said Block 76; thence Northwesterly along said 8 Northeasterly line a distance of 330.00 feet, more or less to the Southeasterly line of Cypress Avenue, 60.00 feet 9 wide; thence Northeasterly along said Southeasterly line of Cypress Avenue a distance of 1080.00 feet, more or less, 10 to the intersection of the Southwesterly line of the North one acre of the West one-half of the West one-half of said 11 Block 76; thence Southeasterly along said Southwesterly line a distance of 330.00 feet, more or less, to the Easterly 12 line of the West one-half of the West one-half of said Block 76; thence Northeasterly along said last mentioned 13 Easterly line and its Northerly prolongation a distance of 130.00 feet, more or less, to the Southwesterly line of 14 said Belmont Avenue; thence Southeasterly along said South- westerly line of Belmont Avenue a distance of 990.00 feet, 15 more or less to the Northwesterly line of said Magnolia Avenue; thence leaving said non-contiguous City Limit Line 16 Northeasterly along the Northeasterly prolongation of the Northwesterly line of said Magnolia Avenue a distance of 17 30.00 feet to the center line of said Belmont Avenue; thence Northwesterly along the center line of said Belmont Avenue 18 a distance of 2060.00 feet, more or less, to the most Westerly terminus of said Belmont Avenue, said point also 19 being on the South line of Lot "H" of said Meyer and Barclay Resubdivision; thence Westerly along the South line of 20 said Lot "H" a distance of 75.00 feet, more or less, to the Southeast corner of that certain property conveyed to 21 Bernice Nyda Bonstein as parcel three in the deed recorded September 18, 1958, Document No. 435 in Book 4607, page 22 214, Official Records of said County; thence North 31° 53' West a distance of 449.90 feet to the most Northerly corner 23 thereof; thence South 57° 31' West along the Northwesterly line of said Bonstein property a distance of 132.69 feet to 24 a point on the Easterly line of said Lot "I" of said Meyer and Barclay Resubdivision; thence Northwesterly along the 25 Northeasterly line of Lots I, J, K, and L of said Meyer and Barclay Resubdivision a distance of 3282.00 feet, more or 26 less to the Northeast corner of Lot 11 of the Meyer and Barclay Sub; thence Northwesterly along the Northeasterly 27 lines of said Lots 11 and 13 of said Meyer and Barclay Sub a distance of 1910.70 feet to the Northeasterly corner of 28 Lot "Q" of said Meyer and Barclay Resubdivision; thence Southerly along the Easterly line of said Lot Q a distance 29 of 1933.00 feet, more or less to the center line of State Highway No. 31; thence Southeasterly along the center line 30 of State Highway No. 31 a distance of 10,120.00 feet, more or less, to the center line of said Palm Avenue; thence 31 Northeasterly along the center line of said Palm Avenue and along said City Limit Line a distance of 3420.00 feet, more or 32 less to the point of beginning. Containing 460 Acres, more or less. - 3 - i i 1 SECTION THREE: That the above described property will be subject 2 to taxation equally with the property within such municipal corporation to 3 pay its proportion of the following bonded indebtedness of the City of San 4 Bernardino, which said bonded indebtedness was outstanding or theretofore I 5 authorized and is outstanding at the time of said annexation, to wit: 6 A bonded indebtedness of $490,000.00 incurred for the acquisition I 7 and construction of a public library, including additions to and enlargements i 8 of the public library system of said City, the outstanding indebtedness 9 thereon being $290,000.00, bearing interest at the rates of 4 3/4%, 3 1/4% 10 and 3 1/2% per annum; 11 A bonded indebtedness of $1,116,000.00 incurred for the acquisition 12 and construction of additions to, relocations of and replacements of the 13 fire fighting system of said City, the outstanding indebtedness thereon 14 being $815,000.00, bearing interest at the rates of 4%, 3%, 2 3/4%, 2.9% 15 and 2 1/2% per annum. 16 SECTION FOUR: The property herein annexed is declared to be a part 17 of Ward 5 and the boundaries of Ward 5 are hereby altered to include said 18 annexed territory, with zoning classifications as shown on a map fiaed_iri the 19 office of the City Clerk titled, "Exhibit B", and described as follows: 20 "0" Open District: 21 All that property owned by the San Bernardino County Flood Control District lying in Lot 11 and 13, Meyers & Barclay Subdivision. 22 Except therefrom the following described property: 23 Parcel 1. Beginning at a point in the north line of State Highway 395 and the West line of said Lot 11; thence Southeasterly 24 along the north line of Highway 395, 810 feet, more or less, to the point of beginning; thence north 260 feet more or less; thence 25 northwesterly 100 feet; thence north 350 feet more or less; thence southeasterly 240 feet more or less; thence south to the north 26 line of State Highway 395; thence northeasterly along the north line of State Highway 395 to the point of beginning. 27 Parcel 2. Beginning at a point which is 1115 feet more or less 28 east of the west line of Lot 11 and in the north line of State Highway 395; said point being the point of beginning; thence north 29 690 feet; thence southeasterly 45 feet more or less; thence south 690 feet more or less to a point in the north line of State 30 Highway 395; thence northwesterly along the north line of State Highway 395 to point of beginning. 31 Parcel 3. Beginning at a point which is 1255 feet east of the 32 west line of Lot 11, and in the north line of State Highway 395; - 4 - i 1 thence north 140 feet more or less; thence southeasterly 250 feet; thence south 140 feet to a point in the north line of State 2 Highway 395; thence northwesterly along the north line of State Highway 395 to the point of beginning. 3 That portion of the flood control property lying in Lots I, J, K, 4 L, and M, Meyer and Barclay Resubdivision. 5 That portion of the flood control property lying in Lots 65, 66, 71, 82 and 83, Irvington Land & Water Company Subdivision. 6 The North 330 feet of the west 130 feet of Lot 76, Irvington Land 7 & Water Company Subdivision. 8 All of Lot 77, Irvington Land & Water Company Subdivision lying north of State Highway 395. 9 R-1-7200 SixtQle Family Residential District: 10 The south 142 feet of the west 330 feet, Lot 76, Irvington Land 11. & Water Company Subdivision. 12 All of Lots 87 and 70, Irvington Land & Water Company Subdivision. 13 All of Lot 71, Irvington Land & Water Company Subdivision, lying northerly of the San Bernardino County Flood Control Channel. 14 That portion Lot 82, Irvington Land & Water Company Subdivision 15 lying northerly of the San Bernardino County Flood Control channel. 16 That portion of Lot I, Meyer & Barclay Resubdivision lying northerly of the San Bernardino County Flood Control channel. 17 R-2 Two-Family Duplex Residential District: 18 All of Lot 65, Irvington Land & Water Company Subdivision lying 19 northerly of the San Bernardino County Flood Control channel. 20 R-3-3000 Multiple Family Residential District: 21 All the following described property lying in the Irvington Land & Water Company Subdivision. 22 All of Lot 71 lying north of State Highway 395 and south of the 23 San Bernardino Control Channel. 24 All of Lots 65 and 66 lying north of State Highway 395 and south of the San Bernardino Flood Control channel and west of the 25 C-3A zone property herein described. 26 All of Lots 82 and 83 lying north of State Highway 395 and South of the San Bernardino County Flood Control channel. 27 All the following described property lying in the Meyers & 28 Barclay Resubdivision: 29 All of Lots J, K, L, M, lying south of the San Bernardino County Flood Control Channel and north of State Highway 395. 30 All the following described property lying in the Meyer & 31 Barclay Subdivision: 32 That portion Lot 11 lying south of the San Bernardino County - 5 - it I, I) 1 Flood Control Channel herein described and north of State Highway 395. 2 That portion Section 2, Township 1 North, Range 5 West, San Bernardino Meridian lying south of the San Bernardino County Flood Control $ Channel and north of State Highway 395. 4 That portion Lot 23, Rancho Muscupiabe lying south of the San Bernardino County Flood Control Channel and north of State 5 Highway 395. 6 C-3A Limited General Commercial District: 7 The east 175 feet, more or less of Lot 65, Irvington Land & Water Company Subdivision lying north of State Highway 395 and the south 8 line of the San Bernardino County Flood Control Channel.
