HomeMy WebLinkAbout3002 Ii ~ ~i i 1 ORDINANCE N0. 3002 AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE N0. 1987 KNOWN AS THE "TAXICAB ORDINANCE"; CHANGING THE 3 METHOD OF DETERMINING THE NUMBER OF RESIDENTS IN THE CITY WHICH THEREBY GOVERNS THE NUMBER OF PERMITS ISSUED; IMPOSING REGULATIONS 4 CONCERNING PERMIT PLATES FOR VEHICLES; REQUIRING EACH HOLDER OF A DRIVERYS PERMIT TO OBTAIN A STATE DRIVERIIS LICENSE; AND REQUIRING 5 THE INSPECTION AND TESTING OF TAXIMETERS BY THE BUREAU OF WEIGHTS AND MEASURES. 6 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 7I DO ORDAIN AS FOLLOWS; $ SECTION 1. Ordinance No. 1987 Section Four Subsection (a) 9 is hereby amended to read as follows: 10 "(a) HEARINGS PRIOR TO GRANTING PERMITS OR INCREASES IN 11 SERVICE. No permit shall be granted to any carrier, as defined 12~ herein, except after a hearing thereon, conducted under and in 13 accordance with such rules and regulations as may, from time to 14 time, be prescribed therefor by the Bureau, and until the Bureau 15 shall have determined that the public convenience and necessity 16 require the operation proposed by the applicant for such permit, 17 The Bureau, in determining whether or not such facts exist, shall i 18 take into consideration the public demand for such service, the 19 adequacy or inadequacy of service being rendered by other carriers, 20 the effect of such service upon traffic, the financial responsi- 21 bility of the applicant, the amount of wages to be paid to employee , 22 the character of equipment proposed to be furnished, and any and 23 all other facts which the Bureau may deem relevant. Before 24 granting any such permit, the Bureau shall require its engineer or ~ 25 other authorized officer to present an oral or written report 26 which shall include his opinion as to the existence of public 27 convenience and necessity for the operation proposed by the appli- I, 28 canto However, the burden of establishing the existence of public I 29 convenience and necessity shall always be borne by the applicant, 30 and no permit shall be issued unless there has been an affirmative 31 showing of the existence of such public convenience and necessity 32 by such applicant. The foregoing provisions and requirements I i I~, ~ I 1 shall also apply where an increase in service is requested. ~ 2 In making the above determinations, the Bureau shall be 3 governed and limited by the following standards: 4 1. Not more than one (1) taxicab shall be permitted for 5 each 2,000 residents of the City of San Bernardino, or major 6 portion thereof. 7i 2. Not more than one (1) ambulance shall be permitted for , 8 each 25,000 residents of the City of San Bernardino, or major I 9 portion thereof. 10 3, Not more than one (1) wheelchair passenger transporta- 11 tion vehicle shall be permitted for each 100,000 residents of the ~ i 12i City of San Bernardino or major portion thereof; provided that if 13 the number of calls averages over ten (10) per day per vehicle in 14 any ninety (90) day period, then the Bureau may authorize an I 15 additional vehicle, 16 4. Not more than one (1) chauffeured limousine shall be ' 17 permitted for each 25,000 residents of the City of San Bernardino, ~ 18 or major portion thereof. ' 19 The number of residents of the City of San Bernardino shall 20 be determined by the current population estimate of the Planning 21 Director of the City." 22 SECTION 2. Ordinance No, 1987 Section Eight is hereby 23 amended to read as follows: I 24 "SECTION EIGHT: DISPLAY OF PERMIT PLATES. There shall be j 25 displayed upon each vehicle operated pursuant to the terms of this 26 ordinance, a numbered permit plate, for the current year, to be ~ 27 issued by the City upon payment of the required license fee. Such ~I 28 plates shall be of a material and of a form and design prescribed 29 by the Bureau from time to time, Each such plate shall be securel 30 attached on the hood of any towing vehicle and on the rear of any 31 other vehicle and shall be plainly visible at all times. 32 -2- !I i i 1 In the event of loss or destruction of any such plate, a 2 renewal plate shall be secured by payment to the City Clerk of a 3 fee of $2.00 for each such plate, but no such renewal plate shall 4 be issued except upon application to the Bureau, and establishing 5 by clear and satisfactory proof that the plate being replaced has 6 been lost or destroyeda 7~ A current and complete description of each vehicle on which 8I a permit plate is attached or may be attached and displayed shall 9 be filed on an approved form with the Franchise Bureau," i 10~' SECTION 3. Ordinance No. 1987 Section Twenty-two Subsection 11 (e) is hereby amended to read as follows: 12 "(e) No Driver4s Permit, or Temporary Drivers Permit, 13 shall be issued to any applicant who is under the age of twenty- 14 one (21) years, or who has failed to obtain a Driver4s License of 15 the requisite type or class from the State of California, or who 16 has, to the knowledge of the Chief of Police, been convicted of a 17 felony, or who shall be deemed by him to be morally unfits" 18 SECTION 4. Ordinance No. 1987 Section Thirty Subsection 19 (d) is hereby amended to read as follows: 20 "(d) The carrier shall cause each taximeter to be inspected 21 and tested for accuracy at least once every six (6) months.
