HomeMy WebLinkAbout3011 - 1 ORDINANCE N0. ..36// 2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0. 229 (LAFC 742). 3 4 WHEREAS, heretofore, proceedings were initiated by the Common 5 Council of the City of San Bernardino, on its own motion, to annex to the 6 City of San Bernardino certain contiguous uninhabited territory hereinafter 7 described; and 8 WHEREAS, on the 30th day of June, 1969, a resolution was adopted 9 by the aforesaid Common Council of the City of San Bernardino, California, 10 declaring that proceedings had been initiated by said Council, and proposing 11 the annexation, for the reasons therein stated, of the aforementioned 12 uninhabited territory to the City of San Bernardino, and that said resolution 13 provided that the proposed annexation should be generally known and 14 identified as Annexation District No. 229; and 15 WHEREAS, said resolution set forth therein that all the property 16 included in the aforesaid territory should be taxed equally with the other 17 property within the City to pay the bonded indebtedness and any and all 18 general indebtedness and liability of the City of San Bernardino contracted 19 prior to or existing or outstanding at Che time of the aforesaid proposed 20 annexation of the aforesaid property as provided in the hereinbefore mentioned 21 Government Code; and 22 WHEREAS, said resolution did fix, determine and declare that a 23 hearing be held on the 18th day of August, 1969, at the hour of 9:30 o'clock 24 A. M. in the Council Chambers of the City Hall in the City of San Bernardino, 25 and the same was the day, hour and place designated where any person owning 26 real estate within such territory so proposed to be annexed, and having any 27 objections to the proposed annexation, might object before the Common Council 28 and show cause why such territory should not be annexed; furthermore, the 29 said resolution provided that at any time not later than the said hour set, 30 as mentioned hereinbefore for the said hearing, any owner of property within 31 the said territory proposed to be annexed might file written protest with 32 the City of San Bernardino against such annexation; and I I 1 WHEREAS, no written protest of any kind or nature whatsoever were 2 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock 3 A. M. on the 18th day of August, 1969, and thereafter on the 18th day of 4 August, 1969, Resolution No. was adopted by the Mayor and Common 5 Council declaring that a majority protest has not been presented; and 6 WHEREAS, it appears to the Common Council of the City of San 7 Bernardino that the aforesaid annexation proceedings have been completed and 8 everything performed at this time in accordance with said Government Code, 9 as mentioned hereinbefore, and any and all other laws in any way connected 10 with the said annexation procedure having been complied with; and 11 WHEREAS, the Common Council of the City of San Bernardino desire 12 to approve at this time the annexation of the aforesaid territory. 13 NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 14 DO ORDAIN AS FOLLOWS: 15 SECTION ONE: That said territory herein described as Annexation 16 District No. 229 is hereby annexed and incorporated in and made a part of 17 the City of San Bernardino. 18 SECTION TWO: The territory herein referred to as being annexed to 19 the City of San Bernardino is particularly described as follows, to wit: 20 That portion of the East one-half of Section 29, Township 1 North, Range 3 West, San Bernardino Meridian and that 21 portion of Mountain Nursery Tract, Map No. 2 as per plat thereof recorded in Book 7 of Maps, page 45, Records of 22 the County Recorder of San Bernardino County, State of California, and those portions of the adjoining streets 23 described as follows: 24 Beginning at a point on the present Corporate Limits of the City of San Bernardino, said point being the Northeast 25 corner of the Northwest one-quarter of the Northeast one- quarter of said Section 29; thence leaving said City Limit 26 Line East along the North line of said Section 29 a distance of 1,320.00 feet, more or less, to the Northeast 27 corner of said Section 29, said point also being the present corporate limits of said City; thence South along 28 the East line of said Section 29 and along said City Limit Line a distance of 2,340.00 feet, more or less, to the 29 center of Baldridge Canyon, said point being the Northeast corner of that certain property conveyed to William A. 30 McOmie by deed recorded June 6, 1961, Document No. 72 in Book 5449, page 62, Official Records of said County; thence 31 leaving said City Limit Line along the center line of Baldridge Canyon and along the Northwesterly line of said 32 McOmie property South 70° 30' West a distance of 100.50 feet; - 2 - 'I I ~'~ 1 thence South 40° 43' West along said Northwesterly line and the prolongation thereof a distance of 362.00 feet, more or 2 less, to the Southeasterly line of Lot 14 of said Mountain ~ ' Nursery Tract; thence Southwesterly along the Southeasterly 3 lines of Lots 14, 13, 12, 11, 10, 9, 8, and 7 a distance of 986.00 feet, more or less to the Southeast Corner of said 4 Lot 7; thence Northwesterly along the Southwesterly line of said Lot 7 and the prolongation thereof a distance of 785.00 5 feet, more or less to the center line of Orange Avenue, 40.00 feet wide said point being the East line of the West 6 one-half of the East one-half of said Section 29, said point also being on the present corporate limits of said City; 7 thence North along said City Limit Line, the center line of said Orange Avenue and the East line of the West one-half $ of the East one-half of said Section 29 a distance of 3,175.00 feet, more or less to the point of beginning. 9 Containing 91 acres, more or less. 10 SECTION THREE: That the above described property will be subject 11 to taxation equally with the property within such municipal corporation to 12 pay its proportion of the following bonded indebtedness of the City of San 13 Eernardino, which said bonded indebtedness was outstanding or theretofore 14 authorized and is outstanding at the time of said annexation, to wit: 15 A bonded indebtedness of $490,000.00 incurred for the acquisition 16 and construction of a public library, including additions to and enlargements 17 of the public library system of said City, the outstanding indebtedness 18 thereon being $290,000.00, bearing interest at the rates of 4 3/4%, 3 1/4% 19 and 3 1/2% per annum;
