HomeMy WebLinkAbout3012 _ I~ 1 ORDINANCE N0. ~D/~2 2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE AffiIHEXATION OF DISTRICT N0. 230 (LAFG 745). 3 '4 WHEREAS, heretofore, proceedings were initiated by the Common 5 Council of the City of San Bernardino, on its own motion, to annex to the 6 City of San Bernardino certain contiguous uninhabited territory hereinafter 7 described; and $ WHEREAS, on the 30th day of June, 1969, a resolution was adopted 9 by the aforesaid Common Council of the City of San Bernardino, California, l0 declaring that proceedings had been initiated by said Council, and proposing 11~ the annexation, for the reasons therein stated, of the aforementioned i 12 uninhabited territory to the City of San Bernardino, and that said resolution 13 provided that the proposed annexation should be generally known and 14 identified as Annexation District No. 230; and 15 WHEREAS, said resolution set forth therein that all the property 16 included in the aforesaid territory should be taxed equally with the other 17 property within the City to pay the bonded indebtedness and any and all 18 general indebtedness and liability of the City of San Bernardino contracted 19 prior to or existing or outstanding at the time of the aforesaid proposed 20 annexation of the aforsaid property as provided in the hereinbefore mentioned 21 government Code; and 22 WHEREAS, said resolution did fix, determine and declare that a 23 hearing be held on the 18th day of August, 1969, at the hour of 9:30 o'clock 24 A. Y. in the Council Chambers of the City Hall in the City of San Bernardino, 25 and the same was the day, hour and place designated where any person owning 26 real estate within such territory so proposed to be annexed, and having any 27 objections to the proposed annexation, might object before the Common Council 28 and show cause why such territory should not be annexed; furthermore, the 29 said resolution provided that at any time not later than the said hour set, 30 as mentioned hereinbefore for the said hearing, any owner of property within 31 the said territory proposed to be annexed might file written protest with 32 the City of San Bernardino against such annexation; and II It 1 WHEREAS, no written protest of any kind or nature whatsoever were 2 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'.clock 3 A. M. on the 18th day of August, 1969, and thereafter on the 18th day of 4 August, 1969, Resolution No. ~ was adopted by the Mayor and Common 5 Council declaring that a majority protest has not been presented; and 6 WHEREAS, it appears to the Common Council of the City of San 7 Bernardino that the aforesaid annexation proceedings have been completed and 8 everything performed at this time in accordance with said Government Code, 9 as mentioned hereinbefore, and any and all other laws in any way connected 10 with the said annexation procedure having been complied with; and 11 WHEREAS, the Common Council of the City of San Bernardino desire 12 to approve at this time the annexation of the aforesaid territory. 13 NOW, THEREFORE THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 14 DO ORDAIN AS FOLLOWS: 15 SECTION ONE: That said territory herein described as Annexation 16 District No. 230 is hereby annexed and incorporated in and made a part of 17 the City of San Bernardino. 18 SECTION TWO: The territory herein referred to as being annexed to 19 the City of San Bernardino is particularly described as follows, to wit: 20 Those portion of Sections 8, 9, and 17, Township 1 North, Range 4 West, San Bernardino Meridian if said Section lines 21 were extended across the Muscupiabe Rancho as per plat thereof recorded in Book 7 of Maps, page 23, Records of the 22 County Recorder of San Bernardino County and those portions of Lots 117, 118, 119, 120, 121, 122, 123, 124, 125, 136, 137, 23 138, 139, 140, Tract No. 1748 as per plat thereof recorded in Book 25 of Maps, page 59, records of the County Recorder of 24 San Bernardino County, State of California, and those portions of the adjoining streets described as follows: 25 Beginning at a point on the present Corporate Limits of the 26 City of San Bernardino, said point being the intersection of the Northerly prolongation of the center line of Orange 27 Drive, 40.00 feet wide and the North line of Hill Drive, 40.00 feet wide as said streets are delineated on the map 28 of said Tract 1748, said North line of Hill Drive also being the center line of Hill Drive 80.00 feet wide as said 29 street was widened by conveyance to the County of San Bernardino by Document recorded in Book 212, page 174 of 30 Deeds, records of the County Recorder of said County; thence Westerly along said City Limit Line and the center line of 31 said Hill Drive, said center line also being the North line of said Tract 1748 a distance of 328.75 feet more or less 32 to the intersection of the East line of said Section 17; - 2 - i ~ II i 1 thence Northerly along the East line of said Section 17 and the West line of said Section 9 and said City Limit Line a 2 distance of 2000.00 feet, more or less to a point which is 702.98 feet North of the South line of said Section 9; thence 3 North 89° 32' 30" East and along said City Limit Line a distance of 2103.92 feet to the Southeast corner of ,the 4 property conveyed to the San Bernardino County Flood Control described as parcel No. 4 in the Deed recorded April 23, 1940, 5 Docyment No. 18 in Book 1415, page 37, Official Records of said County; thence leaving said City Limit Line North 12° 6 46' 30" East along the East line of said Flood Control Property a distance of 440.67 feet; thence North 03° 50' 7 West along said Easterly line a distance of 2113.10 feet to the North line of said Rancho Muscupiabe; thence North 62° 41' 8 West along said Rancho Line a distance of 980.81 feet to station M-29 therein; thence Northerly along said Rancho line 9 a distance of 1786.17 feet to station M-28 therein; thence North 89° 03' West along the North line of said Rancho 10 Muscupiabe a distance of 516.90 feet to the Northeast Corner of the property conveyed to C. F. Martin by deed recorded in 11 Book 740 of Deeds, page 199, records of said County and being on said City Limit Line; thence along said City Limit Line 12 the following courses and distances; thence South 22° 36' West, 626,13 feet; thence South 41° 08' West 241.56 feet; 13 thence South 10° 58' East, 127.05 feet; thence South 41° 09' West, 50.00 feet to the most Northerly point of that certain 14 parcel No. 4 as described in said deed to the San Bernardino County Flood Control District; thence South 39° OS' East, 15 85.12 feet to the most Northwesterly corner of that certain parcel of land conveyed to the San Bernardino County Flood 16 Control District by deed recorded September 25, 1956, in Book 4046, Page 396, Official Records of said County; thence 17 South 59° 47' 20" East, 595.66 feet; thence South 29° 29` West, 700 feet to the most Southerly corner of the last 18 mentioned deed to the San Bernardino County Flood Control District; thence South 38° 31' East, 1666.20 feet; thence 19 Southwesterly a distance of 680.00 feet, more or less, to the Northerly termination of a line described in said parcel No. 4 20 in the above mentioned deed to the San Bernardino County Flood Control District; said line being described in said deed 21 as "thence North 23° 57' East 331.05 feet"; thence South 23° 57' 38" West (Recorded North 23° 57' East) 331.05 feet; 22 thence North 86° 23' 38" West, 1291.52 feet; (Recorded South 86° 25' East, 1292.14 feet); thence South O1° 39' 08" West 23 (Recorded North O1° 39' East) a distance of 596.95 feet, more or less, to the point of intersection with a line that 24 is the westerly prolongation of a line that is parallel with and 205.00 feet North of the Northerly line of that certain 25 Annexation No. 89 to the City of San Bernardino; thence Westerly along said Westerly prolongation of said parallel 26 line a distance of 120.00 feet, more or less, to the point of intersection with the Northe=ly prolongation of a line 27 that is 250.00 feet West of, measured at right angles to and parallel with the East line of said Sections 8 and 17; thence 28 Southerly along said parallel line a distance of 2470.00 feet, more or less to the point of intersection with a line that is 29 the Westerly prolongation of a line that is 210.00 feet South of, measured at right angles to and parallel with the North 30 line of Lot 140 of said Tract 1748; thence Easterly along said Westerly prolongation of said last mentioned line a distance 31 of 270.00 feet, more or less to the West line of Lot 139 of said Tract No. 1748; thence Southerly along the West line of 32 Lots 139, 138, 137 and 136 of said Tract 1748, being the - 3 - i I~ i' i I 1 East line of WesteriY, Avenue and the Southerly prolongation thereof a distance of 425.00 feet, more or less to the center 2 line of Reservoir Drive, 40.00 feet wide; thence East along the center line of said Reservoir Drive a distance of 308.42 '~ feet more or less, to the center line of said Orange Drive; thence North along the center line of said Orange Drive a '4 distance of 143.00 feet, more or less to the Westerly prolon- gation of the North line of lot 116 of said Tract 1748; thence 5 East along said Westerly prolongation and the North line of said lot a distance of 165.00 feet more or less to the Northeast 6 Corner thereof; thence North along the East lines of lots 117, 7 118, 119, 120 and the Northerly prolongation thereof and leaving said City Limit Line a distance of 532.00 feet more ~ or less to the Northerly line of said Hill Drive 40.00 feet I $I wide thence West along said North Line of Hill Drive a 9 distance of 165.00 feet more or less to the point of beginning. Containing 130 acres, more or less. ~ 10 SECTION THREE: That the above described property will be subject 11 to taxation equally with the property within such municipal corporation to 12 pay its proportion of the following bonded indebtedness of the City of San 13 Bernardino, which said bonded indebtedness was outstanding or theretofore 14 authorized and is outstanding at the time of said annexation, to wit: 15 A bonded indebtedness of $490,000.00 incurred for the acquisition 16 and construction of a public library, including additions to and enlargements 17 of the public library system of said City, the outstanding indebtedness 18 thereon being $290,000.00, bearing interest at the rates of 4 3/4%, 3 1/4% 19 and 3 1/2% per annum; 20 A bonded indebtedness of $1,116,000.00 incurred for the acquisition 21 and construction of additions to, relocations of and replacements of the 2~ fire fighting system of said City, the outstanding indebtedness thereon 23 being $815,000.00, bearing interest at the rates of 4%, 3%, 2 3/4%, 2.9% 24 and 2 1/2% per annum. 25 SECTION FOUR: The property herein annexed is declared to be apart 26 of Ward 5 and the boundaries of Ward 5 are hereby altered to include said 27 annexed territory, with zoning classifications as shown on a map filed in 28 the office of the City Clerk titled, "Exhibit.A", and described as follows: 29 R-1-7200 Single Family Residential District 30 That portion Section 8, Township 1 North, Range 4 West, San Bernardino Meridian lying east and west of Western 31 Avenue north of Northpark Blvd.; and bounded on the east, west and north by present city limits and the Flood Control 32 Property herein described for "0" Open District zoning. - 4 - 1 R-1-14,400 Single Family Residential District 2 That portion Section 9, Township 1 North, Range 4 West, San Bernardino Meridian bounded by the north 3 line of Rancho Muscupiabe, the present city limits, and a portion of the "0" Open District zoned property 4 herein described. 5 R-3-3000 Multiple Family Residential District 6 That portion Section 17, Township 1 North, Range 4 West, San Bernardino Meridian lying east and west of Western 7 Avenue, south of Northpark Blvd., and bounded by existing ~ city limits on the east, south and west. 8 R-3-3600 Multiple Family Residential District 9 Lots 117, 118, 119, 120, 121, 122, 123, 124, 125, 136, 10 137, 138, 139, 140, Tract No. 1748. 11 "0" Open District 12 All that portion Sections 8 and 9, Township 1 North, Range 4 West, San Bernardino Meridian owned by the San Bernardino 13 County Flood Control District lying within said annexation except those parcels herein described and included in other 14 zoning districts within proposed annexation. 15 I HEREBY CERTIFY that the foregoing ordinance was duly adopted by 16 the Mayor and Common Council of the City of San Bernardino at an adjourned 17 regular meeting thereof, held on thel day of iar,~ , 18 1969, by the following vote, to wit: 19 AYES: Councilmen o~./.4mf ~ 9~/~iie%/~ ~'~}i5-~~~ y 20 Gnam.w~ ,7 ~ c%~, 21 NOES 22 ABSENT: ~orrp~ -T 23 24 City Clerk 25 26 The foregoing ordinance is hereby approved this day 27 of Qiini..-~f 1969. 28 Ma or of the City of San Bernardino 30 31 Approved as to f~ojrm~ /T O 32 City At rney -5- 1~'- -~ „ c GLC. 1
