2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0. 231 (LAFC 577 - PARCEL A).

4 WHEREAS, heretofore, proceedings were initiated by the Common
5 Council of the City of San Bernardino, on its own motion, to annex to the
6 City of San Bernardino certain contiguous uninhabited territory hereinafter
7 described; and
81 WHEREAS, on the 11th day of August, 1969, a resolution was adopted
9 by the aforesaid Common Council of the City of San Bernardino, California,
10 declaring that proceedings had been initiated by said Council, and proposing
11 the annexation, for the reasons therein stated, of the aforementioned
12 uninhabited territory to the City of San Bernardino, and that said resolution
13 provided that the proposed annexation should be generally known and
14 identified as Annexation District No. 231; and
15 WHEREAS, said resolution set forth therein that all the property
16 included in the aforesaid territory should be taxed equally with the other
17 property within the City to pay the bonded indebtedness and any and all
18 general indebtedness and liability of the City of San Bernardino contracted
~-9 prior to or existing or outstanding at the time of the aforesaid proposed
20 annexation of the aforesaid property as provided in the hereinbefore mentioned
21 Government Code; and
22 WHEREAS, said resolution did fix, determine and declare that a
23 hearing be held on the 29th day of September, 1969, at the hour of 9:30 o'clock
24 A. M. in the Council Chamber of the City Hall in the City of San Bernardino,
25 and the same was the day, hour and place designated where any person owning
26 real estate within such territory so proposed to be annexed. and having any
27 objections to the proposed annexation might object before the Common Council
28 and show cause why such territory should not be annexed; furthermore, the
29 said resolution provided that at any time not later than the said hour set,
30 as mentioned hereinbefore for the said hearing, any owner of property within
31 the said territory proposed to be annexed might file written protest with
32 the City of San Bernardino against such annexation; and

1 WHEREAS, a quorum not being present at the meeting on the 29th day
2~ of September, 1969, the time and place for hearing objections to the proposed
3 annexation was continued to the 6th day of October, 1969, at the hour of ~
4 9:30 o'clock A. M.; and
5 WHEREAS, one written protest was filed with the City Clerk of the City
6 of San Bernardino prior to 9:30 o'clock A. M. on the 6th day of October, 1969; a
7 WHEREAS, thereafter on the day of October, 1969, Resolution
8 No, q99~ was adopted by the Mayor and Cormnon Council declaring that a
9 majority protest has not been presented; and
10 WHEREAS, it appears to the Coon Council of the City of San
11~ Bernardino that the aforesaid annexation proceedings have been completed and
12 everything performed at this time in accordance with said Government Code,
13 as mentioned hereinbefore, and any and all other laws in any waF connected
14 with the said annexation procedure having been complied with; and
15 WHEREAS, the Common Council of the City of San Bernardino desire
16 to approve at this time the annexation of the aforesaid territory.
17 NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
18 DO ORDAIN AS FOLLOWS:
19 SECTION ONE: That said territory herein described as Annexation
20 District No, 231 is hereby annexed and incorporated in and made a part of
21 the City of San Bernardino.
22 SECTION TWO: The territory herein referred to as being annexed to
23 the City of San Bernardino is particularly described as follows, to wit:
24 Those portions of Lots 1, 11, 12, 13, 24, 25, Block 54,
Rancho San Bernardino as per plat thereof recorded in
25 Book 7 of Maps, page 2, records of the County Recorder
of San Bernardino County, State of California and those
26 portions of the adjoining streets described as follows:
27 Beginning at a point in the present corporate limits of the
City of San Bernardino, said point being the intersection ~,
28 of the center line of Waterman Avenue, 82.50 feet wide as
delineated on the map of said Rancho San Bernardino and the
29 center line of Rosewood Drive 60.00 feet wide; thence West
along the center line of said Rosewood Drive and said
30 City Limit Line a distance of 2100.00 feet, more or less
to the East line of that certain property conveyed to
31 Rose M. Lambert designated as parcel No. 4 recorded
January 7, 1959 in Book 4695, page 550, Official Records
32 of said County; thence North 0° 25' 30" West along said

1 City Limit Line a distance of 1660.00 feet more or less to
a point in the South line of said Lot 13; thence West
2 along said City Limit Line and the South line of said
Lot 13 a distance of 200.00 feet more or less to the
'~ Southeast corner of the West one-third of said Lot 13;
thence Northerly along the said City Limit Line and the
4 East line of the West one-third of said Lots 13 and 24 a
distance of 2050.00 feet, more or less to a point on the
5 Westerly prolongation of the South line of the property
conveyed to Harvey H. Head and Naomi B. Head by Deed
6 recorded April 19, 1967 in Book 6806, page 35, Official
7 Records of said County as Instrument Number 187; thence
Easterly along said City Limit Line and said Westerly
prolongation and the South line of said Harvey H. Head
8 property and the South line of the property conveyed to
Samuel James Bankhead and Helen Bankhead by Deed recorded
9 June 11, 1954 in Book 3400, page 293, Official Records of
said County as Instrument Number 142, to the Southeast
10 corner thereof, said point also being on the West line of
said Lot 25; thence Northerly along said City Limit Line
11 and the West line of said Lot 25 a distance of 99.00 feet,
more or less to the North line of the property conveyed
12 to Whittaker Electric Company, a California Corporation,
Rose Miller, a widow, by Deed recorded September 28, 1962
13 in Book 5775, page 815, Official Records of said County
as Instrument Number 371; thence Easterly along said
14 City Limit Line and the North line of said Whittaker
Electric Company property and the Easterly prolongation
15 thereof a distance of 1361.25 feet more or less, to a
point on the center line of said Waterman Avenue, said
16 point being 30 rods South of the North line of said Lot 25;
thence leaving said City Limit Line Southerly along the
17 center line of said Waterman Avenue a distance of 3810.00
feet more or less to the point of beginning.
18 Containing 180 acres, more or less.
19 SECTION THREE: That the above described property will be subject
20 to taxation equally with the property within such municipal corporation to
21 pay its proportion of the following bonded indebtedness of the City of San
2~ Bernardino, which said bonded indebtedness was outstanding or theretofore
23 authorized and is outstanding at the time of said annexation, to wit:
24 A bonded indebtedness of $490,000.00 incurred for the acquisition
25 and construction of a public library, including additions to and enlargements
26 of the public library system of said City, the outstanding indebtedness thereon
27 being $290,000.00, bearing interest at the rates of 4 3/4%, 3 1/4%, and
28 3 1/2% per annum;
29 A bonded indebtedness of $1,116,000.00 incurred for the acquisition
30 and construction of additions to, relocations of and replacements of the
31 fire fighting system of said City, the outstanding indebtedness thereon
82 being $815,000.00, bearing interest at the rates of 4%, 3%, 2 3/4%, 2.9%,

1 and 2 1/2% per annum.
2 SECTION FOUR: The property herein annexed is declared to be apart
3 of Ward 3 and the boundaries of Ward 3 are hereby altered to include said
4 annexed territory, with zoning classifications as shown on a map filed in the
5 office of the City Clerk titled, "Exhibit A", consisting of portions of Lots
6 1, 11, 12, 13, 24, 25, Block 54, Lots 5, 6, 7, 8, 9, 10, Block 72, Rancho
7 San Bernardino, the zoning boundary descriptions which apply to Parcel A,
8 North of Rosewood Drive, West of Waterman Avenue, are as follows:
9: C-M Commercial-Manufac~uiinA District:
10 Those portions of Lots 1, 11, 12, 13, 24, and 25, Block 5&,
Rancho San Bernardino lying west of Waterman Avenue and
11~ north, east, and south of existing city limits, excepting
therefrom the San Bernardino County Flood Control property
12 and San Ti~nteo Creek.
13 "0" Open District:
14 Those portions of Lots 11, 12, 13, and 24, Block 54, Rancho
San Bernardino designated San Bernardino County Flood
15 Control District property and the San Timoteo Creek, lying
west of Waterman Avenue and north, east and south of
16 existing city limits, excepting therefrom those portions
previously herein described for C-M zoning.

I HEREBY CERTIFY that the foregoing ordinance was duly adopted by
18
the Mayor and Common Council of the City of San Bernardino at an adjourned
19
