2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CTTY OF SAN
BERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0. 237 (LAFC 820).

4 WHEREAS, heretofore, proceedings were initiated by the Common Council
5 of the City of San Bernardino, on its own motion, to annex to the City of San ~
6 Bernardino certain contiguous uninhabited territory hereinafter described; and
7 WHEREAS, on the 24th day of November, 1969, a resolution was adopted

8 by the aforesaid Common Council of the City of San Bernardino, California,
9~ declaring that proceedings had been initiated by said Council, and proposing
i
10~ the annexation, for the reasons therein stated, of the aforementioned uninhabited
111 territory to the City of San Bernardino, and that said resolution provided that
12 the proposed annexation should be generally known and identified as Annexation
13 ~ District No. 237; and
14 WHEREAS, said resolution set forth therein that all the property
15 included in the aforesaid territory should be taxed equally with the other
16 property within the City to pay the bonded indebtedness and any and all general
17 indebtedness and liability of the City of San Bernardino contracted prior to or
18 existing or outstanding at the time of the aforesaid proposed annexation of the

19 aforesaid property as provided in the hereinbefore mentioned Government Code;
20 and
21 WHEREAS, said resolution did fix, determine and declare that a hearing
22 be held on the 5th day of January, 1970, at the hour of 9:30 oyclock A, M., of
23 said day, in the Council Chambers located in the Garner Building, 392 Court
24 Street, San Bernardino, California, and the same was the day, hour and place
25 designated where any person owning real estate within such territory so
26 proposed to be annexed, and having any objections to the proposed annexation,
27 might object before the Common Council and show cause why such territory should
28 not be annexed;.furthermore, the said resolution provided that at any time not
29 later than the said hour set, as mentioned hereinbefore for the said hearing,
30 any owner of property within the said territory proposed to be annexed might
31 file written protest with the City of San Bernardino against such annexation;

WHEREAS, no written protest of any kind or nature whatsoever was

2 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock
3 A, Mo, on the 5th day of January, 1970, and thereafter, on the 5th day of
¢ January, 1970, Resolution No. /~~ d -~ was adopted by the Mayor and Common
5 Council declaring that a majority protest has not been presented; and
6 WHEREAS, it appears to the Common Council of the City of San Bernardin
7 that the aforesaid annexation proceedings have been completed and everything
8 performed at this time in accordance with said Government Code, as mentioned
9~ hereinbefore, and any and all other laws in any way connected with the said
10 annexation procedure having been complied with; and
11 WHEREAS, the Common Council of the City of San Bernardino desires to j
12 approve at this time the annexation of the aforesaid territory.
13 NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
14 DOES ORDAIN AS FOLLOWS:
15 SECTION ONE: That stid territory herein described as Annexation
16 District No. 237 is hereby annexed and incorporated in and made a part of the
17 City of San Bernardino.
18 SECTION TWO: The territory herein referred to as being annexed to
19 the City of San Bernardino is particularly described as follows, to wit:
20 That portion of Orange Grove Tract as per plat recorded in
Book 11 of Maps, page 14, and that portion of Del Rosa Heights
21 Subdivision as per plat recorded in Book 19 of Maps, page 39,
records of the County Recorder of San Bernardino County, State
22 of California, and those portions of the adjoining streets,
described as follows:

Beginning at a point on the Present Corporate Limits of the
24 City of San Bernardino, said point being the intersection of
the Southerly prolongation of the West line of Del Rosa Avenue,
25 82.50 feet wide and a line which is parallel with and 25.00
feet North of and measured at right anglestn the center line
26 of Citrus Street 82.50 feet wide as said Citrus Street is deline-
ated on the Map of said Orange Grove Tract; thence North along
27 said City Limit Line and the West line of said Del Rosa Avenue
a distance of 1990.98 feet, more or less to the North line of
28 Marshall Boulevard, 82.50 feet wide; thence East along said
City Limit Line and the North line of said Marshall Boulevard
29 a distance of 482.50 feet, more or less, to the East line of
Lot 1, Block 22 of said Orange Grove Tract; thence leaving
30 said City Limit Line South along the Southerly prolongation
of the East line of said Lot 1 a distance of 41.25 feet to the
31 center line of said Marshall Boulevard; thence West along the
center line of said Marshall Boulevard a distance of 441.25
32 feet, more or less, to the center line of said Del Rosa Avenue;
thence South along the center line of said Del Rosa Avenue a
distance of 2970.00 feet, more or less, to the center line of

1' Date Street; thence West along the center line of said ~
2 Date Street a distance of 420.00 feet to the center line
of Park Avenue, 40.00 feet wide; thence North along the
3 center line of said Park Avenue and its Northerly prolongs- ~
tion a distance of 800.00 feet, more or less, to the
4 Westerly prolongation of the South line of Lot 1 of said Del
~ Rosa Heights Subdivieion; thence East along the Westerly ~
5' prolongation of the South line of said Lot 1 and the South
lines of Lots 1, 2, 3, and 4 of said Del Rosa Heights Sub-
s division a distance of 178.75 feet, more or less to the
Southeast Corner of said Lot 4; thence North along the
7 East line of said Lot 4 and the Northerly prolongation
thereof a distance of 207.50 feet to a point in a line
SI' which is parallel with and 25.00 feet North of and
measured at right angles to the center line of said Citrus
9 Street and being on said City Limit Line; thence East
along said parallel line and said City Limit Line a
10 distance of 200.00 feet to the point of beginning.
Containing 12.15 acres, more or less.

11' SECTION THREE: That the above described property will be subject to '

taxation equally with the property within such municipal corporation to pay its
13 proportion of the following bonded indebtedness of the City of San Bernardino,
14 which said bonded indebtedness was outstanding, or theretofore authorized and is
15 outstanding at the time of said annexation, to wit:

16 A bonded indebtedness of $490,000.00, incurred for the acquisition
i
17 and construction of a public library, including additions to and enlargements
18 of the public library system of said City, the outstanding indebtedness thereon ~
19 being $265,000.00, bearing interest at the rates of 4-3/4%, 3'~l 3~% per
20 annum;
21 A bonded indebtedness of $1,116,000.00, incurred for the acquisition
22 and construction of additions to, relocations of and replacements of the fire
23 fighting system of said City, the outstanding indebtedness thereon being
24 $815,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2'~% per
25 annum.
26 SECTION FOUR: The prpperty herein annexed is declared to be apart
27 of Ward 7, and the boundaries of Ward 7 are hereby altered to include said
28 annexed territory, with zoning classifications as shown on a map filed in the
29 office of the City Clerk titled, "Exhibit A", and described as follows:
30 C-3A Limited General Commercial District
31 All of Lots 5, 6, 17, 18, 19, and 22, Del Rosa
Heights Subdivision and the following described
32 property lying within Lot 6, Block 13, Orange
Grove Tract:
