2 AN ORDINANCE OF THE MAYOR AND COMIi'ON~/CTOUNCIL OF THE CITY OF SAN ~
BERNARDINO APPROVING THE ANNERATION OF DISTRICT N0, 238 (LAFC 832).

¢ WHEREAS, heretofore, proceedings were initiated by the Common Council
5 of the City of San Bernardino, on its own motion, to annex to the City of San
6 Bernardino certain contiguous uninhabited territory hereinafter described; and
7 WHEREAS, on the 8th day of December, 1969, a resolution was adopted
$ by the aforesaid Common Council of the City of San Bernardino, California,
g declaring that proceedings had been initiated by said Council, and proposing
10 the annexation, for the reasons therein stated, of the aforementioned uninhabited
11~, territory to the City of San Bernardino, and that said resolution provided that
12 the proposed annexation should be generally known and identified as Annexation
13 District No. 238; and
14 WHEREAS, said resolution set forth therein that all the property
15I included in the aforesaid territory should be taxed equally with the other
16 property within the City to pay the bonded indebtedness and any and all general
17 indebtedness and liability of the City of San Bernardino contracted prior to or
],g existing or outstanding at the time of the aforesaid proposed annexation of the
lg aforesaid property as provided in the hereinbefore mentioned Government Code;
20 and
21 WHEREAS, said resolution did fix, determine and declare that a hearing
22 be held on the 19th day of January, 1970, at the hour of 9:30 o'clock A. M„
23 of said day, in the Council Chambers located in the Garner Building, 392 Court
2¢ Street, San Bernardino, California, and the same was the day, hour and place
25 designated where any person owning real estate within such territory so pro-
2g posed to be annexed, and having any objections to the proposed annexation,
try might object before the Common Council and show cause why such territory should
2$ not be annexed; furthermore, the said resolution provided that at any time not
2g later than the said hour set, as mentioned hereinbefore for the said hearing,
30 any owner of property within the said territory proposed to be annexed might
31 file written protest with the City of San Bernardino against such annexation;

1~ WHEREAS, no written protest of any kind or nature whatsoever was
2i filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock
3 A. M., on the 19th day of January, 1970, and thereafter, on the 19th day of
4~ January, 1970, Resolution No. 10103 was adopted by the Mayor and Common
51 Council declaring that a majority protest has not been presented; and

6i WHEREAS, it appears to the Common Council of the City of San

7jl Bernardino that the aforesaid annexation proceedings have been completed and
$l everything performed at this time in accordance with said Government Code, as ~
9!i mentioned hereinbefore, and any and all other laws in any way connected with
I
1011 the said annexation procedure having been complied with; and
11','' WHEREAS, the Common Council of the City of San Bernardino desires to
12111 approve at this time the annexation of the aforesaid territory.
13I NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
14~ BERNARDINO DO ORDAIN AS FOLLOWS:

15~ SECTION ONE: That said territory herein described as Annexation
16 District No. 238 is hereby annexed and incorporated in and made a part of the
17 City of San Bernardino.

],g SECTION T4A: The territory herein referred to as being annexed to
1g the City of San Bernardino is particularly described as follows, to wit:
20 i That portion of Arrowhead Suburban Farms, Tract D, as per
plat thereof recorded in Book 23 of Maps, Page 35, records
21 of the County Recorder of San Bernardino County, State of
California and that portion of Sections 21 and 22, Township
22 1 North, Range 4 West San Bernardino Meridian if said section
lines were extended across the Muscupiabe Rancho as per plat
i 23 thereof recorded in Book 7 of Maps, page 23, records of said
County and those portions of adjoining streets, described as
24 follove:
25 Beginning at a point on the present corporate limits of the
City of San Bernardino, said point being the intersection of
26 the center lines of Third Avenue, 60.00 feet wide and Fortieth
Street delineated as "C" Street on said Arrowhead Suburban
27 Farms, Tract D; thence leaving said City Limit Line East along
the center line of said Fortieth Street a distance of 3300.00
2g feet, more or less to the Northerly prolongation of the West
line of Lot 1 of said Arrowhead Suburban Farms, Tract D; thence
29 South along said Northerly prolongation, the West lines of
Lots 1, 2, and 3 and the Southerly prolongation thereof a
30 distance of 414.00 feet, more or less to the Westerly prolonga-
tion of the center line of Acre Lane, 20.00 feet wide as
31 delineated on said map of Arrowhead Suburban Farms, Tract D;
thence East along the center line of said Acre Lane a distance
g2 of 330.00 feet, more or less, to the West line of Lot 9 of

D, said point is also described in the deed to the San

SECTION THREE: That the above described property will be subject to

taxation equally with the property within such municipal corporation to pay its
21
proportion of the following bonded indebtedness of the City of San Bernardino,
22
~ which said bonded indebtedness was outstanding or theretofore authorized and is

outstanding at the time of said annexation, to wit:

A bonded indebtedness of $490,000.00, incurred for the acquisition
' 25
and construction of a public library, including additions to and enlargements
26
of the public library system of said City, the outstanding indebtedness thereon
27
being $265,000.00, bearing interest at the rates of 4-3/4%, 3'y% and 3'~% per
28
annum;
29
A bonded indebtedness of $1,116,000.00, incurred for the acquisition
30
' and construction of additions to, relocations of and replacements of the fire
31
fighting system of said City, the outstanding indebtedness thereon being
32
$815,000.00, bearing interest at the rates of 4%, 3% 2-3/4%, 2.9% and 2'~% per an uQ

11 SECTION FOUR: The property herein annexed is declared to be apart ~

2 of Ward 5, and the boundaries of Ward 5 are hereby altered to include said '
3!~ annexed territory, with zoning classifications as shown on a map filed in the
4 office of the City Clerk titled, "Exhibit A", and described as follows:

13 I HRREBY CERTIFY that the foregoing ordinance was duly adopted by
14 the Mayor and Common Council of the City of San Bernardino at an adjourned
15 regular meeting thereof, held on the 26th day of January, 1970, by the following
16 vote, to wit:
