2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO APPROVING THE ANNEXATIQN OF DISTRICT N0, 240 (LAFC 848).

4 WHEREAS, heretofore, proceedings were initiated by the Common Council
5 of the Gity of San Bernardino, on its own motion, to annex to the City of San
6 Bernardino certain contiguous uninhabited territory hereinafter described; and
7 WHEREAS, on the 9th day of February, 1970, a resolution was adopted
$~ by the aforesaid Common Council of the City of San Bernardino, California,
9I declaring that proceedings had been initiated by said Council, and proposing
10 the annexation, for the reasons therein stated, of the aforementioned uninhabited
11 territory to the City of San Bernardino, and that said resolution provided that
12 the proposed annexation should be generally known and identified as Annexation

13i District No. 240; and
14 i WHEREAS, said resolution set forth therein that all the property
15 included in the aforesaid territory should be taxed equally with the other
16~property within the City to pay the bonded indebtedness and any and all general
17 indebtedness and liability of the City of San Bernardino contracted prior to or
18 existing or outstanding at the time of the aforesaid proposed annexation of the
19 !aforesaid property as provided in the hereinbefore mentioned Government Code;
20 ~ and
~ 21 WHEREAS, said resolution did fix, determine and declare that a hearing
22 ibe held on the 23rd day of March, 1970, at the hour of 9:30 o'clock A,M„ of
23 ~ said day, in the Council Chambers located in the Garner Building, 392 Court
24 Street, San Bernardino, California, and the same was the day, hour and place
25 designated where any person owning real estate within such territory so
26 proposed to be annexed, and having any objections to the proposed annexation,
27 might object before the Common Council and show cause why such territory should
28 not be annexed; furthermore, the said resolution provided that at any time not
29 later than the said hour set, as mentioned hereinbefore for the said hearing,
30 any owner of property within the said territory proposed to be annexed might
31 file written protest with the City of San Bernardino against such annexation;

1 WHEREAS, no written protest of any kind or nature whatsoever was
2 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock
3 A,M., on the 23rd day of March, 1970, and thereafter, ®n the 23rd day of March,
4 1970, Resolution No. 10175 was adopted by the Mayor and Common Council
5 declaring that a majority protest has not been presented; and
6i WHEREAS, it appears to the Common Council of the City of San Bernardino
7 that the aforesaid annexation proceedings have been completed and everything

8 performed at this time in accordance with said Government Code, as mentioned
9 hereinbefore, and any and all other laws in any way connected with the said
10 annexation procedure having been complied with; and
11 WHEREAS, the Common Council of the City of San Bernardino desires to
12 approve at this time the annexation of the aforesaid territory.
13 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
14 BERNARDINO DO ORDAIN AS FOLLOWS:
15 SECTION ONE: That said territory herein described as Annexation
16 District No. 240 is hereby annexed and incorporated in and made a part of the
17 City of San Bernardino.
18 ~ SECTION TWO: The territory herein referred to as being annexed to
19 the City of San Bernardino is particularly described as follows; to wit:
20~ That portion of Lots 1 and 2, Block 60, Rancho San Bernardino,
as per plat thereof recorded in Book 7 of Maps, Page 2, records
21 of the County Recorder of San Bernardino County, State of
California and those portions of adjoining streets, described
22 as follows:
23 Beginning at a point on the ,resent Corporate Limits of the
City of San Bernardino, said point being the intersection of
24 the Easterly prolongation of the center line of Amanda Street
60.00 feet wide with the said City Limit Line, said point also
25 being 330.00 feet, more or less East of the denter line of
Valaria Drive, 60.00 feet wide; thence along said City Limit Line
26 the following courses and distances; thence South along the West
line of that parcel deeded to Dellason Inc., a California Cor-
27 poration by deed recorded March 1, 1965, Document No. 65 in
Book 6339, page 663, Official Records of said County, being
28 also the West line of the East one-half of the Weat one-half
of said Lot 1, Block 60 and the West line of the San Bernardino
29 County Flood Control property by deed recorded July 23, 1943,
Document No. 34 in Book 1613, page 304, Official Records of
30 said County, a distance of 840.00 feet, more or leas, to the
South line of said Flood Control property; thence East along
31 the South line of said Flood Control property a distance of
330.00 feet, more or less to the Southeast corner thereof;
32 thence North along the East line of said Flood Control pEOperty

], a distance of 115.00 feet, more or less to the Southwest corner
of that parcel deeded to Court Street Fund, Inc., a Corporation,
2 by deed recorded August 27, 1965, Document No. 167 in Book 6462,
page 137, Official Records of said County; thence East along the
3 South line of said Court Street Fund property a distance of
330.00 feet, more or less to the Southeast corner thereof; thence
leaving said City Limit Line South along the East line of the
bleat one-half of the East one-half of said Lot 1 and the Southerly
$ prolongation thereof a distance of 660.00 feet, more or less, to
the center line of Baseline Street; thence West along the center
6 line of said Baseline Street a distance of 1430.00 feet more or
less to the Southerly prolongation of the bleat line of the property
7 conveyed to Jack 0. and Vivian E. Spencer et al by deed recorded
February 11, 1963, Document No. 525 in Book 5850, page 397,
$ Official Records of said County, said bleat line of the Spencer
property being the East line oftfi~:West one-third of the East
9 one-half of said Lot 2; thence North along said Southerly prolonga-
tion and the West lineoof said Spencer et al property a distance
10~ of 630.00 feet, more or less, to a point which is 630.00 feet
North of the center line of said Baseline Street; thence East along
11 a line parallel with and 630.00 feet North of the center lime of
said Baseline Street a distance of 440.00 feet, more or less, to
12 the Eaet line of said Lot 2; thence North along the East line of
said Lot 2 a distance of 740.00 feet, more or less to the center ~
13 line of said Amanda Street; thence East along the center line of
' said Amanda Street a distance of 330.00 feet, more or less to the
14 point of beginning. Containing 26 acres, more or less.
15 SECTION THREE: That the above described property will be subject to
16 taxation equally with the property within such municipal corporation to pay its
17 proportion of the following bonded indebtedness of the City of San Bernardino,
18, which said bonded indebtedness was outstanding or theretofore authorized and is
19 outstanding at the time of said annexation, to wit:
20 A bonded indebtedness of $490,000.00, incurred for the acquisition ~
21 and construction of a public library, including additions to and enlargements
22 of the public library system of said City, the outstanding indebtedness thereon
23 being $265,000.00, bearing interest at the rates of 4-3/4%, 3-1/4% and 3-1/2%
24 per annum;
25 A bonded indebtedness of $1,116,000.00, incurred for the acquisition
26 and construction of additions to, relocations of and replacements of the fire
27 fighting system of said City, the outstanding indebtedness thereon being
28 $815,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2%
29 par annum.
30 SECTION FOUR: The property herein annexed is declared to be part
31 of Ward 2, and the boundaries of Ward 2 are hereby altered to include said
32 annexed territory, with zoning classifications as shown on a map filed in the

1 office of the City Clerk titled, "Exhibit A", and described as follows:
2 R-1-7200 Single Family Residential District
3 The northerly 510 feet, more or less, Lot 1, Block 60,
Rancho San Bernardino lying south of Amanda Street.

"0" Open District

That portion of the flood control channel lying within
6 Lot 1, Block 60, Ranch® San Bernardino and lying southerly
of the R-1-7200 zoning herein described.

C-3 General Commercial District
8
That portion of Lots 1 and 2, Block 60, Rancho San
9 Bernardino lying north of Base Line Street and south
of the "0" zone herein described.

I HEREBY CERTIFY that the foregoing ordinance was duly adopted by
11
the Mayor and Common Council of the City of San Bernardino at an adjourned
12
regular meeting thereof, held on the 30th day of March, 1970, by the following
