2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO,REGULATING THE
3 INSTALLATION, OPERATION AND MAINTENANCE OF EQUIPMENT OR MACHINERY,
INCLUDING WASHERS, DRYERS, EXTRACTORS, WASHER EXTRACTORS AND COM-
4 PRESSORS; AND REPEALING ORDINANCE NO. 320.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5' DO ORDAIN AS FOLLOWS:
6, SECTION 1. The purpose of this ordinance is to regulate
7 the installation, operation and maintenance of equipment or
' $ machinery, including but not limited to washers, dryers, extrac-
9 tors and washer extractors of fifty-five (55) pound capacity or
10 larger, and compressors.
11 SECTION 2. No person, firm or corporation shall install
12 any equipment or machinery without first obtaining a permit from
13 the Department of Building and Safety. The fee for such permit
' 14 shall be ten dollars ($10.00). Such fee shall be in addition
15 and supplemental to any other fee charged for the installation of
16 such equipment or machinery.
17 A design drawing and calculations shall be submitted with
18 the application for a permit showing all information pertaining
19 to the equipment or machinery which is necessary for a determina-
20 tion of foundation requirements in order that it may operate
21 efficiently, safely, and with a minimum of vibration. A require-
22 ment of installation based on the design shall be that the ground
23 vibration inherently and recurrently generated does not cause a
24 displacement of the earth greater than .003 of one (1) inch as
251 measured at any point radially in any plane from the foundation,

26 as determined by the City Engineer of the City of San Bernardino.
27 SECTION 3. No person shall operate any of the above ~
28 equipment or machinery which due to faulty installation, main-
29 tenance or operation causes a ground vibration in excess of that
30 described above. If in the opinion of the City Engineer equipment
31 or machinery presently in operation does cause such excessive
32 vibration, the Superintendent of the Building and Safety Departmen
1 may require the operator to submit all the information required
2 for an original installation of such equipment or machinery.
3 If such information shows to the satisfaction of the City
4 Engineer that the existing installation of such equipment or
5i machinery does not meet the required standards, changes and
6i modifications of installation shall be required to obtain com-
p pliance with the standards before the operation of the equipment

$ or machinery may be continued.
9 SECTION 4. Any commercial laundry compressor maintained
10 outside of the commercial building on the premises shall be at
11 least seventy-five (75) feet from any other building occupied as
12 a residential dwelling, unless provision is made to completely
13 enclose the compressor in accordance with the minimum standards
14 set forth in a drawing marked "commercial laundry compressor" on
15 file in the Departments of City Engineer and Building and Safety,
16 City Hall, San Bernardino, California.
17 SECTION 5. The requirements of this ordinance are in
18 addition and supplemental to any other requirements set forth in
19 the Uniform Building Code or other. laws.
20 SECTION 6. Any person violating any of the provisions
21 of this ordinance shall be guilty of a misdemeanor and shall be
22 punishable therefor by a fine of not more than five hundred
23 dollars ($500.00) or by imprisonment in the San Bernardino County
24 Jail for a period of not more than six (6) months or by both such
25 fine and imprisonment.
26 SECTION 7. If any section, subsection, subdivision,
27 paragraph, sentence, clause or phrase of this ordinance or any
28 part thereof is for any reason held to be unconstitutional, such
i 29 decision shall not affect the validity of the remaining portions

31 Council hereb declare that it would have

1 thereof, irrespective of the fact that any one or more sections,
2 subsections, subdivisions, paragraphs, sentences, clauses or
3 phrases be declared unconstitutional.
4 SECTION 8. Ordinance No. 320 is hereby repealed.
5 I HEREBY CERTIFY that the foregoing ordinance was duly
6 adopted by the Mayor and Common Council of the City of San Ber-
