2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0, 242 (LAFC 857).

4 WHEREAS! heretofore, proceedings were initiated by the Common Council
5 of the City of San Bernardino, on its own motion, to annex to the City of San
6 Bernardino certain contiguous uninhabited territory hereinafter described; and
7 WHEREAS, on the 9th day of March, 1970, a resolution was adopted by
8 the aforesaid Common Council of the City of San Bernardino, California, declar-
9 ing that proceedings had been initiated by said Council, and proposing the

10~ annexation, for the reasons therein stated, of the aforementioned uninhabited
11 territory to the City of San Bernardino, and that said resolution provided that
12i the proposed annexation should be generally known and identified as Annexation
13 District No. 242; and
141 WHEREAS, said resolution set forth therein that all the property

15 included in the aforesaid territory should be taxed equally with the other
16 property within the City to pay the bonded indebtedness and any and all general
i 17 indebtedness and liability of the City of San Bernardino contracted prior to or
18~, existing ox outstanding at the time of the aforesaid proposed annexation of the

19i aforesaid property as provided in the hereinbefore mentioned Government Code;
20 ;I and

21~ WHEREAS, said resolution did fix, determine and declare that a
22 ' hearing be held on the 20th day of April, 1970, at the hour of 9:30 o'clock
23~~ A,M., of said day, in the Council Chambers located in the Garner Building,
24 392 Court Street, San Bernardino, California, and the same was the day, hour
25 and place designated where any person owning real estate within such territory
26 so proposed to be annexed, and having any objections to the proposed anclexa-
27 tion, might object before the Coon Council and show cause why such territory
28 should not be annexed; furthermore, the said resolution provided that at any
29 time not latex than the said hour set, as mentioned hereinbefore for the said
30 hearing, any owner of property within the said territory proposed to be annexed
31 might file written protest with the City of San Bernardino against such
32 annexation; and

1 WHEREAS, no written protest of any kind or nature whatsoever was
2 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock
3 A, M„ on the 20th day of April, 1970, and thereafter, on the 20th day of
~ April, 1970, Resolution No. 10222 was adopted by the Mayor and Common
5 Council declaring that a majority protest has not been presented; and
6 WHEREAS, it appears to the Common Council of the City of San Bernar-
7 dino that the aforesaid annexation proceedings have been completed and every-
$ thing performed at this time in accordance with said Government Code, as
Q mentioned hereinbefore, and any and all other laws in any way connected with
10 the said annexation procedure having been complied with; and
11 WHEREAS, the Common Council of the City of San Bernardino desires to
12 approve at this time the annexation of the aforesaid territory.
13i NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
', 14~ BERNARDINO DO ORDAIN AS FOLLOWS:
15 SECTION ONE: That said territory herein described as Annexation
16 District No. 242 is hereby annexed and incorporated in and made a part of the
17 City of San Bernardino.
1$ SECTION TWO: The territory herein referred to as being annexed to
lg the City of San Bernardino is particularly described as follows, to wit:
20~' That portion of Lot 4, Block 65, and that portion of Lot 1,
Block 54, all in Rancho San Bernardino as per plat thereof
21, recorde d in Book 7 of Maps, page 2, Records of the County
Recorder of San Bernardino County, State of California, and
221 those portions of the ad3oining streets described as follows:
23 Beginning at a point on the Present Corporate Limit Line of the
City of San Bernardino, said point being the intersection of the
24 center line of Redlands Boulevard, 82.50 feet wide and said
• City Limit Line, said point being 400.00 feet, more or leas,
25 East of the center line of Hunts Lane; thence Southerly along said
City Limit Line a distance of 1250.00 feet, more or less, to
2g the Northeasterly line of the Southern Pacific Railroad right
of way, 100.00 feet wide; thence Northwesterly along said right
try of way line and said City Limit Line a distance of 405.00 feet,
more or less, to the West line of said Lot 4; thence leaving
2$ said City Limit Line, Northerly along the West line of said
Lot 4 and along the Corporate Limit Line of the City of Colton
29 a distance of 1175.00 feet, more or less to the Northwest
corner of said Lot 4; thence continuing North along the
30 Corporate Limit Line of the City of Colton a distance of 310.00
feet, more or less, to the North line of U. S. Highway No. 99
31 and the San Bernardino City Limit Line; thence leaving said
Colton City Limit Line, Northeasterly along said San Bernardino
32 City Limit Line and the North line of said U. S. Highway No. 99

1 a distance of 390.00 feet, more or less, to an angle point
in said San Bernardino City Limit Line; thence South along
2 said City Limit Line a distance of 325.00 feet, more or less,
to the North line of said Redlands Boulevard; thence East
3 along said North line and said City Limit Line a distance of
60.00 feet, more or less, to an angle point in said City Limit
4 Line; thence South along said City Limit Line a distance of
41.25 feet to the point of beginning. Containing 14 acres,
5 more or less.
6 SECTION THREE: That the above described property will be subject to
7 taxation equally with the property within such municipal corporation to pay its
8 proportion of the following bonded indebtedness of the City of San Bernardino,
9 which said bonded indebtedness was outstanding or theretofore authorized and
10 is outstanding at the time of said annexation, to wit:
11 A bonded indebtedness of $490,000.00, incurred for the acquisition
12~ and construction of a public library, including additions to and enlargements
13 of the public library system of said City, the outstanding indebtedness thereon
14 being $265,000.00, bearing interest at the rates of 4-3/4%, 3-1/4% and 3-1/2%
15 per annum;
16 A bonded indebtedness of $1,116,000.00, incurred for the acquisition
17 and construction of additions to, relocations of and replacements of the fire
18 fighting system of said City, the outstanding indebtedness thereon being
19 $815,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2%
20 per annum.
21 SECTION FOUR: The property herein annexed is declared to be apart
22 of Ward 3, and the boundaries of Ward 3 are hereby altered to include said
23 annexed territory, with zoning classifications as shown on a map filed in the
24 office of the City Clerk titled, "Exhibit A", and described as follows:
25 C-3A Limited General Commercial District
I 2g That portion of Lot 1, Block 65, Rancho San Bernardino
lying between U. S. Highway No. 99 and Redlands Boulevard
27 rights of way.
2$ C-M Commercial-Manufacturing District
2g The northerly 460 feet, more or less, Lot 4, Block 65,
Rancho San Bernardino lying within said annexation.

M-1 Light Industrial District

All that portion Lot 4, Block 65, Rancho San Bernardino
32 lying within said annexation and excluding the C-M
zoning herein described.

], I HEREBY CERTIFY that the foregoing ordinance was duly adopted by
2 the Mayor and Common Council of the City of San Bernardino at an adjourned
$ regular meeting thereof, held on the 27th day of April, 1970, by the following
