HomeMy WebLinkAbout3068 1 ORDINANCE N06`~~%) L-u-- 'z AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0, 243 (LAFC 852). 3 WHEREAS, heretofore, proceedings were initiated by the Common Council 4 of the City of San Bernardino, on its own motion, to annex to the City of San 5 Bernardino certain contiguous uninhabited territory hereinafter described; and 6 WHEREAS, on the 16th day of March, 1970, a resolution was adopted 7 by the aforesaid Common Council of the City of San Bernardino, California, 8 declaring that proceedings had been initiated by said Council, and proposing 9 the annexation, for the reasons therein stated, of the aforementioned 10 uninhabited territory to the City of San Bernardino, and that said resolution 11 provided that the proposed annexation should be generally known and identified 12 as Annexation District No. 243; and 13~ WHEREAS, said resolution set forth therein that all the property 14 included in the aforesaid territory should be taxed equally with the other 15 property within the City bo pay the bonded indebtedness and any and all general 16 indebtedness and liability of the City of San Bernardino contracted prior to 17 or existing or outstanding at the time of the aforesaid proposed annexation of 18 the aforesaid property as provided in the hereinbefore mentioned Government 19 Code; and 20 21 WHEREAS, said resolution did fix, determine and declare that a hearing 22 be held on the 27th day of April, 1970, at the hour of 9:30 o'clock A, M„ of 23 said day, in^the Council Chambers located in the Garner Building, 392 Court 24 Street, San Bernardino, California, and the same was the day, hour and place 25 designated where any person owning real estate within such territory so 26 proposed to be annexed, and having any objections to the proposed annexation, 27 might object before the Common Council and show cause why such territory should 28 not be annexed; furthermore, the said resolution provided that at any time not 29 later than the said hour set, as mentioned hereinbefore for the said hearing, 30 any owner of property within the said territory proposed to be annexed might 31 file written protest with the City of San Bernardino against such annexation; 32 and -1- -- I 1 WHEREAS, no written protest of any kind or nature whatsoever was 2 filed with the City Clerk of the City of San Bernardino ppior to 9:30 o'clock 3 A, M,, on the 27th day of April, 1970, and thereafter, on the 27th day of 4 April, 1970, Resolution No. ~ ~ z 3 3 was adopted by the Mayor and Common 5 Council declaring that a majority protest has not been presented; and 6 WHEREAS, it appears to the Common Council of the City of San Bernar- 7 dino that the aforesaid annexation proceedings have been completed and every- 8 thing performed at this time in accordance with said Government Code, as 9 mentioned hereinbefore, and any and all other laws in any way connected with 10 the said annexation procedure having been complied with; and 11 WHEREAS, the Common Council of the City of San Bernardino desires to 12I approve at this time the annexation of the aforesaid territory. 13 NOW, THEREFORE, THE MAYOR AND COMMON COFNCIL OF THE CITY OF SAN 141 BERNARDINO DO ORDAIN AS FOLLOWS: 15 SECTION ONE: That said territory herein described as Annexation 16 District No. 243 is hereby annexed and incorporated in and made a part of the 17 City of San Bernardino. 18 SECTION TWO: The territory herein referred m as being annexed to 19 the City of San Bernardino is particularly described as follows, to wit: 20 Those portions of Lots 4, 5, 6, Block 9, Map of West Highlands ~ as per plat thereof Recorded in Book 5 of Maps, page 77, 21 Records of the County Recorder of San Bernardino County, State ~ of California, and those portions of the adjoining streets 22 described as follows: 23 Beginning at a point on the Present Corporate Limit Line of the City of San Bernardino, said point being the intersection 24 of the center line of Pumalo Street and the Southerly prolonga- tion of the West line of said Lot 4; thence leaving said City 25 Limit Line North along the West line of said Lot 4 and the Northerly prolongation thereof a distance of 980.00 feet, more 26 or less to the center line of Date Street, 82.50 feet wide; thence East along the center line of said Date Street a distance of 27 1320.00 feet, more or less to the center line of Arden Avenue, 82.50 feet wide; thence South along the center line of said 28 Arden Avenue a distance of 560.00 feet more or less to the Southeasterly prolongation of the Northeasterly line of Tract 29 6411 as per plat thereof, recorded in Book 83 of Maps, pages 1 and 2, records of the County Recorder of said County; thence 30 Northwesterly along said Southeasterly prolongation and the Northeasterly line of said Tract 6411, a distance of 470.00 feet 31 more or less, to the East line of said Lot 5, said point being also the Northwest corner of said Tract 6411; thence South 32 along the East line of said Lot 5 and the West line of said -2- i 1 Tract 6411 and the Southerly prolongation thereof a distance of 592.00 feet, more or less, to the center line of said 2 Pumalo Street and said City Limit Line; thence West along the center line of said Pumalo Street and said City Limit Line a 3 distance of 880.00 feet, more or less to the point of beginning. Containing 25 acres, more or less. 4 SECTION THREE: That the above described property will be subject to 5 taxation equally with the property within such municipal corporation to pay its 6 proportion of the following bonded indebtedness of the City of San Bernardino, 7 which said bonded indebtedness was outstanding or theretofore authorized and 8 is outstanding at the time of said annexation, to wit: 9 A bonded indebtedness of $490,000.00, incurred for the acquisition 10 and construction of a public library, including additions to and enlargements 11 of the public lihrary system of said City, the outstanding indebtedness thereon 12 being $265,000.00, bearing interest at the rates of 4x3/4%, 3-1/4% and 3-1/2% 13 per annum; 14 A bonded indebtedness of $1,116,000.00, incurred for the acquisition 15 and construction of additions to, relocations,of and replacements of the fire 16 fighting system of said City, the outstanding indebtedness thereon being 17 $815,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.97< and 2-1/2% 18 per annum. 19 SECTION FOUR: The property herein annexed is declared to be a part 20 of Ward 2, and the boundaries of Ward 2 are hereby altered to include said 21~ annexed territory, with zoning classifications as shown on a map filed in the 22 office of the City Clerk titled,'Exhibit A", and described as follows: 23 R-1-7200 Single Family Residential Zoning District. 24 I HEREBY CERTIFY that the. foregoing ordinance was duly adopted by 25 ~ the Mayor and Common Council of the City of San Bernardino at a regular 26 meeting thereof, held on the 4th day of May, 1970, by the following vote, ~o 27 wit: 28 AYES: Councilmen 29 l ~~, 30 NOES: ~~~s--yl0 31 r/ ABSENT:^` ~ _,p 32 - 3- 1 2 city Cle 3 The foregoing ordinance is hereby approved this~day of 4 May, 1970. 5 / 1 Mayor/of the C' of San Bernardino 7 Pro Tempore 8 9 Approved as to form: ~ ~ 10 ~' ' ~ ~% ~' 11 t?c ,fir, :' `/?.
