AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDI-
3 NANCE NO. 1991 KNOWN AS THE "LAND USE ZONING ORDINANCE"; AND
PROVIDING FOR AUTOMOBILE SERVICE STATIONS SUBJECT TO CONDITIONAL
4 DEVELOPMENT PERMITS IN "C-1". "C-2", "C-3", C-3A", "C-4", "M-1",
"M-lA" AND "M-2" DISTRICTS.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
6 DO ORDAIN AS FOLLOWS:
7 SECTION 1. Ordinance No. 1991 Section Ten Subsection
8 10,1 is hereby amended to read as follows:
9 "10.1 USES PERMITTED - No building or structure or land
10 shall be used and no building or structure shall be hereafter
11 erected, structurally altered, enlarged, or maintained, except
12 for the following uses:
13 A. RETAIL STORES:
14 1. Bakeries employing not more than five (5) people.
15 2. Book or stationery store.
16 3. Confectionery store.
17 4. Druq store.

5 measured from the nearest street property line to the nearest

? ing shall be permitted; only new or unused merchandise may be
8 stored outside.

27 SECTION 2. Ordinance No. 1991 Section Eleven Subsection
28 11.1 is hereby amended to read as follows:
29 "11.1. USES PERMITTED - No building or structure or land
30 shall be used and no building or structure shall be hereafter
31 erected, structurally altered, enlarged or maintained except for
32 the following uses:

1 A. Uses permitted in the 'C-1' Neighborhood Commercial
2 District.
3 B. RETAIL STORES:
4 1. Antique store.
5 2. Art shop.
6 3. Automobile sales agency, with incidental service and
7 repairs.
8 4. Bakeries (not more than 10 employees).

10 6. Clothing store.
11 7, Cocktail lounge, tavern, bar or similar use.
12 8. Department store.
13 g, Drive-In restaurants (subject to conditional develop-
14 ment permit).

2 D. SERVICES:
3 1. Banks and financial institutions.
4 2. Catering establishments.
5 3. Automobile service stations, including locations where
6 gasoline dispensing pumps are installed for the sale of
7 motor fuels in combination with some other type of retail
8 service (subject to conditional :development .permit).
9 Service station pump islands shall not be closer than
10 fourteen (14) feet from the street property line which dis-
11 tance shall be measured from the nearest street property
12 line to the nearest edge of the pump island. No major
13 repairs, metal work or painting shall be permitted; only
14 new or unused merchandise may be stored outside.
15 4. Dry cleaning and pressing establishments and laundries,
16 provided each machine has a rated capacity of not more than
17 sixty (60) pounds. j
18 5. Medical or dental laboratories.
19 6. Movie theaters, subject to a conditional development
20 permit.
21 7. Music conservatories.
22 8. Open uses such as: agriculture (field crops, truck
23 gardening, berry or bush crops, flower fields, apiaries)
24 when not being used for commercial purposes.
25 9. Public garages.
26 E. COMBINATION USES: See Section 9.2.
27 F. Such other uses as the Commission determines to be

29 SECTION 3. Ordinance No. 1991 Section Twelve Subsection
30 12.1 is hereby amended to read as follows:
31 "12.1. USES PERMITTED - No building or structure or land
32 shall be used and no building or structure shall be hereafter

1 erected, structurally altered, enlarged or maintained except for
2 the following uses:
3 A. Uses permitted in the 'C-2' District.
4 B. RETAIL STORES:
5 1. Automobile sales, new and used cars including servicing
6 and repairs conducted entirely within a building.
7 2. Commercial greenhouses (retail only).
8 3. Secondhand goods sold in an enclosed building (no junk
9 yards), subject to a conditional development permit.
10 4. Used car and trailer sales lots (service and repair
11 facilities conducted entirely within a building).
12 C. SERVICES:
13 1. Animal hospitals, subject to conditional development
14 permit.
15 2. Auction houses or stores, subject to conditional develo -
16 ment permit.
17 3. Baths, Turkish and the like.
18 4. Blueprinting and photocopying.
lg 5. Bowling alleys.
20 6. Boxing arenas, subject to conditional development permi .
21 7. Dance halls, subject to conditional development permit.
22 8. Drive-In theaters, subject to conditional development
23 permit.
24 9. Employment agencies.
25 10. Ice and roller skating, subject to conditional develop-
26 ment permit.
27 11. Automobile wash, subject to conditional development pe
28 12. Mortuaries and funeral parlors, subject to conditional
29 development permit.
30 13. Motels and motor hotels, subject to a conditional de-
31 velopment permit.
32 14. Natatoriums.

15. Pool halls, subject to a conditional development permit.
2 16. Repair garages, including automobile and truck repair
3 and painting or upholstering (conducted wholly within a
4 building).
5 17. Trade schools (if not objectionable due to noise,
6 lights, odor, vibration or dust).
7 18. Trailer camp, subject to a conditional development permi .
8 19. Upholstery shop.
9i 20. Wedding chapels.
l0 21. Tire retreading and recapping, subject to the following

11 restrictions:
12 Said operation to be completely enclosed in a building
13 of commercial appearance; space devoted to tire retreading
14 and recapping not to exceed 25~ of total first floor area,
15 and new and used tire storage area not to be a part of the
16 retreading and recapping area; tire buffer room to contain
17 motors, blowers and buffer equipment with waste container
18 for buffed or waste rubber to be outside the buffer room, ~
19 but within the enclosed building, and the buffer room to be
20 reasonably fire and sound proof.
21 22. Trampolines, subject to a conditional development permit

1 SECTION 4. Ordinance No. 1991 Section Sixteen Subsection ~

2 16.1 is hereby amended to read as follows:
3 "16.1 USES PERMITTED - No building or structure or land
4 shall be used and no building or structure shall hereafter be
5 erected, structurally altered, enlarged or maintained except for
6 the following purposes:
7 A. Automobile assembly, battery manufacturing, body and
8 fender works, painting, rebuilding, reconditioning, tire retread-
9 ing and recapping, truck repairing and overhauling, upholstering
10 and like uses.
11 B. Assembly of small electrical and mechanical appliances
12 and electronic instruments.
13; C. Automatic screw machines, blacksmith shops and machine
14~ shops, excluding punch presses over twenty (20) tons and drop
15 hammers.
16! D. Small boat building and repairs.
17 E. Contractors storage yards when conducted entirely
18 within a building or within an open space entirely enclosed with
19, a six (6) foot high chain link fence or six (6) foot high masonry
20 wall. The front wall or fence shall be set back not less than
21 six (6) feet from the front property line. The six (6) foot set
22 back area shall be landscaped and maintained.
23 F. braying and freight yards.
24~ G. Feed and fuel yards, subject to the same provisions
25 as required in paragraph E.
26 H. Laundries and dry cleaning plants, carpet and rug
27 cleaning plants and like uses.
28 I. Lumber yards, subject to the same provisions as required

30 J. Machinery rentals when conducted entirely within an
31~ enclosed yard as required by paragraph E.

32~~, K. Manufacturing, compounding, processing, packaging or

1 treatment of products such as: bakery goods, candy, cosmetics,
2 dairy products, drugs, food products (excluding sauerkraut,
3 vinegar, yeast and the rendering of fats and oils), perfumes and
4 toiletries.
5' L. Manufacturing, compounding, assembly or treatment of
6 articles or merchandise from the following previously prepared
7 materials: bone, cellophane, canvas, cloth, feathers, felt, fibre,
8 fur, glass, hair, horns, leather, paints not employing a boiling
9 process, paper, plastics, precious or semi-precious metals or
10 stones, shells, textiles, tobacco, wood and yarns.
11 M. Manufacturing of figurines, pottery or similar ceramic
12 products using only previously pulverized clay in kilns fired by
13 electricity or gas.
14 N. Manufacture and maintenance of billboards and electrical
15 signs, commercial advertising structures, subject to compliance
16 with the provisions of Section 20.10. Light sheet metal products,
17 including heating and ventilating ducts and equipment, cornices,
18 eaves and the like.
19 O. Manufacture of novelties, metal and rubber stamps and
20 toys.
21 P. Movie studios.
22 Q, poultry or rabbit killing incidental to sale on the
23 premises.
24 R. Repair garages.
25 S. Retail lumber yards including incidental mill work.
26 T. Veterinarian animal hospital.
27 U. Wholesaling and warehousing.
28 V. Automobile service stations, including locations where
29 gasoline dispensing pumps are installed for the sale of motor
30 fuels in combination with some other type of retail service
31 (subject to conditional development permit). Service station
32 pump islands shall not be closer than fourteen (14) feet from

1 the street property line which distance shall be measured from
2 the nearest street property line to the nearest edge of the
3 pump island.
4 W. Electric distribution substations.
5 X. Such other uses which the Commission determines to be
6 similar in nature and does not produce obnoxious noise, odor,
7 dust, smoke, glare and other nuisances."
8 SECTION 5. Ordinance No. 1991 Section Sixteen and One-Half
9 Subsection 16.6 is hereby amended to read as follows:
10 "16.6. USES PERMITTED - The following uses shall be per-
11 mitted if conducted within a completely enclosed building and
12 within the limits of the standards of performance set forth in
13 this Section:
14 A. Administrative or executive offices of a business or
15 industrial establishment.
16 B. Assembly of:
17 1. Electrical appliances.
18 2. Electronic instruments or devices.
19 3. Precision instruments.
20 4. Radios, phonograph or television sets, including the
21 manufacturing of component parts.
22 C. Blueprinting and photocopying.
23 D. Engineering and surveying offices.
24 E. Manufacturing, compounding, assembly, processing,
25 packaging, or treatment of the following products: candy, cosmetic ,
26 drugs, perfumes, pharmaceuticals, toiletries and bakery goods. ~

E. Manufacturing, compounding, assembly, packaging, or
28 treatment of articles or merchandise from the following previously
29 prepared materials: canvas, cellophane, cloth, cork, feathers, felt,
30 fibre, fur, hair, leather, paper, plastics or synthetics, precious
31 or semi-precious metals or stones (excluding the grinding, cutting
32 or dressing of stones, marble or granite), textiles, wood (excluding

1 lumber yards and planing mills) and yarns.
2 G. Parcel delivery terminals.
3 H. Publishing and printing.
¢ I. Research offices and laboratories for the conduct of
5 scientific research and theoretical studies and investigations,
5 including the fabrication and testing of prototypes and the per-
? formance of environmental tests, and related activities, by or
g{ under the supervision of professional scientists and highly
g trained specialists in the fields of physical, economic or social
10~ research.
II 111 J. Storage building incidental to a permitted use.
~I 12{ K. Restaurant, cafe or cafeteria operated in conjunction
I ~
13 with and incidental to a permitted use for the convenience of
14 Persons employed upon the premises.
15 L. Manufacture, assembly, fabrication, warehousing, and
16 wholesale distribution of goods, wares, merchandise, articles or
17 substances; provided that goads, wares, merchandise, articles
lg or substances which are combustible, inflammable, explosive, or
lg likely to create fire, radiation, or explosive hazards to sur-
20 rounding property may be stored and used in reasonable quantities
21 as an incident to any permitted use only if such storage and use
22 are permitted in the certificate of occupancy.
23 M. Electrical Distribution Sub-station (need not be within
24 a completely enclosed building).
25 N. Such other uses which the Planning Commission determines
26 to be similar in nature and which do not produce obnoxious noise,
27 vibration, odor, dust, smoke, glare or other nuisances. ~
28 O. The following uses may be permitted with a Ebnditional
29 development ~rmit:
30 1. Industrial hospital.
31 2. Restaurant or cafeteria (excluding drive-ins).
32 3. Heliport.

~ 1 4. Hotel.
2 5. Motel.
3 6. Public or private recreation center.
4 7. Radio and television studio.
5 8. Automobile service stations, including locations where
6 gasoline dispensing pumps are installed for the sale of
7 motor fuels in comb.ipation with some other type of retail
8 service (subject to oonditional development permit). Ser-
9 vice station pump islands shall not be closer than fourteen
10 (14) feet from the street property line which distance

13 SECTION 6. Ordinance No. 1991 Section Seventeen Subsection
14 17.1 is hereby amended to read as follows:
15 "17.1 USES PERMITTED - No building, structure, or land
16 shall be used and no building or structure shall hereafter be
17 erected, structurally altered, enlarged or maintained except for
18 the following purposes:

19 A. All industrial uses not expressly prohibited by law,
20 or by reason of emission of noxious or offensive gasses or odors,
21 dust, smoke, soot, noise, vibration or light.
22 B. Junk yards and like uses. (Subject to conditional
23 development "permit).
24 C. Automobile service stations, including locations where
25 gasoline dispensing pumps are installed for the sale of motor
26 fuels in combination with some other type of retail service (sub-
27 ject to conditional development permit). Service station pump ~

28 islands shall not be closer than fourteen (14) feet from the
29 street property line which distance shall be measured from the
30 nearest street property line to the nearest edge of the pump
31 island."
