2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDI-
NANCE NO. 821; AND MODIFYING THE APPREHENSION, POUND AND SALE
3 FEES RELATING TO DOGS.
4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION 1. Ordinance No. 821 Section 523 is hereby
6
amended to read as follows:

"SECTION 523: The Animal Control Officer shall have the
8
right to seize any dog or animal within the City of San Bernardino

having or suspected to have rabies or hydrophobia and in the event
10
he shall determine that such dog or animal is afflicted with
11
rabies or hydrophobia, the dog or animal shall be forthwith killed
12
by said Officer; provided that if such dog or animal shall be
13
suspected of having rabies or hydrophobia, it may be confined
14
by sai3 Officer for such time as is necessary, and if said Officer
15
shall then determine that said dog or animal does not have rabies
16
or hydrophobia, it shall be returned to the owner upon payment by
17
the owner of the sum of two dollars ($2.00) per day for each day
18 that the dog or animal shall be confined."
i 19 SECTION 2. Ordinance No. 821 Section 530 is hereby
20
amended to read as follows:

"SECTION 530: Any dog found running at large or running
22
loose and unrestrained in the City of San Bernardino shall be
~ 23 impounded by the Animal Control Officer for a period of seventy-two
24
(72) hours. The first time the dog is impounded the reclaiming
25 fee shall be five dollars ($5.00) plus two dollars ($2.00) per
26 day pound fee; the second or any subsequent time the same dog is
27
impounded the reclaiming fee shall be ten dollars ($10.00) plus
28
two dollars ($2.00) per day pound fee. In the event the owner of
29 or the person possessing said dog shall not on or before the
30 expiration of said period of seventy-two (72) hours call for and
31 claim said dog, paying any sum then due or owing, said dog shall
32 be disposed of by said Officer."

1+ SECTION 3. Ordinance No. 821 Section 531 is hereby ,
2, amended to read as follows:
3~ "SECTION 531: The Animal Control Officer shall have the
4 right to receive and dispose of dogs delivered into his possession
5 by the owners thereof and shall charge therefor the sum of four
6 dollars ($4.00) for each such dog and the sum of one dollar
7 {$1.00) for each puppy under the age of three (3) months. Said
8 Officer may sell any dog or puppy so placed in his possession
9 for a sum not to exceed five dollars ($5.00); provided that said
10 sum shall be ten dollars ($10.00) when the dog or puppy is sold
11 for research purposes."
12 SECTION 4. This ordinance is an emergency and urgency
13 measure necessary for the immediate preservation of the public
14 health, safety and welfare and shall go into effect immediately
15 upon its adoption and approval. The facts constituting such
16 emergency are:
17 The fees currently being charged by the City for appre-
18 hending, impounding, confining and disposing of dogs are insuffi-
19 cient to defray the City's costs involved and such costs are
20 steadily increasing. Therefore, it is imperative that the fee
21 increases take effect at once.
22 I HEREBY CERTIFY that the foregoing ordinance was duly
23 adopted by the Mayor and Common Council of the City of San Ber-
24 nardino at a ~G~ meeting thereof, held on
25 the day of ° 1970 by the following vote,
