HomeMy WebLinkAbout3080 i it 1 ' ORDINANCE N0, ~ ~ 2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN $ERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0, 247 (LAFC 873). 3 4 WHEREAS, heretofore, proceedings were initiated by the Common Council 5I of the City of San Bernardino, on its own motion, to annex to the City of Saa 6 Bernardino certain contiguous uninhabited territory hereinafter described; and 7i WHEREAS, on the 4th day of May, 1970, a resolution was adopted by 8i the aforesaid Common Council of the City of San Bernardino, California, 9i declaring that proceedings had been initiated by said Council, and proposing 10 the annexation, for the reasons therein stated, of the aforementioned 11 uninhabited territory to the City of San Bernardino, and that said resolution 12 provided that the proposed annexation should be generally known and identified 13 as Annexation District No. 247; and 14~ WHEREAS, said resolution set forth therein that all the property ~' 15 included in the aforesaid territory should be taxed equally with the other I 16 property within the City to pay the bonded indebtedness and any and all general ' 17 indebtedness and liability of the City of San Bernardino contracted prior to or 18 existing or outstanding at the time of the aforesaid proposed annexation of the 19 aforesaid property as provided in the hereinbefore mentioned Government Code; 20 ~ and 21 WHEREAS, said resolution did fix, determine and declare that a hearing 22 be held on the 15th day of June, 1970, at the hour of 9:30 o'clock A, M„ of 23 said day, itt the Council Chambers located in the Garner Building, 392 Court 2¢~ Street, San Bernardino, California, and the same was the day, hour and place 25 designated where any person owning real estate within such territory so 26I proposed to be annexed, and having any objections to the proposed annexation, 27 might object before the Common Council and show cause why such territory should 2$j not be annexed; furthermore, the said resolution provided that at any time not 2g; later than the said hour set, as mentioned hereinbefore for the said hearing, I 30; any owner of property within the said territory proposed to be annexed might 31~', file written protest with the City of San Bernardino against such annexation; 32I~'~ and i -1' ~ I I ~, WHEREAS, no written protest of any kind or nature whatsoever was 2 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock 3 A, M., on the 15th day of June, 1970, and thereafter, on the 15th day of June, ¢ 1970, Resolution No. / ~ 3 ~ ~ was adopted by the Mayor and Coomlon Council 5' declaring that a majority protest has not been presented; and g WHEREAS, it appears to the Common Counc$1 of the City of San ry Bernardino that the aforesaid annexation proceedings have been completed and g everything performed at this time in accordance with said Government Code, as g~ mentioned hereinbefore, and any and all other laws in any way connected with 10 the said annexation procedure having been complied with; and ll~ WHEREAS, the Common Council of the City of San Bernardino desires to 121 approve at this time the annexation of the aforesaid territory. 13 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 1¢ BERNARDINO DO ORDAIN AS FOLLOWS: 15 SECTION ONE: That said territory herein described as Annexation 16 District No, 247 is hereby annexed and incorporated in and made a part of the 17 City of San Bernardino. 18 SECTION TWO: The territory herein referred to as being annexed to 19' the City of San Bernardino is particularly described as follows, to wit: I 20 Those portions of Blocks 64, 68, 69, 74, 75, 81 and 86 Irvington Land and Water Company's Subdivision, as per plat thereof 21 recorded in Book 1, page 32, Records of Survey on file in the office of the County Recorder of San Bernardino County, State 22 of California, and that portion of Section 1, Township 1 North, Range 5 West, San Bernardino Meridian which includes Blocks 59, 23 63 and 67 as delineated on said map of Irvington Land and Water Company's Subdivision, and those portions of adjoining ~ 24 streets, described as follows: 25 Beginning at a point on the Present Corporate Limits of the City of San Bernardino, said point being the intersection of 26 the center lines of Palm Avenue, 60.00 feet wide and Belmont Avenue 60.00 feet wide; thence Northwesterly along said City 27i Limit Line and the center line of said Belmont Avenue a distance of 4910.00 feet, more or less to the most Westerly terminus 28 of the center line of said Belmont Avenue, said point also being on the South line of Lot "H" of the Meyer and Barclay 29i~ Resubdivision as per plat thereof recorded in Book 12 of Maps, ~ page 18, records of said County; thence leaving said City Limit 30 Line Easterly along the South line of said Lot "H" a distance of 335.00 feet, more or less, to the West line of said Block 81 3111 of said Irvington Land and Water Company Subdivision; thence Northerly along tiae West line of said Irvington Land and Water 32',i Company Subdivision a distance of 1515.00 feet, more or less to the center line of Ohio Avenue, 60.00 feet wide; thence ~I it -2- I ~ i i I i 1 Southeasterly along the center line of said Ohio Avenue a distance of 1250.00 feet, more or less, to the center line 2 of Cypress Avenue, 60.00 feet wide; thence Northeasterly along the center line of said Cypress Avenue a distance of 3, 1025.00 feet, more or less, to a point on the North line of the Rancho Muscupiabe as per plat recorded in Book 7 of Maps, 4 page 23, records of said County; thence Southeasterly along said Rancho Muscupiabe line, a distance of 1765.00 feet, more 5 or less, to a point on the North line of Section 1, Township 1 North, Range 5 West, San Bernardino Meridian; thence East 6 along the North line of said Section 1, a distance of 2,740.00 feet, more or less to the Northeast corner of ' 7~ Government Lot 1 of said Section 1, and said Gity Limit Line; thence along said City Limit Line the following courses and 8 distances; thence Southwesterly along the West line of the ~ property cocrveyed to John P. Fauls Sr, by Deed recorded 9~ January 8, 1957 in Book 4126, page 84, Official Records of said County, a distance of 1,335.00 feet, more or less, to a 10 point on the Southerly line of said Government Lot 1, which point is 900.00 feet Southeasterly thereon from the Southwest 111 corner of said Government Lot 1; thence Northwesterly along said Southerly line of Government Lot 1, a distance of 70.00 12 feet, more or less to the centerline of said Palm Avenue; thence Southwesterly along said center line of said Palm 13 Avenue a distance of 2,570.00 feet, more or less to the point of beginning. Containing 294 acres, more or less. 14 15 $SGRION THREEa That the above described property will be subject to 16 taxation equally with the property within such municipal corporation to pay its 17 Proportion of the following bonded indebtedness of the City of San Bernardino, 18 which said bonded indebtedness was outstanding or theretofore authorized and is 19 outstanding at the time of said annexation, to wit: 20 A bonded indebtedness of $490,000.00, incurred for the acquisition 21 and construction of a public library, including additions to and enlargements 22 of the public library system of said City, the outstanding indebtedness thereon 23 being $265,000.00, bearing interest at the rates of 4-3/4%, 3-1/4% and 3-1/2% 24 per annum; 25 A bonded indebtedness of $1,116,000.00, incurred for the acquisition 26 and construction of additions to, relocations of and replacements of the fire 27 fighting system of said City, the outstanding indebtedness thereon being 28 $765,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2% 291 Per annum. 30 SECTION FOUR: The property herein annexed is declared to be a part 31i of Ward 5, and the boundaries of Ward 5 are hereby altered to include said 321~I annexed territory, with zoning classifications as shown on a map filed in the n _ 3_ I I I i i i i 1 office of the City Clerk titled, "Exhibit A", and described as follows: 2j R-1-7200 Single Family Residential District 3 Blocks 64, 68, 69, 74, 75, 81 and 86, Irvington Land and Water Company's Subdivision lying south 4 of the Muscupiabe Rancho Line. 5 R-1-10,800 Single Family Residential District 6 That portion Section 1, Township 1 North, Range 5 West, San Bernardino Meridian which includes I' Blocks 59, 63, and 67 as delineated on map of 7 Irvington Land and Water Company°s Subdivision 8'~i lying north of the Muscupiabe Rancho Line.
