ERS AND MATRONS PROVISIONS THERFAF RELATII3G TO NIGHT CLUBS.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5 DO ORDAIN AS FOLLOWSo
6 SECTION 1. That Ordinance No, 763 Section Forty Subsection
7 (g) is hereby amended to read as followso
8 ~~(g)
9 (1) Each person, firm, corporation or association
10 operating, conducting or carrying en any public dance hall, danc-
11 ing club, dine and dance club or night club, under the provisions
12 of this ordinance shall employ, at his or its own expense, a man
13 to be designated as a Special Officer, who shall be in attendance
14 at all times that dancing is allowed, permitted or conducted at
15 the establishment for which the license is issued, Said Special
16 Officer shall keep the peace at such dances and shall enforce .all
17 laws applicable thereto, and shall, upon request of the Chief of
I8 Police of the City of San Bernardino, make a written report to
19 the Chief of Police respecting any incident or disturbance at
20 said establishment, The employment of the Special Officer shall
21 be subject to the approval of the Chief of Police of said city,
22 who shall require the furnishing of the personPS name and address
23 his previous felony and misdemeanor convictions and any addition-
24 al relevant information.
25 (2) Every person, firm, corporation or association so
26 operating, conducting or carrying on any public dance club, danc=
27 ing club, dine and dance club or night club shall similarly em-
28 ploy a woman to be designated as a Matron. The person so desig-
29 nated shall be subject to the approval of the Chief of Police,
30 who shall require the furnishing of the persons name and address,
31 her previous felony and misdemeanor convictions, and any addi-
32 tional relevant information. It shall be the duty of said

1~ Matron to generally assist the Special Officer in the performance
2 of his duties, and to report to him any violations of laws that s
3 may observe, and any acts or conduct contrary to public health,
4 peace or morals,
5 (3) The approval of the Chief of Police of the employ-
6 went of a Special Officer and Matron is not an approval of his or
7 her qualifications to serve in such capacity and in no way implie
8 any assumption of liability on the part of the city of San Ber-
g nardino for his or her acts or failure to act. The sole purpose
10 fvdr requiring approval by the Chief of Police is to insure com-
11 pliance by the licensee with this ordinance,
12 (4) A Special Officer or Matron shall not be permitted
13 to wear an official police uniform, badge or insignia or any uni-
14 form, badge or insignia that may be mistaken for, or confounded
15 with, such official police uniform, badge or insignia, A Special
16 Officer who is not in officially approved uniform shall not posse
17 any type of badge, or other type of Special Officer identificatio
I8 except as issued or approved by the Chief of Police. A Special
19 Officer or Matron shall not carry or have in his possession a
20 firearm, wooden club, baton, black jack, slingshot, billy, sand-
21 club, sandbag, sawed off shotgun, metal knuckles, dirk, dagger,
22 or teargas weapon as defined in Penal Code Sections 12400 and 124
23 except when required by the Rules and Regulations of the Police
24 Department.
25 (5) In any case where the Chief of Police of said
26 City shall find that the preservation of public peace, health or
27 morals does not require the attendance of a Special Officer and
28 Matron in any public dancing hall, dancing club, dine and dance
29 club or night club, as the same is defined in this ordinance, he
30 is, in the exercise of his discretion, authorized to waive the
31 requirement for the attendance of a Special Officer and Matron;
32 provided that if, at any time after such a waiver has been made,
1 the Chief of Police determines that the public peace, health or
2 morals require the attendance of a Special Officer and Matron,
3 he shall so notify such licenssee of such establishment in writing
4 and thereafter a Special Officer and Matron shall be required to
5 be in attendance in accordance with the provisions of this ordi-
6 nance,
7 (6) The Chief of Police of said City may require, in
8 special instances when the law enforcement problems may be rea-
9 sonably anticipated, that the Special Officer and Matron be a
10 person with previous law enforcement experienced"

12 adopted by the Mayor and Common Council of the City of San Bernar-
