HomeMy WebLinkAbout3083 1 ORDINANCE NO., 3~ 2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDI- NANCE NO. 821; IMPOSING A PENALTY OF $3.75 FOR LATE PAYMENT OF 3 DOG LICENSE FEE; AND INCREASING THE SELLING PRICE OF DOGS FOR RESEARCH PURPOSES TO $15.00. 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 5 DO ORDAIN AS FOLLOWS: 6 SECTION 1. Ordinance No. 821 Section 519 is hereby 7 amended to read as follows: $ "SECTION 519: Each person, firm or corporation owning 9 or harboring a dog, either kept upon private property or other- 10 wise, within the City of San Bernardino, shall on or before the ],]. first day of July of each year, pay to said City in advance for 12 the fiscal year, a license fee of three and 75/100 dollars 13 ($3.75) for each dog, and in addition, the sum of twenty-five 14 cents (25¢) for a tag for each dog, and in the event any of said 15 fees and sums are not paid prior to the first day of September 16 of each year, then a penalty of three and 75/100 dollars ($3.75) 17 shall be added to each such license fee. A fee of fifty cents lg (50¢) shall be charged for any additional tag issued to replace ],g lost, stolen, misplaced or damaged tag. 20 Monies received during the current fiscal year for a 21 icense shall be first applied to the payment of delinquent fees, 22 ums and penalties due during the preceding fiscal year, and any 23 alance remaining thereafter shall be applied to the payment of 24 he current license fees, sums and penalties. A license issued 25 uring any prior fiscal year to the same owner for the same dog, 26 s shown in an application for a current license, shall be 27 prima facie evidence in any court or administrative proceeding 28 that the dog was continuously owned by the same owner from said 29 prior year to the current fiscal year." 30 SECTION 2. Ordinance No. 821 Section 531 is hereby 31 amended to read as follows: 32 "SECTION 531: The Animal Control Officer shall have the 11 right to receive and dispose of dogs delivered into his pos- t session by the owners thereof and shall charge therefor the sum 3 of four dollars ($4.00) for each such dog and the sum of one ¢ dollar ($1.00) for each puppy under the age of three (3) months. 5 Said Officer may sell any dog or puppy so placed in his possession 6 for a sum not to exceed five dollars ($5.00); provided that said 7 sum shall be fifteen dollars ($15.00) when the dog or puppy is g sold for research purposes." 9 SECTION 3. This ordinance is an emergency and urgency 10 measure necessary for the immediate preservation of the public 11 health, safety and welfare and shall go into effect immediately 12 upon its adoption and approval. The factscconstituting such 13 emergency are: 14 The fees currently being charged by the City for appre- 15 hending, impounding, confining and disposing of dogs are insuffi- 16 dent to defray the City's costs involved and such costs are 17 steadily increasing.
