HomeMy WebLinkAbout3085 i I 1 ORDINANCE N0,3~~-~ 2 AN ORDINANCE OF THE MAYOR APID COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0, 249 (LAFC 879). 3i 4~ WHEREAS, heretofore, proceedings were initiated by the Common Council 5'i of the City of San Bernardino, on its own motion, to annex to the City of San 61I Bernardino certain contiguous uninhabited territory hereinafter described; and 71~ WHEREAS, on the 11th day of May, 1970, a resolution was adopted by 8 the aforesaid Common Council of the City of San Bernardino, California, 9 declaring that proceedings had been initiated by said Council, and proposing l0l the annexation, for the reasons therein stated, of the aforementioned 111 uninhabited territory to the City of San Bernardino, and that said resolution 12 provided that the proposed annexation should be generally known and identified 13I as Annexation District No. 249; and 14~ WHEREAS, said resolution set forth therein that all the property 15 included in the aforesaid territory should be taxed equally with the other 16 property within the City to pay the bonded indebtedness and any and all general 17 indebtedness and liability of the City of San Bernardino contracted prior to or 18 existing or outstanding at the time of the aforesaid proposed annexation of the 19~ aforesaid property as provided in the hereinbefore mentioned Government Code; 20 and 21 WHEREAS, said resolution did fix, determine and declare that a hearing 22 be held on the 22nd day of June, 1970, at the hour of 9:30 o'clock A, M., of 23 said day, in the Council Chambers located in the Garner Building, 392 Court 24~ Street, San Bernardino, California, and the same was the day, hour and place 25 designated where any person owning real estate within such territory so 26 proposed to be annexed, and having any objections to the proposed annexation, 27 might object before the Common Council and show cause why such territory should 28 not be annexed; furthermore, the said resolution provided that at any time not 29~ later than the said hour set, as mentioned hereinbefore for the said hearing, i 30! any owner of property within the said territory proposed to be annexed might 31i file written protest with the City of San Bernardino against such annexation; 32 and 1- i it li I~ I i 11 WHEREAS, no written protest of any kind or nature whatsoever was 2 filed with the City Clerk of the City of San Bernardino prior to 9:30 o°clock 3 A, M„ on the 22nd day of June, 1970, and thereafter, on the 22nd day of June, 4 1970, Resolution No. / D > ~ ~ was adopted by the Mayor and Common Council 5 declaring that a majority protest has not been presented; and 6 WHEREAS, it appears to the Common Council of the City of San 7 Bernardino that the aforesaid annexation proceedings have been completed and 8 everything performed at this time in accordance with said Government Code, as 9 mentioned hereinbefore, and any and all other laws in any way connected with 10 the said annexation procedure having been complied with; and ~ 11 WHEREAS, the Common Council of the City of San Bernardino desires to 12 approve at this time the annexation of the aforesaid territory. 13 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 14 BERNARDINO DO ORDAIN AS FOLLOWS: 15 SECTION ONE: That said territory herein described as Annexation i 16 District No. 249 is hereby annexed and incorporated in and made apart of the 17 City of San Bernardino. 18 SECTION TWO: The territory herein referred to as being annexed to 19 the City of San Bernardino is particularly described as follows, to wit: 20i That portion of Block A of the Cooley Tract as per plat thereof recorded in Book S of Maps, page 62, records of the County 21 Recorder of San Bernardino County, State of California and those portions of the adjoining streets, described as follows: 22 Beginning at a point on the Present Corporate Limits of the 23 City of San Bernardino, said point being the intersection of the center line of Fourth Street and the center line of Waterman 24 Avenue; thence North along the center line of said Waterman Avenue and said City Limit Line a distance of 341.25 feet to 25 the center line of Monterey Street; thence East along said City Limit Line, the center line of said Monterey Street and leaving 26 said City Limit Line a distance of 441.25 feet to the Northerly prolongation of the East line of Lot 11 of said Block A; thence 27 South along said Northerly prolongation, the East Line of Lots 11 and 34 and the Southerly prolongation thereof a distance of 28 341.25 feet to the center line of said Fourth Street; thence West along the center line of said Fourth Street a distance of 29 441.25 feet to the point of beginning. Containing 3.46 acres, j more or less. 30i SECTION THREE: That the above described property will be subject to 31~ taxation equally with the property within such municipal corporation to pay its 02~ proportion of the following bonded indebtedness of the City of San Bernardino, !I I -2- I i l 1 which said bonded indebtedness was outstanding or theretofore authorized and is '~ 2 outstanding at the time of said annexation, to wit: 3 A bonded indebtedness of $490,000.00, incurred for the acquisition 4 and construction of a public library, including additions to and enlargements I i 5 of the public library system of said City, the outstanding indebtedness thereon 6ibeing $265,000.00, bearing interest at the rates of 4-3/4%, 3-1/4% and 3-1/2% 7 per annum; 8 A bonded indebtedness of $1,116,000.00, incurred for the acquisition 9 and construction of additions to, relocations of and replacements of the fire 10 fighting system of said City, the outstanding indebtedness thereon being 11 $765,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2% 12 per annum. 13 SECTION FOUR: The property herein annexed is declared to be apart 14~,of Ward 1, and the boundaries of Ward 1 are hereby altered to include said I 15~annexed territory, with zoning classification as follows: i, 16I C-M Commercial-Manufacturing zoning District. 17 I HEREBY CERTIFY that the foregoing ordinance was duly adopted by 18the Mayor and Coon Council of the City of San Bernardino at an adjourned 19regular meeting thereof, held on the 29th day of June, 1970, by the following 20lvote, to wit: 21 AYES: Councilmen s ii•i~y,,~/~y `~~~®~/,B~ sy. , ''~JJ i , 23 NOES: ,! /~ 24 ABSENT: ~i~-r.1~>.~~/„,~s» ,~J,~,~-, mss ,W 25 26 Cit Clerk 27 i 28~ The foregoing ordinance is hereby approved this day of June, 1970.
