HomeMy WebLinkAbout3090 II I~ 1~ ORDINANCE N0 2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0, 248 (LAFC 877). 3i I 4 WHEREAS, heretofore, proceedings were initiated by the Common Council I 5~I of the City of San Bernardino, on its own motion, to annex to the City of San 6 Bernardino certain contiguous uninhabited territory hereinafter described; and 7' WHEREAS, on the 4th day of May, 1970, a resolution was adopted by the 8~ aforesaid Common Council of the City of San Bernardino, California, declaring I gel that proceedings had been initiated by said Council, and proposing the l0 annexation, for the reasons therein stated, of the aforementioned uninhabited 11~ territory to the City of San Bernardino, and that said resolution provided that 12 I the proposed annexation should be generally known and identified as Annexation 13~ District No. 248; and 14~ WHEREAS, said resolution set forth therein that all the property 151 included in the aforesaid territory should be taxed equally with the other i 16 property within the City to pay the bonded indebtedness and any and all general 17 indebtedness and liability of the City of San Bernardino contracted prior to or 18 I existing or outstanding at the time of the aforesaid proposed annexation of the ' lg~ aforesaid property as provided in the hereinbefore mentioned Government Code; 201 and 21 WHEREAS, said resolution did fix, determine and declare that a hearing 22 be held on the 15th day of June, 1970, at the hour of 9:30 o'clock A,M„ of said 23 day, in the Council Chambers located in the Garner Building, 392 Court Street, 24; San Bernardino, California, and the same was the day, hour and place designated ' 25 where any person owning real estate within such territory so proposed to be i 26 annexed, and having any objections to the proposed annexation, might object ~ I 27 before the Common Council and show cause why such territory should not be 28~ annexed; furthermore, the said resolution provided that at any time not later i 29 than the said hour set, as mentioned hereinbefore for the said hearing, any i 301 owner of property within the said territory proposed to be annexed might file 31i, written protest with the City of San Bernardino against such annexation; and it WHEREAS no written rotest of an kind or nature whatsoever was 32 " a P Y I -1- i I I ~ i 1 ~ filed with the Gity Clerk of the City of San Bernardino prior to 9:30 o'clock j 2 A,M., on the 15th day of June, 1970, and thereafter, on the 15th day of June, 3' 1970, Resolution No.~n~was adopted by the Mayor and Common Council declar- ~I 4 ing that a majority protest has not been presented; and 5 WHEREAS, it appears to the Common Council of the City of San Bernardino 6 that the aforesaid annexation proceedings have been completed and everything 7i performed at this time in accordance with said Government Code, as mentioned 8 hereinbefore, and any and all other laws in any way connected with the said 9 annexation procedure having been complied with; and 10 WHEREAS, the Common Council of the City of San Bernardino desires to 11 approve at this time the annexation of the aforesaid territory. 12 NOW, THEREE'ORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 13~ BEgNARDINO DO ORDAIN AS FOLLOWS: 14 SECTION ONE: That said territory herein described as Annexation I 15 District No. 248 is hereby annexed and incorporated in and made a part of the 16i City of San Bernardino. i 171 SECTION TWO: The territory herein referred to as being annexed to ~ I lsi the City of San Bernardino is particularly described as follows, to wit: 19 Those portions of Lots 48 thru 54, Tract 2505 as per plat thereof 20 recorded in Book 36 of Maps, page 1, Lots 1 thru 8, Tract 2221 as per plat thereof recorded in Book 31 of Maps, page 88, Lots 21 1 thru 11, Tract 2980 as per plat thereof recorded in Book 41 of Maps, page 50, all records of the County Recorder of San Bernardino County, State of California and those portions of the 22I adjoining streets, described as follows: 23 Beginning at a point on the present Corporate Limits of the City of San Bernardino, said point being the intersection of the 24 center line of Central Avenue and the center line of Valley View Avenue; thence North along the center line of said Valley View 25 Avenue and said City Limit Line a distance of 1140.00 feet, more or less, to the Easterly prolongation of the South line of Lot 26 52, of said Tract 2505; thence West along said Easterly prolonga- tion and the South line of said Lots 48 thru 52 inclusive, of said ' 27i Tract 2505 and along said City Limit Line a distance of 525.00 ~ feet more or less, to the Southwest Corner of said Lot 48; thence 28I leaving said City Limit Line, North along the West line of said Lot 48 and the Northerly prolongation thereof a distance of 29i 331.80 feet more or less to the center line of Santa Fe Street; thence East along the center line of said Santa Fe Street a 30 distance of 750.00 feet more or less, to the Northerly prolonga- ~ tion of the East line of Lot 54 of said Tract 2505; thence South 311 along said Northerly prolongation and the East line of said Lot 54 a distance of 331.60 feet more or less, to the Southeast Corner 32~,~ of said Lot 54 and being on the North line of Lot 1, of said Tract No. 2221; thence Bast along the North line of said Lot 1 ~ I _2- I ii ~ i I ], a distance of 19.35 feet, more or less to the Northeast Corner of said Lot 1; thence Southerly along the East line of Lots 1 2i thru 7 inclusive of said Tract 2221 and the Southerly prolongation thereof a distance of 1140.00 feet more or less, to the center 3' line of said Central Avenue; thence East along the center line of said Central Avenue a distance of 3.00 feet more or less, to 4 the Northerly prolongation of the East line of Lot 1 of said Tract 2980; thence South along the Northerly prolongation of the 5 East line of said Lot 1 and the East line of Lots 1 and 4 thru 11 of said Tract 2980 a distance of 1135.14 feet more or less, 6 to the Southeast Corner of said Lot 11; thence West along the South line of said Lot 11 and the Westerly prolongation thereof 7 a distance of 419.16 feet more or less, to the center line of said Valley View Avenue and said City Limit Line; thence North 8i along the center line of said Valley View Avenue and said City Limit Line a distance of 1134.00 feet more or less, to 9i the center line of said Central Avenue; thence East along the ~ center line of said Central Avenue and said City Limit Line a 10 distance of 128.00 feet, more or less, to the point of beginning. Containing 24 acres, more or less. llj SECTION THREE: That the above described property will be subject to 12 taxation equally with the property within such municipal corporation to pay its 13 proportion of the following bonded indebtedness of the Gity of San Bernardino, 14~, ~ which said bonded indebtedness was outstanding or theretofore authorized and is 15 outstanding at the time of said annexation, to wit: l6 A bonded indebtedness of $490,000.00, incurred for the acquisition 17 and construction of a public library, including additions to and enlargements 18~ of the public library system of said City, the outstanding indebtedness thereon 19 being $265,000.00, bearing interest at the rates of 4-3/4%, 3-1/4% and 3-1/2% 20 ~ per annum; 21~ A bonded indebtedness of $1,116,000.00, incurred for the acquisition 22 and construction of additions to, relocations of and replacements of the fire 23 fighting system of said City, the outstanding indebtedness thereon being 24. ' $765,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2% 25 per annum. 26 SECTION FOUR: The property herein annexed is declared to be a part 27 of Ward 1, and the boundaries of Ward 1 are hereby altered .to include said 2g annexed territory, with zoning classifications as shown on a map filed in the 29'i office of the City Clerk titled, "Exhibit A", and described as follows: 30~ C_M Commercial - Manufacturing District 31~ Lots 48, 49, 50, 51, 52, 53, 54, Tract No. 2505 Gifford 32~.
