SECTION 1, This Ordinance shall be known as the "UNIFORM
11
PLUMBING ORDINANCE,"
12
SECTION 2, Those certain rules and regulations which pro-
13
vide for and govern the installation, alteration and repair of
14
plumbing, gas and drainage systems and the inspections thereof,
15
the licensing of persons engaged in the installation of plumbing,
16
gas and drainage systems in the City of San Bernardino, the cre-
17
ation of a Board of Appeals and prescribing its duties and the

duties of the plumbing inspector; and penalties for violations
19
thereof, as set forth in that certain code printed in book form,
20
and entitled "Uniform Plumbing Code, 1970 Edition", as prepared c
21
promulgated by the International Association of Plumbing and
22
Mechanical Officials, three (3) copies of which code have here-
23
tofore been filed with and now are on file in the office of the
24
City Clerk of the City of San Bernardino, and which copies are
25
identified by certificates attached hereto, reading substantiall
26
as followso
27
"I, LUCILLE GOFORTH, hereby certify that the annexed code
28
entitled 'Uniform Plumbing Code, 1970 Edition°, was filed in the
29
office of the City Clerk of the City of San Bernardino on the
30
2nd day of July, 1970, and is a true, correct and complete copy
31
of said code which is sought to be adopted by reference by
32
ordinance of the Mayor and Common Council of said City< LUCILLE
7- GOFORTH, City Clerk of the City of San Bernardino,"; be and the
2 same are hereby established as rules and regulations and a code
3 of said City; and each and every part of said code, and each and
4 every provision therein contained, including its Appendices A
5 through G, inclusive, and Tables, is hereby referred to and de-
b signated as the "Uniform Plumbing Code, 1970 Edition", and is
7 hereby adopted and made a part hereof as though fully set forth
$ at length in this ordinance.
9 SECTION 3, The following sections and provisions of the
10 Uniform Plumbing Code, 1970 Edition, are hereby amended to read
11 as followso
12 Section 1.1. ADMINISTRATIVE AUTHORITY AND ASSISTANTS.
13 Whenever the term "administrative authority" is used in this
14 code it shall be construed to mean the Chief Plumbing Inspector
15 or his authorized aepresentative.
16 Section 1.2, ASSISTANTS. Whenever the term "assistants"
17 is used in this code it shall be construed to mean the Plumbing
18 Inspectors. All assistants shall have had at least two (2) years
19 as a Journeyman Plumber.
20 Section 1,3. DEPARTMENT HAVING JURISDICTION. Unless other-
21 wise provided for by law, the Office of the Administrative Auth-
22 ority shall be part of the Department of Building and Safety,
23 Section 1.7. VIOLATIONS AND PENALTIES, Any person, firm
24 or corporation violating or causing or permitting the violation
25 of any of the provisions of this code or ordinance shall be
26 deemed guilty of a misdemeanor and upon conviction thereof shall
27 be punishable by a fine of not to exceed Five Hundred Dollars
28 ($500,00) or by imprisonment in the County Jail for not to ex-
29 ceed six (6) months, or by both such fine and imprisonment. Each
30 separate day or any portion thereof during which any violation
31 of this code or ordinance occurs or continues shall be deemed
'~ 32 to constitute a separate offense, and upon conviction thereof

1 shall be punishable as herein provided,
2 The issuance or granting of a permit or approval of plans
3 and specifications shall not be deemed or construed to be a
4 permit for, or an approval of, any violation of any of the pro-
s visions of this code. No permit presuming to give authority to
3 6 violate or cancel the provisions of this code shall be valid,
7 except insofar as the work or use which it authorizes is lawful.
8 The issuance or granting of a permit or approval of plans
9 shall not prevent the Administrative Authority from thereafter
10 requiring the correction of errors in said plans and specifica-
11 tions or from preventing construction operations being carried
12 on thereunder when in violation of this code or of any other
13 ordinance or from revoking any Certificate or Approval when issu
14 ed in error.
15 fiery permit issued by the Administrative Authority under
16 the provisions of this code shall expire by limitation and be-
17 come null and void, if the work authorized by such permit is
18 not commenced within sixty (60) days from the date of issuance o
19 such permit, or if the work authorized by such permit is suspend
20 ed or abandoned at any time after the work is commenced for a
21 period of sixty (60) days, Before such work can be recommenced
22 a new permit shall be first obtained so to do.
23 When work for such a plumbing permit is required by this
24 ordinance is started or proceeded with prior to obtaining said
25 permit, the fees specified in the Uniform Plumbing Code shall
26 be doubled, but the payment of such double fee shall not relieve
27 any person from fully complying with the requirements of this
28 code in the execution of the work nor from any other penalties
29 prescribed herein.
30 Section 1.12, COST OF PERMIT. Eery applicant for a per-
31 mit to install, add to, alter, relocate or replace a plumbing
32 or drainage system or part thereof, shall state in writing on

1 the application form provided for that purpose, the character of
2 work proposed to be done and the amount and kind in connection
3 therewith, together with such information pertinent thereto as
4 may be required,
5 Such applicant shall pay for each permit issued at the time
6 of issuance, a fee in accordance with the following schedule,
7 and at the rate provided for each classification shown therein.
8 Any person who shall commence any plumbing work for which
9 a permit is required by this code without first having obtained
10 a permit therefor &hal~,if subsequently permitted to obtain a
11 permit, pay double the permit fee fixed by this section for such
12 work, provided, however, that this provision shall not apply to
13 emergency work when it shall be proved to the satisfaction of
14 the Administrative Authority that such work was urgently nec-
15 essary and that it was not practical to ebtain a permit therefor
16 before the commencement of the work. In all such cases a permit
17 must be obtained as soon as it is practical to do so, and if the e
I8 be an unreasonable delay in obtaining such permit, a double fee
19 as herein provided shall be charged,
20 For the purpose of this section a sanitary plumbing outlet
21 on or to which a plumbing fixture or applicane,=~ay be set or
22 attached shall be construed to be a fixture. Fees for reconnec-
23 tion and retest o~ existing plumbing systems in relocated build-
24 ings shall be based on the number of plumbing fixtures, gas
25 systems, water heaters, etc., involved.
26 When interceptor traps or house trailer site traps are
27 installed at the same time as a building sewer on any lot, no
28 sewer permit shall be required for the connection of any such
29 trap to an appropriate inlet fitting provided in the building
30 sewer by the permittee constructing such sewer.
31 When a permit has been obtained to connect an existing
32 building or existing work to the public sewer or to connect to

1 a new private disposal facility, backfilling of private sewage
2 disposal facilities abandoned consequent to such connection is
3 included in the building sewer permit,

30 Section 409(a). Every house or building which shall here-
31 after be connected to a public sewer shall be protected from
32 back-flow of sewage whenever the finished floor of such house or

building is at a lower elevation than the top of the first man-
1 hole upstream from point of connection with the public sewer.
2 Protection shall be accomplished by installing a back-flow pre-

3 venter acceptable to the Administrative Authority.
4 Section 702(c). Each waste outlet for a plumbing fitting
5 that requires roughing in above floor shall be immediately in the
6 rear of the fixture trap and no concealed change of direction or
7 offset shall be installed between any such fixture trap and its
$ vent. Any exposed fitting installed between a trap and its vent
9 shall be so located as to be readily removable for cleaning pur-
e 10 poses.
11 Section 7040 TRAPS PROHIBITED. No form of trap which
12 depends for its seal upon the action of :movable parts or concea -
13 ed interior partitions shall be used, Full "S" traps are pro-
14 hibited. Bell traps are prohibited, Crown-vented traps are pro-
, 15 hibited. No fixture shall be double trapped, Drum traps with-
16 out vents may be installed only when permitted by the Adminis-
17 trative Authority for special conditions.
18 Section 907(e). SETTING. Fixtures shall be set level and
~ 19 in proper alignment with reference to adjacent walls, No water
20 closet shall be set Moser than fifteen inches (15") from its
21 center to any vertical surface, No urinal shall be set closer
' 22 than twelve (12") inches from its center to any side wall or
23 art it ion or closer than twent four inches 24"

25 SECTION 4, Said Uniform Plumbing Code is hereby amended
26 by deleting therefrom the following sections, sub-sections and
27
provisions;

1 SECTION 5. Said Uniform Plumbing Code is hereby amended by
2 adding thereto the sections and sub-sections hereinafter set
3 forth to read as follows:
4 Section 1.15. LIABILITY OF CITY OFFICIAL OR EMPLOYEE.
5 This ordinance and said Uniform Plumbing Code shall not be con-
6 strued to impose upon the City of San Bernardino or its employee
7 or agents any liability or responsibility for damages caused by
8 defective plumbing or drainage systems or the installation there
9 of, and the City of San Bernardino and its officials, agents or
10 employees shall not be held as assuming any such liability or
11 responsibility by reason of any inspection required or authorize
12 thereunder.
13 Section 1.16. SUBSTANCES OR EQUIPMENT POLLUTING WATER. No
14 person shall advertise, sell or offer for use or sale, any water-
15 treating chemical or substance, water-using or water-treating
16 chemical or substance, water-using or water-operated equipment,
17 mechanism or contrivance, if the Health Officer finds that the
18 use of such chemical or substance, equipment, mechanism or con-
19 trivance may cause contamination or pollution of the domestic
20 water system. Such devices may be permitted when equipped with
21 back-flow protection meeting the requirements of the Uniform
22 Plumbing Code.
23 Section 1.17. Where work for which a permit is required by
24 this code is completed prior to the issuance of said permit, an
25 additinnal fee of ten (10) per cent of the cost of the project, o
26 the sum of $200.00, whichever is less, shall be paid, and it
27 shall be the duty of the Chief Plumbing Inspector to levy and
28 collect said additional fees. The payment of such fee shall not
29 relieve any persons or firms from fully complying with other
30 provisions of this code or from the payment 6f any other penaltie
31 or fees prescribed herein.
32 Section 207(d). An approved two-way clean-out fitting shall

1_ be installed at the lower end of every building drain and shall
2 be located two (2) feet outside the dwelling or building which
3 it serves. Such clean-out shall be extended to the finish grade
4 and made readily accessible.
5 Section 403(c). The minimum size of the building drain in-
6 stalled in any commercial construction shall be 4".
7 Section 410. HOUSE DRAINS SHALL CONNECT TO ONE OUTLET. In
8 a single family dwelling all plumbing drains shall connect to one
9 outlet. Such outlet shall not exceed ninety (90°) degrees from t
10 direction of flow of the closest public sewer or if there is no
11 public sewer then from the proposed public sewer. If more than
12 one stub-out is used, the contractor installing the plumbing shall
13 connect all such stub-outs to each other so that there shall be on
14 outlet. The materials used shall be as required elsewhere in
15 this code.
16 Section 1009(n). All horizontal water piping, including
17 lawn sprinkler systems, installed underground shall have not less
I8 than six inches (6") of earth cover,
19 Section 1103(c). The following are the only materials ap-
20 proved for the installation of sewers for buildings and structures
21 in the City of San Bernardinoo

27 Acrylonitrile-Butadine-Styrene (A.B.S.)
28 as approved by International Association
29 of Plumbing & Mechanical Officials.
30 SECTION 6. The word "City" in the aforesaid sections and
31 code shall be deemed to refer to and designate the City of San
32 Bernardino, and any reference to any act or legislative enactment

1 therein referred to shall be deemed to designate and embrace the
2 statutes of the State of California, and amendments thereof, deal
3 ing with the subject matter thereby and therein referred too
4 SECTION 7o REVOCATIONo The Mayor and Common Council of
5 the City of San Bernardino shall have the power, upon recommenda-
6 tion of the Plumbing Inspector, to suspend or revoke the business
7 license of any person, firm or corporation violating the terms
8 and provisions of said Plumbing Code, provided that such suspen-
9 sion or revocation shall not be ordered by said Mayor and Common
10 Council without first holding a public hearing thereon and with-
11 out giving reasonable notice of such hearing to the person, firm
12 or corporation so charged with said violationo
13 SECTION 8o If any section, sub-section, sentence, clause
14 or phrase of this Ordinance or said Code is for any reason held
15 to be invalid or unconstitutional by the decision of any court of
16 competent jurisdiction, such decision shall not affect the valid-
17 ity of the remaining portions of said Ordinance or coded The

19 declare that they would have passed said Ordinance and code, and
20 each section, sub-section, sentence, clause and phrase thereof,
21 irrespective of the fact that any one or more other sections,
22 sub-sections, clauses or phrases be declared invalid or unconsti-
23 tutionalo
24 SECTION 9a Ordinance No, 2923 is hereby repealed,
