2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARHINO APPROVING THE ANNEXATION OF DISTRICT N0, 251 (LAFC 878).

4 WHEREAS, heretofore, proceedings were initiated by the Common Council
5~ of the City of San Bernardino, on its own motion, to annex to the City of San
6 Bernardino certain contiguous uninhabited territory hereinafter described; and
7 WHEREAS, on the 29th day of June, 1970, a resolution was adopted
8 by the aforesaid Common Council of the City of San Bernardino, California,
9 declaring that proceedings had been initiated by said Council, and proposing
10 the annexation, for the reasons therein stated, of the aforementioned
lluninhabited territory to the City of San Bernardino, and that said resolution
12 provided that the proposed annexation should be generally known and identified
13
as Annexation District No. 251; and

14~ WHEREAS, said resolution set forth therein that all the property
15 included in the aforesaid territory should be taxed equally with the other
16 property within the City to pay the bonded indebtedness and any and all general
17 indebtedness and liability of the City of San Bernardino contracted prior to or
18 existing or outstanding at the time of the aforesaid proposed annexation of the
19 aforesaid property as provided in the hereinbefore mentioned Government Code;
20 ~ and
21 WHEREAS, said resolution did fix, determine and declaze that a hearing
22 be held on the 10th day of August, 1970, at the hour of 9e30 o`clock A,M„ of
23 said day, in the Council Chambers located in the Garner Building, 392 Court
24, Street, San Bernardino, California, and the same was the day, hour and p3ace
25 designated where any person owning real estate within such territory so
26 proposed to be annexed, and having any objections to the proposed annexation,
27 might object before the Common Council and show cause why such territory should
28 not be annexed; furthermore, the said resolution provided that at any time not
29 later than the said hour set, as mentioned hereinbefore for the said hearing,
30iany owner of property within the said territory proposed to be annexed might

311fi1e written protest with the City of San Bernardino against such annexation;

1 WHEREAS, there were four written protests filed with the City Clerk
2 of the City of San Bernardino prior to 9:30 o'clock A. M., on the 10th day of
3 August, 1970; and
¢ WHEREAS, on the 10th day of August, 1970, the date set for the hearing
5 of protests against the proposed annexation, Resolution No./ D373 was adopted
6 by the Common Council of the City of San Bernardino declaring that a majority
7 protest has not been presented; and
$ WHEREAS, it appears to the Common Council of the City of San
g Bernardino that the aforesaid annexation proceedings have been completed and
10 everything performed at this time in accordance with said Government Code, as
11 mentioned hereinbefore, and any and all other laws in any way connected with
12 the said annexation procedure having been complied with; and
13 WHEREAS, the Common Council of the City of San Bernardino desires to
14 approve at this time the annexation of the aforesaid territory.
15 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
16 BERNARDINO DO ORDAIN AS FOLIAWS:
17 SECTION ONE: That said territory herein described as Annexation
I8 District No. 251 is hereby annexed and incorporated in and made a part of the
19 City of San Bernardino.
20 SECTION TWO: The territory herein referred to as being annexed to
21 the City of San Bernardino is particularly described as follows, to wit:
22 That portion of Tract 7229 as per plat thereof recorded in
Book 98 of Maps, pages 28 and 29 records of the County Recorder
23 of San Bernardino County, State of California, and those portions
of the adjoining streets, described as follows:
2¢ Beginning at a point on the Present Corporate Limits of the
25 City of San Bernardino, said point being the intersection of
the center line of Piedmont Drive and the Northerly prolonga-
26 tion of the East line of Lot 5 of said Tract 7229; thence
North 20° 29' 06" East along said prolongation, and being the
2q East line of Lot "B" of said Tract 7229 and said City Limit
Line a distance of 33.00 feet to the beginning of a non tangent
2$ curve concave Southerly and having a radius of 533.00 feet, a
radial line of said curve at said point bears South 20° 29° 06"
2g West; thence Westerly along said curve through a central angle
of 0° 43' S4" and along said City Limit Line a distance of 6.81
30 feet; thence North 19° 45' 12" East along the East line of
Lot 6 of said Tract 7229 and said City Limit Line a distance
31 of 133.38 feet to the Northeast corner of said Lot 6; thence
leaving said City Limit Line Westerly along the North line of
32 Lots 6, 7, 8 and 9 of said Tract 7229 a distance of 295.89

1 feet to the Northwest corner of said Lot 9; thence Southerly
along the Westerly line of said Lot 9 and the Southerly pro-
2 longation thereof a distance of 143.76 feet, more or less to
the center line of said Piedmont Drive; thence Easterly along
3 the center line of said Piedmont Drive a distance of 5.00 feet,
more or less, to the center line of Bradford Avenue; thence
4 Southerly along the center line of said Bradford Avenue a
distance of 165.00 feet, more or less to the Westerly prolonga-
5 tion of the South line of Lot 2 of said Tract 7229; thence East
along said Westerly prolongation, the South line of Lots 2, 3,
6 4, and 5, of said Tract a distance of 374.00 feet, more or less
to the Southeast corner of said Lot 5, and said City Limit Line;
7 thence North along the East line of said Lot 5, the Northerly
prolongation thereof and said City Limit Line a distance of
$ 155.57 feet to the point of beginning. Containing 2.30 acres,
more or less.

SECTION THREE: That the above described property will be subject to

taxation equally with the property within such municipal corporation to pay its
11
proportion of the following bonded indebtedness of the City of San Bernardino,
12
which said bonded indebtedness was outstanding or theretofore authorized and is
13
outstanding at the time of said annexation, to wit:

A bonded indebtedness of $490,000.00, incurred for the acquisition and
15
construction of a public library, including additions to and enlargements to the
16
public library system of said City, the outstanding indebtedness thereon being
17
$265,000.00, bearing interest at the rates of 4-3/4%, 3-1/4% and 3-1/2% per ann ;

A bonded indebtedness of $1,116,000.00, incurred for the acquisition
19
and construction of additions to, relocations of and replacements of the fire
20
fighting system of said City, the outstanding indebtedness thereon being
21
$765,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2%
22
per annum.

SECTION FOUR: The property herein annexed is declared to be a part
24
of Ward 4, and the boundaries of Ward 4 are hereby altered to include said
25
annexed territory, with zoning classification as follows:

R-1-7200 Single Family Residential Zoning District.

SECTION FIVE: That the area included in the above annexation is
28
hereby detached from County Service Area No. SL-1.

I HEREBY CffitTIFY that the foregoing ordinance was duly adopted by
30
the Mayor and Common Council of the City of San Bernardino at a regular meeting
31
