HomeMy WebLinkAbout3099 r~UG 18 19tp LUCI E GOFORTH, CityCler 1 1 ORDINANCE N0, ~ `~'-{~s 2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDI- NANCE NOo 1983 ENTTTLED IN PART "AN ORDINANCE REGULATING EN- 3 CROACHMENTS o o ,"; AND MODIFYING THE RULES AND REGULATIONS AND THE FEES FOR INCROACHMENT PERMITS, 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 5 DO ORDAIN AS FOLLOWS; i 6 SECTION to Ordinance Noo 1983, SECTION TWO Subsection (a) 7 is hereby amended to read as followso 8 "(a) Each applicant, before obtaining an encroachment ~ 9 permit, shall pay a fee therefor as followso 10 to For each space of twenty-two (22)by eight 11 (8) feet or less, $2,00 per each twenty-four (24) con- 12 secutive hour period, or portion thereof, including Satur- 13 days, Sundays and Holidayso" 14 SECTION 20 Ordinance Noo 1983, SECTION TWO Subsection (b) 15 is hereby amended to read as followso 'k 16 "(bj' The application for such permit shall be filed 17 with said Street Superintendent at least forty-eight (48) lg hours prior to the requested encroachment, obstruction or 19 closingo 20 Each permittee shall agree to and shall provide nec- 21 essary barricades and warning and safety devices and shall 22 take other necessary measures to protect life and property 23 as a condition to the issuance of such permit, ~determina- 24 tion of necessary protective measures shall be at the dis- 25 cretion of the Superintendent of Streetsa" 26 SECTION 3o Ordinance Noo 1983, SECTION TWO Subsection (d) 27 is hereby amended to read as followso 28 "(d) No permit granted under this Section shall be 29 issued unless and until said applicant has executed a good 30 and sufficient surety bond to the City of San Bernardino 31 in a sum designated by the Superintendent of Streets recit- 32 ing that said applicant shall hold the City and its offic- 1 ers, employees and agents harmless from any and all claims, 2 costs, damages or expenses that the City or any of its 3 officers, employees or agents may become obligated to pay 4 by reason of the granting of such permit,the work to be 5 performed or the erection or maintenance of structures, 6 equipment or appliances for which the permit is granted. 7 The Superintendent of Streets may in his discretion waive 8 the requirement of a bond, 9 Each permittee shall execute an agreement to indemnify 10 and hold harmless the City of San Bernardino and its offic- 11 ers, employees and agents against all claims for liability 12 arising out of the work to be performed; and shall present 13 proof of liability insurance covering such work and the 14 operations of his business in amounts of not less than 15 $100,000/$300,000 bodily injury and $25,000 property 16 damage." 17 I HEREBY CERTIFY that the foregoing ordinance was duly 18 adopted by the Mayor and Common Council of the City of San Ber- 19 nardino at a meeting thereof, held on the z0 ~/~ day o 1970 by the following 21 vote, to wito 22 AYESo Councilmen "~ 23 ~ 24 NOES 8 ~~~f yt.?~ 25 ABSENTo ,j/~~ 26 27 Cit C~ r c~ 28 The foregoing ordinance is hereby approved this ~~~~day 29 of , 1970. 30 "'~ / ~ - 31 Appro ed as to ,f~or~~-~ y r o ) ity o an ernar nc 32 ~ ~ ' <P>y torney
