HomeMy WebLinkAbout3112 ~ I I it F A I L E D 1 ORDINANCE N0 2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNERATION OF DISTRICT N0. 244 (LAFC 859). 3 4 WHEREAS, heretofore, proceedings were initiated by the Common 5 Council of the City of San Bernardino, on its own motion, to annex to the I 6 City of San Bernardino certain contiguous uninhabited territory hereinafter 7 described; and $ WHEREAS, on the 30th day of March, 1970, a resolution was adopted gi by the aforesaid Common Council of the City of San Bernardino, California, I l0 declaring that proceedings had been initiated by said Council, and proposing 11 the annexation, for the reasons therein stated, of the aforementioned 12 uninhabited territory to the City of San Bernardino, and that said resolution 13i provided that the proposed annexation should be generally known and identified 14 as Annexation District No. 244; and 15 WHEREAS, said resolution set forth therein that all the property 16 included in the aforesaid territory should be taxed equally with the other 17 property within the City to pay the bonded indebtedness and any and all general lg indebtedness and liability of the City of San Bernardino contracted prior to lgi or existing or outstanding at the time of the aforesaid proposed annexation 2p of the aforesaid property as provided in the hereinbefore mentioned Government 21 Code; and 22 WHEREAS, said resolution did fix, determine and declare that a 23 hearing be held on the 25th day of May, 1970, at the hour of 9:30 o'clock A, M., 24 in the Council Chambers located in the Garner Building, 392 Court Street, San 25 Bernardino, California, and the same was the day, hour and place designated 2g where any person owning real estate within such territory so proposed to be annex d 27 and having any objections to the proposed annexation, might object before the 2$ Common Council and show cause why such territory should not be annexed; further- 2gi more, the said resolution provided that at any time not later than the said hour i 30~ set, as mentioned hereinbefore for the said hearing, any owner of property 31~I within the said territory proposed to be annexed might file written protest 32 I with the City of San Bernardino against such annexation; and ~I -1- ~i it 1 WHEREAS, on the 25th day of May, 1970, said hearing was continued 2 by the Common Council to the 13th day of July, 1470, at the same hour and place 3 heretofore set forth; and 4 WHEREASy there were eight written protests filed with the City 5 Clerk of the City of San Bernardino prior to 9:30 o'clock A. M„ on the 13th 6I day of July, 1970; and 7' WHEREAS, on the 13th day of July, 1970, the date set for the hearing of 8 protests against the proposed annexation, Resolution No. 10345 was adopted 9~1 by the Common Council of the City of San Bernardino declaring that a majority 10 protest has not been presented; and 111 WHEREAS, it appears to the Common Council of the City of San 12 Bernardino that the aforesaid annexation proceedings have been completed and 13 everything performed at this time in accordance with said Government Code, as 14 mentioned hereinbefoxe, and any and all other laws in any way connected with 15 the said annexation.procedure having been complied with; and 16 WHEREAS, the Common Council of the City of San Bernardino desires to 17 approve at this time the annexation of the aforesaid territory. 18 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 19' BERNARDINO DO ORDAIN AS FOLLOWS: 20 SECTION ONE: That said territory herein described as Annexation 21 District No. 244 is hereby annexed and incorporated in and made a part of the 22 City of San Bernardino. 23 SECTION TWO: The territory herein referred to as being annexed to 24 the City of San Bernardino is particularly described as follows, to wit: 25 That portion of Tract 2404 as per plat recorded in Book 34 26 of Maps, pages 52 and 53, and that portion of the Northeast one-quarter of Section 18, Township 1 North, Range 4 West, 27 San Bernardino Meridian if said Section lines were extended across the Muscupiabe Rancho as per plat thereof recorded in 28 Book 7 of Maps, page 23, all of records of the County Recorder of San Bernardino County, State of California, and those 29~ portions of adjoining streets, described as follows: Beginning at a point on the Fresent Corporate Limits of the 3011 City of San Bernardino, said point being the intersection of the center line of Kendall Drive and the Southwesterly prolongation 311 of the Northwesterly line of Lot 21 of said Tract 2404; thence leaving said City Limit Line Northeasterly along said South- 32~~ westerly prolongation and the Northwesterly line of said Lot 'I I~ -2- I i ll~ 21 a distance of 653.25 feet to the most Northerly Corner I' thereof and being on said City Limit Line; thence along said 2 City Limit Line the following courses and distances; thence Southeasterly along the Northerly line of said Tract 2404 and 3, following its various courses and distances a distance of 2,978,48 feet more or less to the most Easterly Corner of Lot 1 j 4! of said Tract 2404, said point also being on the North line j of said Section 18; thence West along the South line of 5'ii said Lot 1 and the North line of said Section 18 a distance of 565.00 feet, more or less, to the Southeasterly line of I~ 6i the property com~eyed to John V, and Naomi L. Bahr by deed ~, recorded May 7, 1964, Document No. 8l in Book 6143, page 7' 882, Official Records of said County; thence Southwesterly along said Southeasterly line and the Southwesterly pxolonga- $ tion thereof a distance of 100.00 feet, more or less to the ~ center line of said Kendall Drive; thence Northwesterly along 9; the center line of said Kendall Drive a distance of 2200.00 feet, more or less, to the point of beginning. Cgntaining 10 i 40 acres, more or less. 111 SECTION THREE: That the above described property will be subject 12{ to taxation equally with the property within such municipal corporation to 13~ pay its proportion of the following bonded indebtedness of the City of San 14~ Bernardino, which said bonded indebtedness was outstanding or theretofore 15I authorized and is outstanding at the time of said annexation, to wit: 16 A bonded indebtedness of $490,000.00 incurred for the acquisition 17 and construction of a public library, including additions to and enlargements 18I of the public library system of said City, the outstanding indebtedness 19 ' thereon being $265,000.00, bearing interest at the rates of 4-3/4%, 3-1I2% and 20~ 3-1/4% per annum; 21 A bonded indebtedness of $1,116,000.00 incurred for the acquisition 22 and construction of additions to, relocations of and replacements of the fire 23 fighting system of said City, the outstanding indebtedness thereon being 24 $765,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2% 25I per annum. 26 SECTION FOUR.: The property herein annexed is declared to be a part 27 of Ward 5, and the boundaries of Ward 5 are hereby altered to include said 28' annexed territory, with zoning classifications as shown on a map filed in the 29 office of the City Clerk titled, "Exhibit A", and described as follows: 30~ "0" Open District: 31 Lots 16 and 17, Tract No, 2404 i 32 '.
