2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO APPROVING THE ANNERATION OF DISTRICT N0. 253 (LAFC 906},

4 WHEREAS, heretofore, proceedings were initiated by the Common
5 Council of the City of San Bernardino, on its own motion, to annex to the
6 City of San Bernardino certain contiguous uninhabited territory hereinafter
7 described; and
8 WHEREAS, on the 3rd day of August, 1970, a resolution was adopted
9 by the aforesaid Common Council of the City of San Bernardino, California,
10 declaring that proceedings had been initiated by said Council, and proposing
11 the annexation, for the reasons therein stated, of the aforementioned
12 uninhabited territory to the City of San Bernardino, and that said resolution
13 provided that the proposed annexation should be generally known and identified
14 as Annexation District No. 253; and
15 WHEREAS, said resolution set forth therein that all the property
16 included in the aforesaid territory should be taxed equally with the other
17 property within the City to pay the bonded indebtedness and any and all general
18 indebtedness and liability of the City of San Bernardino contracted prior to
19 or existing or outstanding at the time of the aforesaid proposed annexation
20 of the aforesaid property as provided in the hereinbefore mentioned Government
21 Code; and
22 WHEREAS, said resolution did fix, determine and declare that a
2 3 hearing be held on the 14th day of September, 1970, at the hour of 9:30 o'clock
24 A, M., in the Council Chambers located in the Garner Building, 392 Court Street,
25 San Bernardino, California, and the same was the day, hour and place designated
26 where any person owning real estate within such territory so proposed to be
27 annexed and having any objections to the proposed annexation, might object
28 before the Common Council and show cause why such territory should not be
29 annexed; furthermore, the said resolution provided that at any time not later
30 than the said hour set, as mentioned hereinbefore for the said hearing, any
31 owner of property within t he said territory proposed to be annexed might file
32 written protest with the City of San Bernardino against such annexation; and

1 ~ WHEREAS, there were no written protests filed with the
2 City Clerk of the City of San Bernardino prior to 9:30 o°clock A. M„ on the
3 14th day of September, 1970; and
4 WHEREAS, on the 14th day of September, 1970, the date set for the
5 hearing of protests against the proposed annexation, Resolution No, 10432
6 was adopted by the Common Council of the City of San Bernardino declaring that
7 a majority protest has not been presented; and
8 WHEREAS, it appears to the Common Council of the City of San
9 Bernardino that the aforesaid annexation proceedings have been completed and

10 everything performed at this time in accordance with said Government Code, as
11 mentioned hereinbefore, and any and all other laws in any way connected with
12 the said annexation procedure having been complied with; and
13 WHEREAS, the Common Council of the City of San Bernardino desires to
14 approve at this time the annexation of the aforesaid territory.
15 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
16 BERNARDINO DO ORDAIN AS FOLLOWS:
17 SECTION ONE: That said territory herein described as Annexation
I8 District No. 253 is hereby annexed and incorporated in and made a part of the
19 City of San Bernardino.
20 SECTION TWO: The territory herein referred to as being annexed to
21 the City of San Bernardino is particularly described as follows, to wit:
22 That portion of Block 41, Rancho San Bernardino, as per plat thereof
recorded in Book 7 of Maps, Page 2, records of the County Recorder
23 of San Bernardino County, State of California; that portion of
Tract 2624 as per plat thereof recorded in Book 37 of Maps, Page
24 30, records of said County; that portion of Tract 1964 as per
plat thereof recorded in Book 28 of Maps, page 46, records of said
25 County and those portions of adjoining streets, described as
follows:

Beginning at a point on the Present Corporate Limits of the City
27 of San Bernardino, said point being the intersection of the center
line of Baseline Street, 82.50 feet wide and the Northerly pro-
28 longation of the East line of Bobbett Drive, 54.00 feet wide; thence
North along said City Limit Line and the Northerly prolongation of
29 the East line of said Bobbett Drive a distance of 41.25 feet to
the North line of said Baseline Street; thence East along said City
30 Limit Line and the North line of said Baseline Street a distance
of 100.00 feet more or less to the center line of Cedar Avenue;
31 thence North along the center line of said Cedar Avenue and said
C~,ty Limit Line a distance of 170.00 feet more or less to the
32 Westerly prolongation of the South line of Lot 15, Tract 2307 as
per plat thereof recorded in Book 33 of Maps, Page 49, records
of the County Recorder of said County; thence leaving said City

1 i Limit Line East along said Westerly prolongation, the South
line of said Lot 15 and the Easterly prolongation thereof a
2 distance of 213.00 feet more or less to the most Easterly Weat
line of Lot 4 of said Tract 2624; thence South 5.00 feet to the
3 South line of said Lot 4; thence East along the South line of
said Lot 4 and the Easterly prolongation thereof a distance of
4 210.00 feet more or less to the center line of Canyon Road;
thence South along the center line of said Canyon Road a distance
5 of 70.00 feet more or less, to the Westerly prolongation of the
South line of the North 50.00 feet of Lot 60 of said Tract 2624;
6 thence East along said Westerly prolongation and the South line
of said North 50.00 feet of Lot 60, a distance of 120.00 feet
7 to the East line of said Lot 60; thence North along the East line
of said Lot 60 and the Northerly prolongation thereof a distance
8 of 70.00 feet more or less to a point on the South line of Lot 59
of said Tract 2624; thence East along the South line of said Lot
9 59 and the Easterly prolongation thereof a distance of 148.00
feet more or less to the West line of the property comTeyed to
10 Joseph W. Sessmms, et ux, by Deed No. 283 recorded August 21,
1964 in Book 6216, Page 542, Official Records of said County;
11 thence South along the West line of said Sessoms property a
distance of 70.00 feet more or less to the South line of the
12 North one-half of Lot 1, Block 1 of said Tract 1964; thence East
along said South line of the North one-half of said Lot 1 a distance
13 of 196.00 feet more or less to the center line of Barton Street;
thence North along the center line of said Barton Street a
14 distance of 300.00 feet more or less to the Westerly prolonga-
tion of the North line of Lot 2, Block 2, of said Tract 1964;
15 thence East along said Westerly prolongation, the North line
of said Lot 2, the North line of Lot 25, Block 2 of said Tract
16 1964, and the Easterly prolongation thereof a distance of 440.00
feet more or less to the center line of Perris Hill Road; thence
17 South along the center line of said Parris Hill Road a distance
of 440.00 feet more or less to the center line of Baseline Street
I8 and said City Limit Line; thence West along the center line of
said Baseline Street and said City Limit Line a distance of
19 1430.00 feet more or less to the point of beginning. Containing
8.23 acres, more or less.

21 SECTION THREE: That the above described property will be subject
22 to taxation equally with the property within such municipal corporation to
23 pay its proportion of the following bonded indebtedness of the City of San
24 Bernardino, which said bonded indebtedness was outstanding or theretofore
25 authorized and is outstanding at the time of said annexation, to wit:
26 A bonded indebtedness of $490,000.00 incurred for the acquisition
27 and construction of a public library, including additions to and enlargements
28 of the public library system of said City, the outstanding indebtedness
29 thereon being $265,000.00, bearing interest at the rates of 4-3/4%, 3-1/2% and
30 3-1/4% per annum;
31 A bonded indebtedness of $1,116,000.00 incurred for the acquisition
32 and construction of additions to, relocations of and replacements of the fire

1 fighting system of said City, the outstanding indebtedness thereon being
2 $765,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2,9% and 2-1/2%
3 per annum,
4 SECTION FOUR: The property herein annexed is declared to be a part
5 of Ward 2, and the boundaries of Ward 2 are hereby altered to include said
6 annexed territory, with zoning classifications as shown on a map filed in the
7 office of the City elerk titled, "Exhibit A", and described as follows:
8 R-3-3000 Multiple Family Residential District
The North 50 feet of lot 1, all of laffi 2 and 25,
9 Block 2, Base Line Gardens Tract No. 1964.
10 C-3 General Commercial District
Lots 1, 2, 3, 60, and the west 74 feet, more or less,
11 of lot 61, Tract No. 2624; the south one-half of the
east 175 feet, more or less, lot 1, Block 1 and the
12 south 150 feet of lot 1 and all of lot 26, Block 2,
Tract No. 1964; and that portion lot 1, Block 41,
13 Rancho San Bernardino described as follows: Beginning
at the northeast corner Base Liae Street and Cedar
14 Avenue; thence north 175 feet; thence east 180 feet;
thence south 175 feet; thence west 180 feet to the
15 point of beginning.
16 "0" Oven District
The west 25 feet, more or less, of the south 165 feet,
17 more or less, of lot 1, Block 1, Base Line Gardens
Tract No. 1964 and that portion lot 1, Block 41, Rancho
18 San Bernardino and lot 61, Tract No, 2624 described as
follows: Beginning at the southeast corner lot 59,
19 Tract No. 2624; thence east 97 feet, more or less;
thence south to the north line of Base Line Street;
20 thence west along the north line of Base Line Street
approximately 105 feet to a point which is 74 feet,
21 more or less, east of the west line of lot 61, Tract
No. 2624; thence north to the north line said lot 61;
22 thence east approximately 8 feet to the northeast
corner said lot 61; thence north to the point of
23 beginning.
24 SECTION FIVE: That the area included in the above annexation is
25 hereby detached from County Service Areas Nos. SL-1, 38 and 70.
26 I HEREBY CERTIFY that the foregoing ordinance was duly adopted by
2'7 the Mayor and Coon Council of the City of San Bernardino at a regular
28 meeting thereof, held on the 21st day of September, 1970, by the following
29 vote, to wit:
